AMENDMENT NO. 1 TO CITY SECRETARY
CONTRACT NO. 27304
THIS Contract Amendment is entered into by and between the City of Fort Worth
("City "), a home-rule municipality located in Tarrant County, Texas, acting by and
through Libby Watson, its duly authorized Assistant City Manager, and Heritage
Environmental Services, Inc. ("Contractor"), by and through Gt;N E lA,s cis-rE� ,

WHEREAS, the City and Heritage Environmental Services, Inc., have entered into
that certain agreement identified as City Secretary Contract No. 27304 for a period
beginning January 1, 2003 and ending December 31, 2003 with two one-year
extensions;
WHEREAS, Heritage Environmental Services, Inc. was hired for the transport and
disposal of household hazardous waste collected by the City's Environmental
Collection Center ("ECC");
WHEREAS,the last quarter of the calendar year resulted in a 19% increase in the use
of the household hazardous waste program for participating cities and at the ECC;
WHEREAS, the City Council authorized the City Manager to increase the current
contract's not-to-exceed amount by$57,900 for the 2003 year and for the two renewal
option years by M&C C-19953;
WHEREAS, it is the mutual desire of the parties to amend said City Secretary
Contract No. 27304 by increasing the contract not-to-exceed amount to $362,900
annually.
NOW, THEREFORE, THIS CONTRACT FURTHER WITNESSETH:
The compensation provision of City of Fort Worth's Contract with Heritage
Environmental Services, Inc., identified as City Secretary Contract No. 27304,
currently on file in the office of the City Secretary of the City of Fort Worth, Section
6.A is hereby amended to read as follows:

City agrees to pay Contractor for its services on a cost basis as
delineated in the Proposal Documents. City and Contractor agree that
the total cost of this contract shall not exceed $362,900 annually.
All other terms and conditions of City Secretary Contract No. 27304 remain in full
force and effect.

Approval of Supplemental Appropriation Ordinance and Authorization to Amend the Contract with
Heritage Environmental Services, Inc. for the Transportation and Disposal of Household Hazardous
Waste for the Environmental Collection Center
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached supplemental appropriation ordinance increasing appropriations and estimated
receipts by $57,900 from available funds in the Environmental Management Operating Fund; and
2. Authorize the City Manager to execute Amendment No. 1 to City Secretary Contract No. 27304 with
Heritage Environmental Services, Inc. for the transportation and disposal of household hazardous waste at
the Environmental Collection Center for an additional $57,900, thereby increasing the total contract amount
to $362,900 for the contract period January 1, 2003 through December 31, 2003, and for the renewal
option terms for 2004 and 2005.
DISCUSSION:
On October 2, 2001 (M&C C-18763), the City Council awarded a $305,000 contract to Heritage
Environmental Services, Inc. for the transport and disposal of household hazardous waste collected at the
Environmental Collection Center (ECC). The estimated not-to-exceed amount was based on the increase
in estimated service numbers and an approximation of waste volumes based on previous years
performance. The participation/utilization rate at the ECC, which provides Fort Worth and surrounding area
citizens a convenient place to dispose of household hazardous waste, has greatly increased within the last
several years. In 2002, the ECC accepted household hazardous waste from 15,629 participants and in
2003, from 17,076 participants. With the increase in participation, the ECC also realized an increase in the
volume of waste collected at the facility. Uncharacteristic to previous years, the last quarter of calendar
year 2003 resulted in a 19% increase in usage over previous years and the acceptance of significantly more
waste than anticipated. For the calendar year 2003, the ECC was $57,900 over estimates for waste
disposal as a result of the center's popularity.
Amending the existing contract from $305,000 to $362,900 will cover outstanding invoices from January to
December 2003. Additionally, the renewal amounts for this contract will be raised to $362,900, annually, to
cover the anticipated cost increase for 2004 and the remaining annual renewal option in 2005. The cost of
these services will be paid from revenues generated by the Environmental Protection Fee and fees charged
to participating cities for use of the facility and its services.
MI BE - A waiver of the goal for M/WBE subcontracting requirements was requested by the department
and approved by the M/WBE Office because the contract requirements and the purchase of services is from
sources where subcontracting or supplier opportunities are negligible.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon adoption of the attached supplemental appropriation ordinance,
funds will be available in the current operating budget, as appropriated, of the Environmental Management
Fund.
