Home My WebLink AboutOrdinance 21591-12-2014 Ordinance No.21591-12-2014 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $2,426,364.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING WATER AND SANITARY IMPROVEMENTS ON BELLAIRE DRIVE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $2,426,364.00, from available funds, for the purpose of funding Water and Sanitary Improvements on Bellaire Drive. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of$4,358,805.00 from the Water and Sewer Operating Fund in the amounts of $1,932,441.00 to the Water Capital Projects Fund and $2,426,364.00 to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinances increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$1,932,441.00 and in the Sewer Capital Projects Fund in the amount of$2,426,364.00; and 3. Authorize the execution of a contract with Conatser Construction TX, LP, in the amount of $7,759,588.70 for Bellaire Drive Water, Sanitary Sewer and Storm Drain Improvements. DISCUSSION: On July 16, 2013, (M&C C-26346) the City Council authorized an Engineering Agreement with Teague Nall & Perkins, Inc., for the design of Bellaire Drive Water and Sanitary Sewer Improvements on Bellaire South Drive and Bellaire West Drive. This contract was subsequently amended to include the design of Overton Park East Drive sewer improvements by Amendment No.1 in the amount of$44,120.00, which was administratively authorized on February 19, 2014. On July 9, 2013, (M&C C-26319) the City Council authorized an Engineering Agreement with Dunaway Associates, L.P., for the design of Bellaire Park Court Drainage Improvements. In order to achieve construction efficiencies, the two projects were combined and bid collectively. M/WBE Office - Conatser Construction TX, LP, is in compliance with the City's BDE Ordinance by committing to 15 percent MBE participation on this project. The City's MBE goal on this project is 15 percent. This project is located in COUNCIL DISTRICT 3, Mapsco 75Y, 75Z, 89C, 89D and 89G. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinances, funds will be available in the current capital budgets as appropriated, the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Stormwater Capital Projects Bond Fund.
