AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE
AMOUNT OF $25 395 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF
AUTHORIZING CHANGE ORDER NUMBER 3 TO CITY SECRETARY
CONTRACT NUMBER 35396 WITH STABILE & WINN, INC FOR PAVEMENT
RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN
REPLACEMENT ON PORTIONS OF BOMAR AVENUE, CARTER AVENUE,
HARWOOD STREET AND WILKINSON AVENUE, PROVIDING FOR A
SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-
2009 in the Budget of the City Manager there shall also be increased estimated receipts and
appropriations in the Water Capital Projects Fund in the amount of $25 395 00 from available
funds for the purpose of authorizing Change Order Number 3 to City Secretary Contract Number
35396 with Stabile & Winn, Inc. for pavement reconstruction and water and sanitary sewer main
replacement on portions of Bomar Avenue, Carter Avenue, Harwood Street and Wilkinson Avenue
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 18283 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect upon adoption

RECOMMENDATION
It is recommended that the City Council
1 Authorize Change Order No 3 in the amount of $167 244 00 to City Secretary Contract No 35396 with
Stabile and Winn Inc. thereby revising the total cost to $2 259 875 50
2 Authorize transfer of $25 395 00 from the Water and Sewer Operating Fund to the Water Capital
Projects Fund in the amount of $25 395 00
3 Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $25 395 00
DISCUSSION
On May 29 2007 (M&C C-22153) City Council authorized the award of contract to Stabile and Winn Inc.
for the subject project. The project consists of pavement reconstruction and water and sanitary sewer
replacement on Bomar Avenue (Beach Street to Harwood Street and Harwood Street to Barron Street)
Carter Avenue (Beach Street to Harwood Street and Harwood Street to Sanborn Street) Harwood Street
(Scott Avenue to Meadowbrook Drive and Meadowbrook Drive to Purington Avenue) and Wilkinson
Avenue (Beach Street to Harwood Street)
This change order will provide increased pay item quantities of seven inch reinforced concrete and for the
relocation of water service lines on this project.
The net effect of the proposed change order is as follows

The additional cost in this change order for water construction is $25 395 00 Funds of $25 000 00 were

included as contingency for water change orders in this contract. Additional funding in the amount of
$25 395 00 is needed to complete the water construction The additional cost in this change order for
pavement reconstruction is $141 849 00 Funds of $41 516 72 were included in this contract as
contingency for change orders for pavement reconstruction Additional funding in the amount of
$109 332.28 is needed to complete the pavement reconstruction
Stabile and Winn Inc. is in compliance with the City's M/WBE Ordinance by committing to an additional
two percent M/V1/BE participation on this Change Order No 3 which represents the only subcontracting
opportunity
This project is located in COUNCIL DISTRICT 8 MAPSCO 77A, 78A, 78B and 78E
