HomeMy WebLinkAboutOrdinance 18513-03-2009Ordinance No 18513-03-2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT OPERATING FUND (R103) IN THE AMOUNT OF $32,123 00 AND DECREASING THE UNRESERVED NET ASSETS BY THE SAME AMOUNT FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE ENVIRONMENTAL MANAGEMENT FUND (R101) FOR A LANDFILL PERMIT MODIFICATION AT THE EASTSIDE LANDFILL, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2008- 2009 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Environmental Management Operating Fund (R103) in the amount of $32,123.00 and decreasing the unreserved retained earnings by the same amount, for the purpose of transferring said funds to the Environmental Management Fund (R101) for a landfill permit modification at the Eastside Landfill SECTION 2 That should any portion section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption. DATE Tuesday March 24 2009 REFERENCE NO *C-23398 LOG NAME 52TRV PROJECT-EASTSIDE LANDFILL-GEOSYNTEC SUBJECT Authorize a Professional Services Contract with Geosyntec Consultants in the Amount of $32 123 00 for a Landfill Permit Modification at the Eastside Landfill RECOMMENDATION It is recommended that the City Council• 1 Adopt the attached supplemental appropriation ordinance increasing appropriations in the Environmental Management Operating Fund (R103} by $32 123 00 and decreasing the Unreserved Net Assets by the same amount; 2 Approve the transfer of $32 123 00 in undesignated funds in the Environmental Management Operating Fund to the Environmental Management Project Fund 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Fund (R101) by $32,123 00 and 4 Authorize the City Manager to execute a Professional Services Contract with Geosyntec Consultants in the amount of $32 123 00 for a landfill permit modification at the Eastside Landfill DISCUSSION As part of the Trinity River Vision project, valley storage areas must be created for flood control Soil that is removed from valley storage areas must be placed in a new location The Eastside Landfill provides this location and allows the former landfill to be better shaped for proposed future uses under the Gateway Park Master Plan Waste Management is the current permit holder for the landfill and is agreeable to allow for such fill provided a successful landfill Permit Modification is approved by TCEQ Waste Management has previously worked with Geosyntec Consultants regarding landfill permit is familiar with the conditions at the site Geosyntec Consultants will provide professional services for the Permit Modification These services will include development of a new grading plan that maintains the integrity of existing landfill gas collection system and does not increase the overall height of the landfill development of updated surface water drainage preparation of a slope stability calculation package and preparation of permit application Additional funds are included for potential Texas Commission on Environmental Quality (TCEQ) revisions and needs regarding the permit modification Based on the proposed scope of services and potential TCEQ revision requests the total not to exceed cost is $32 123 00 and Geosyntec will only bill for time and material expended Logname 52TRV PROJECT EASTSIDE LANDFILL-GEOSYNTEC Page 1 of 2 A waiver for MWBE participation was requested and subsequently approved by the MWBE office The Eastside Landfill is located in COUNCIL DISTRICT 8 FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached supplemental appropriation ordinance funds will be available in the current operating budget, as appropriated of the Environmental Management Project Fund FUND CENTERS TO Fund/Account/Centers FROM Fund/Account/Centers 1) R103 538040 0521100 $32,123.00 2) R103 538040 0521100 $32,123.00 2~ R101 476103 052200906000 $32,123.00 4) R101 539120 052200906000 $32,123.00 R101 539120 052200906000 $32,123.00 CERTIFICATIONS Submitted for City Manager's Office by_ Fernando Costa (6122) Originating Department.
