HomeMy WebLinkAboutContract 30535 AMENDMENT NO. 4 STATE OF TEXAS § CITY SECRETARY CONTRACT NO.c, � (No M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Transystems Corporation Consultants (Engineer) made and entered into City Secretary Contract No. 26807 (the Contract) which was authorized by the City Council by M&C C-18571 on the 26th day of April, 2001; and WHEREAS, the Contract involves engineering services for the following project: Engineering Contract for Sanitary Sewer Main 244A Parallel Relief Study and Design WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated August 26, 2004, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $19,546.52 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$1.017,901.00 3. All other provisions of the contract, which are not expressly amended herein, shall remain in full force and effect. This amendment includes additions and deletions to the Contract. The amendment increases the Contract by $19,546.52 from $998,354.48 to $1,017,901.00. Items added to the contract include a 36" Bypass sewer along US 80, SRF Environmental Informational Document (EID), Supplemental Pipe Testing Specification, breaking plans into additional phases and reproduction. Items deleted from the Contract include survey and design items relating to the cancellation of proposed sewers to service the Far East Fort Worth Homeowners Association. Design the 36" bypass line from the parallel collector to M-503. This sewer will be approx. 800 If. Revolving Fund: Environmental $24,000.00 Tasks include preparation of Environmental Information Documentation per SRF guidance, provide environmental constraints information, attend one Public Meeting, preparation of report, respond to comments on Environmental Information Document and contact. This also includes a TWDB requirement for a biologist to review the project for Threatened or Endanger Species and their habitat. Attached is the scope from the biologist. Breaking Plans into Additional Phases $10,000.00 Amendment 1 broke the Plans and Specifications into 2 phases (Phase 1 and 2). The City directed TranSystems to divided into four phases. This items includes dividing the Plans and Specifications for Phases 3 and 4. Reproduction $8,250.00 The number of plan set delivered to the City exceeded the bid proposal. Phase 1 require 55 sets of plans and specifications. This fee item is for 30 additional bid packages for phases 1 and 2 and 110 bid packages for phases 3 and 4. The total is based on 140 packages at $75.00 ea. Fee does not include printing for rebidding any phases. Review Sequence of Construction Contracts $2,500.00 The City directed TranSystems to review the sequence of the four construction contracts and existing sewer system to determine ideas to reduce the overflow into the Arlington Rush Creek Sewer along Hwy 80. Developing this $ 50,215.00 testing program includes the below tasks. TranSystems will team with a testing specialist to develop the specification. TranSystems will supervise and review the testing specifications. TranSystems will be involved in meeting with the City, vendors, and testing organizations. Due to the limited timing of the task, TranSystems will provide supporting services to the specialist by supplying project documents, negotiating with testing organizations and developing the boiler plate specification to compliment the testing sections. Kanninen, PhD Submitted on July 14, 2004 Introduction MFK Consulting Services(MFKCS)has reached a general understanding with TranSystems Corporation Consultants (TSCC)on the assistance that MFKCS can provide to TSCC in the Village Creek sewer construction project that it is conducting for the City of Fort Worth(CFW). The discussions that have led to this understanding have centered on the technical issues associated with the pipe material selection process that has so far precluded this project from being initiated. Based on previous knowledge of the mechanical behavior of sewer pipe, and on the testing that can be conducted to quantify this behavior,MFKCS believes that it can be of direct assistance in achieving a prompt resolution of the problem. Background It is clear that the basic impediment to the initiation of CFW's Village Creek sewer project is an intertwined combination of technical issues and conflict resolution. There are two over riding-- and directly conflicting--concerns. First,because the CFW is under great pressure to complete the project,any further delays in initiating it will be difficult for them to accept. Second,because it appears that a wide range of pipe types will be proposed for this project by contractors who will utilize vendors possibly having significantly different capabilities for making pipe,time is needed to develop a fair competition that will at the same time assure that the City will have a credible product installed. Because it will additionally serve to provide a sound platform for awarding contracts for future sewer projects, the approach that is most appropriate for initiating CFW's Village Creek sewer construction project is one that provides the most reasonable compromise between a swift resolution and one that requires more time but provides a technically satisfactory resolution of the problem. The assistance that MFKCS can provide to TSCC in developing and implementing this compromise approach is as follows. v�U ?V3 EXHIBIT A Proposed Work Scope Five tasks are proposed to be performed by MFKCS under the general supervision of TSCC in support of their work on the CFW's Village Creek sewer construction project. The consulting hours and other costs needed to perform the work in each of these tasks are estimated in a tabulation that appears on page 4. Task 1: Develop Supplemental Testing Program Starting immediately, a thorough search will be made to identify, acquire and assimilate all pertinent ASTM and other standards now available for testing sewer pipe and sewer pipe materials. This review is expected to lead to the development of a small—but comprehensive—set of standardized tests that can be included in a specification document. This set of tests will be selected to effectively screen all of the various pipe products that are likely to be included in the contractor bids that will be given to the CFW for its Village Creek project, and for all foreseeable future sewer projects,without unnecessarily burdening the pipe vendors. A draft version of a complete specification document embodying this information will be provided to TSCC for their review on August 26,2004. A final version of the specification incorporating TSCC comments and other input is to be submitted to the CFW for their disposition by August 30,2004. Task 2: Identify Suitable Independent Testing Organizations In parallel with the identification of a set of effective screening tests,an effort will be made to identify the best qualified independent testing organizations that can perform the tests on pipe provided by the vendors. Candidate organizations are Stress Engineering Services,Houston, TX; the Southwest Research Institute, San Antonio,TX,the Trenchless Technology Center at Louisiana Tech University, Ruston,LA; and MACTEC, Inc., in Ft. Worth, TX. Contacts will be made to assure that these organizations (and possibly others) have the requisite testing capabilities,and that they also could conduct the testing in an expeditious manner. Site visits to the leading candidate organizations will be made to assure that the requirements of this program can be fully met. Appropriate contact information on at least one testing organizations meeting these requirements will be provided to TSCC for their negotiation with them. This identification will be provided by August 23,2004. Task 3: Review and Critique Data from Pipe Manufacturers A critical assessment will be made of the technical data developed by the manufacturers on the performance of their pipe. These data are expected to be available for review in mid September; i.e., at the pre-bid conference. Participation in the pre-bid conference is also anticipated to assist,as needed, in the presentation of the supplemental testing program plan. 2 Q = i EXHIBIT A Task 4: Observe and Assimilate Testing Conducted by Independent Organization At an appropriate time after testing has commenced, a visit to the independent testing organization that has been selected by TSCC will be made to observe their procedures, review preliminary data, and,to the extent possible,help expedite their progress. At the completion of the testing, a detailed review of the data that have been generated will be conducted, and recommendations made to TSCC in regard to the acceptability of the selected pipe vendor for them to provide to the CFW. Task 5: Develop Long Range Comprehensive Pipe Qualification Plan While the work in tasks 1 to 4 will be aimed specifically at the Village Creek project, this work will also provide a foundation for a general procedure that CFW can utilize in future construction projects. The work in this task which will be carried out in parallel with the preceding tasks,will include(i)making systematic contacts with progressive municipalities(e.g., The City of Houston, TX; The County of Los Angeles, CA)to learn about the strengths and weaknesses of their systems, (ii)identifying key technical issues together with strengths and weaknesses in the CFW's planning, contracting and acquisition systems, (iii)discussing the"lessons learned"in this activity with TSCC and the CFW,and (iv)if warranted by the above, scoping further work needed to develop an enhanced approach for sewer and other projects that the CFW could adopt. The anticipated product of this task would be a well documented set of procedures that would streamline and standardize the qualification and supervision of CFW contractors for future sewer(and other) city projects. Cost and Time Estimates The cost estimates by task for MFKCS participation in this work are provided in the following tabulation. These estimates include the real and actual costs of travel approved by TSCC, and of the acquisition of pertinent reference material, as needed and approved by TSCC. The time costs in this tabulation are entirely those of Dr. Melvin F.Kanninen, and are based on the following billing rates: Consulting time ..................... $200 per hour Unproductive travel time ........... $100 per hour Depositions and live testimony .... $300 per hour The period in which the work that is described in Tasks 1 and 2 above is performed is expected to extend from July 15 through August 31,2004. While the work in Tasks 3 to 5 will be initiated in this period,their completion date cannot be estimated at this time. 3
