FOR ARCHITECTURAL DESIGN SERVICES
BOTANIC GARDEN GREENHOUSE

WHEREAS, The City of Fort Worth and GSBS Batenhorst, Inc. (Architect) made and entered into City
Secretary Contract No. 28212 (The Contract) which was authorized by the City Council by M&C C-19270,
the 1 st day of October, 2002; and
WHEREAS, further amendment is necessary to reimburse the Architect $20,950 for modification of
design to include changes in project scope, Mechanical, Civil, Electrical and Structural Engineering design
costs, TXDOT-required Traffic Impact Study and site improvements for adjacent parking lot including
Architectural design coordination costs.
NOW THEREFORE, City and Architect, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:
1.
Article 1.1, SECTION I —SERVICES OF THE ARCHITECT, a third-paragraph is added to read as follows:
"Provide additional design services to include changes in scope, TXDOT Traffic Impact Study
and coordination of site improvements for adjacent parking lot. The cost of this additional service
is$20,950.00."
2.
Paragraph 1 of SECTION V- COMPENSATION TO ARCHITECT, is amended as follows:
"The total compensation for all of the assignments to be performed by Architect as described in
CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of
$95,700.00."
3.
All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

Re: Fee Proposal for Fort Worth Botanical Garden New Service Center—Phase One
Additional Services
(Original Contract Authorization C-19270 dated October 1,2002)
Dear Ms. Richardson:
GSBS is presenting the following fee proposal for additional services for design and construction related
services.
These additional services reflect a project scope change required to incorporate items impacting our initial
project due to unforeseen situations.
Listed below are the three items we are presenting, for your acceptance, for inclusion into a successful
and cohesive project.
Item 1
Changes are included in the scope of work, at the Design Development stage, and approved by your
department. This work included alterations to omit or reduce the greenhouse size,plumbing fixtures,
furnishings, site work, and the black out cloth system. Professional fees included,not only architectural
fees,but Civil Engineering,Mechanical and Electrical Engineering, Structural Engineering, and our
pricing consultant. This work is complete.
TOTAL ADDITIONAL FEE(as previously approved by your department April 7,2005) $4,500.00

GSBS
This analysis is being required by TxDOT as part of a request to increase width and improve the

Item 3
Item 3 includes design and engineering services for site improvements to the adjacent parking lot(the
west portion of the property occupied by Lockheed Martin). Design service phases will include:
Construction Documents,Bidding, and Construction Administration,as well as a TxDOT permitting
package. This work will include an increase in width and re-design of the existing drive approach,
additional asphalt paving,re-striping the existing paving, and fencing relocation,plus an erosion control
plan. The drive approach will be designed to TxDOT standards. This will be a separate construction
document package, apart from the Fort Worth Botanic Garden Greenhouse project, and will require a
separate building permit. We do intend for this to be accepted for bid by the same construction company
as will be under contract for the Greenhouse. The work may be staged and phased,to insure Lockheed
Martin employees constant access to the parking lot, but we expect some work to be concurrent. We
propose the package be unified under one contract with the construction company performing all the
work.
Not included in this item are design changes that may be required by the Traffic Impact Analysis or
TxDOT, such as the addition of a deceleration lane or turning lane, or moving a drive approach, on the I-
30 access road.Not included in Item 3 are reimbursable expenses(printing,TAS review or inspection if
required).
TOTAL ADDITIONAL FEE(STIPULATED SUM) $7,400.00
Summary and Acceptance:
We shall consider a return of this letter with your signature as acknowledgment of your acceptance of the
Agreement giving us authorization to proceed, and to prepare formal agreements using the AIA
Documents if deemed necessary by GSBS.
