HomeMy WebLinkAboutOrdinance 21562-12-2014 ORDINANCE NO.21562-12-2014 AN ORDINANCE VACATING, ABANDONING AND EXTINGUISHING A PORTION OF MOSIER VIEW COURT, A PRIVATE STREET, UTILITY EASEMENT AND EMERGENCY ACCESS EASEMENT, LOCATED WITHIN BLOCK 100 OF RIVERBEND EAST OFFICE PARK, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS RECORDED IN VOLUME 388-186, PAGE 91 OF THE PLAT RECORDS, TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY 21,442 SQUARE FEET OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Mosier View Court, a private street, an emergency access easement and utility easement, situated in Block 100, Riverbend East Office Park, an addition to the City of Fort Worth, Tarrant County, Texas, containing approximately 21,442 square feet of land, and as recorded in Volume 388-186, Page 91 of the Plat Records of Tarrant County, Texas, and as more specifically described in Exhibits "A" and "B", attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished. SECTION 2. That the fee to the land in the above described vacated private street, emergency access easement and utility easement is hereby released and shall revert to the adjacent owner as provided by law. Adopt the attached ordinance vacating a portion of Mosier View Court, a private street, to be replatted with the adjoining property for additional parking for the existing industrial development for Beloit Tarrant 1, LLC; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy. DISCUSSION: JB Davies, Inc., on behalf of Beloit Tarrant 1, LLC, has requested the vacation of this portion of Mosier View Court to replat it with the adjoining property for additional parking for the existing industrial development. The City Plan Commission recommended approval of this request at its meeting on August 27, 2014. An acceptable final plat (FS-014-142) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's Policy Regarding Street and Alley Vacation Transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley. This project is located in COUNCIL DISTRICT 4, Mapsco 66J.
