HomeMy WebLinkAboutOrdinance 18495-02-2009Ordinance No 18495-02 2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $224 367 03 FROM THE INTEREST EARNED FROM THE UNT HSC COLLABORATIVE AGREEMENT GRANT FROM THE STATE OF TEXAS COMPTROLLER'S OFFICE, FOR THE PURPOSE OF FUNDING THE RENOVATION OF GUINN ELEMENTARY SCHOOL, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009 there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $224 367 03 from the interest earned from the UNT HSC Co{laborative Agreement Grant from the State of Texas Comptroller's Office for the purpose of funding the Renovation of Guinn Elementary School SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisd'+ction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVED AgTf6 FORM Assista ADOPTED AND EFFECTIVE. No. 18495:-02-2009 _ DATE Tuesday February 24 2009 LOG NAME 20GUINNE36YRNE1 REFERENCE NO C-23363 SUBJECT Authorize Change Order No 1 in the Amount of $222 134 00 to City Secretary Contract No 35727 a Construction Manager at Risk Contract with E3 Contract Consultants Inc./Thos S Byrne Ltd a Joint Venture for the Renovation of the Guinn Elementary School and Adopt Appropriation Ordinance RECOMMENDATION It is recommended that the City Council 1 Authorize the use of interest in the amount of $224 367 03 from the State grant; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $224,367 03 from the interest earned thus far• and 3 .Authorize the City Manager to execute Change Order No 1 in the amount of $222,134 00 to City Secretary Contract No 35727 a Construction Manager at Risk contract with E3 Construction/Thos S Byrne Ltd a Joint Venture for the renovation of the Guinn Elementary School located at Interstate 35 South and Rosedale Street, thereby increasing the Construction Manager at Risk contract amount to $1 722,134 00 DISCUSSION On August 15 2006 (M&C C-21618) the City Council authorized the execution of a Construction Manager at Risk (CMAR) contract in the budget amount of $1 500 000 00 with E3 Contract Consultants Inc./Thos S Byrne Ltd (E3/Byrne) a Joint Venture (City Secretary Contract No 35727}, for the renovation of the Guinn Elementary School located at Interstate 35 South and Rosedale Street. A preconstruction services contract in the amount of $10 000 00 was executed with E3/Byrne (City Secretary Contract No 34059) to provide feasibility and constructability reviews and cost estimates during the design phase of the project During the various design phases the architect, construction contractor and staff realized that the total construction could not be completed for the $1 500 000 00 budget. The project will be completed in two phases Phase 1 (Exterior) will structurally stabilize the exterior walls and roof' complete the abatement and demolition replace the roof and second floor structure provide a new roof' repair the exterior masonry' repair or replace the exterior windows provide a new elevator' provide the plumbing for future restrooms and provide new site electrical extension and panels and provide new heating ventilation air conditioning (HVAC) units Phase 2 (Interior) will complete the interior finish out, such as new interior walls and doors, new paint, Logname' 20GUINNE3BYRNEI Page 1 of 3 carpet, and vinyl composition tiles new electrical wiring and light fixtures new HVAC duct extensions computer network wiring and furnishings fixtures, and equipment. Phase 2 can be executed after the completion of Phase 1 and will require additional funds from future State appropriations The available funds are $800 000 00 from State appropriation (first increment), $800 000 00 from State appropriation (second increment) $375 000 00 Economic Development Administration (EDA) grant; $75 000 00 from the City's share for the EDA grant; $375 000 from State Biennium (Fiscal Year 07-08) $75 000 from State Biennium (Fiscal Year 08-09) and $224 367 03 from interests earned from the State appropriations The total of these various funds is $2 724 367 03 The agreement with the State authorizes the use of interest earned on the State funds for this project. The estimated overall cost of the Phase 1 portion is.
