AMENDMENT No.2 COMRACT NO.
TO CITY SECRETARY CONTRACT No. 44486
WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No. 44486, (the
CONTRACT) which was authorized by M&C C-26249 on the 14th day of May,
2013 in the amount of $ 341, 607. 00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $173, 720 which was authorized by M&C #C-26685 on March
4, 2014 ; and
WHEREAS, the CONTRACT involves engineering services for the
following project :
CAH - Western Avenue Water, Sewer, Drainage and Pavement
Improvements; and
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated November 19, 2014, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $32, 970. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase An
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $547, 847.
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Re: 01776 CAH Western Drainage Improvements Project—Amendment No. 2
Dear Mr.Owen,
Additional services have been requested for the Western Drainage Improvements project(Project No.01776).
The additional scope of work is described below and a detailed fee breakdown is attached.
1. Electrical Design for Streetlights—Illumination plans were prepared to replace the streetlights on
Western Avenue. This request originated with the residents and was approved by City staff. This design
required the creation of three (3)additional sheets and coordination time with Oncor and the City
streetlight department. The fee for this task is$7,720.
2. Design of Interim Surface Detention Basin—FNI prepared an interim design of the surface detention
basin so the surface detention basin could be constructed at the beginning of the construction contract.
This request originated with the residents and was approved by City staff. This design was issued by
addendum and required the creation of one(1) additional sheet, revision of contract documents, and
coordination time with City staff. The fee for this task is$3,160.
3. Revised Sewer Design—During the construction advertisement process, a contractor suggested a change
to the sewer design that is expected to allow for a significant cost savings in construction. Even though
FNI had consulted with the same contractor during the design process,this issue was not raised until
advertisement. Upon further review by the City and FNI, it was decided to revise the sewer design to
remove all private sewer services from the contract and add a new sewer line within Western Avenue.
This required new design of 1000 LF of sewer, re-design of 1000 LF of water,adjustment of storm drain
laterals, re-design of the underground electric line, updates to other relevant sheets,revision of contract
documents, and coordination time with City staff. A total of 17 sheets were impacted by this change.
The fee for this task is$22,090.
The total for the proposed services is$32,970. The revised total contract amount is$547,847. We appreciate
