HomeMy WebLinkAboutContract 29043 AMENDMENT NO. 4 STATE OF TEXAS $ CITY SE CRE TARY CONTRACT NO. 0 q-3 (No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Wendy Lopez & Associates, (Engineer) made and entered into City Secretary Contract No. 26994 , (the Contract) which was authorized by the City Council by M&C C-18701 on the 9th day of August 2001; and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Water and Sewer Extension for the Bryson Tract Area. WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated August 6, 2003, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $6,748.88. 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $114,133.48. 09-02-03 ORIGINAL r: 3. Project Manager City of Fort Worth Department of Engineering 900 Monroe Street Suite 201 Fort Worth, Texas 76102 RE: Request for Amendment No. 4 Water and Sewer Extension for Bryson Tract, D.O.E. 3312 LGG Project No. 210069.00 Dear Mr. Domenech: This letter is in response to your request for additional surveying, engineering design services and Storm Water Pollution Prevention Plan (SWPPP) and report. A detailed breakdown and summary of estimated fees are attached. A description of the additional work is as follows: The final plans and easements to be acquired were submitted to the City. Boswell property owners agreed to sign 30 feet of permanent and 20 feet of temporary easement on the south side of the property. When the Real Property Department of the City of Fort Worth wanted to acquire the easements from the Boswell property, the property owners changed their minds and didn't want to provide the City the required easements. To meet the requirements of the property owners, the easement width had to be reduced to 25 feet of permanent and 15 feet of temporary, which resulted in the change in alignment of the 8-inch sanitary sewer along the south side of the Boswell property. Also new permanent easement and temporary easement documents had to be prepared. To meet the requirements of the Envionmental protection Agency (EPA) and the Texas Commission on Environmental Quality(TCEQ), the City has adopted a policy of adding SWPPP plans and report. The additional plans and SWPPP report will be incorporated into the 100% plan submittal and will also include two (2) revised plan and profile sheets. Domenech, P.E. i �` t) DATE: August 11, 2003 RE: DESIGN FEE AMENDMENT NO. 4 TO WATER AND SEWER EXTENSION FOR THE BRYSON TRACT AREA. DOE NO. 3312 The proposed amendment will allow Wendy Lopez & Associates, Inc. dba LOPEZGARCIA GROUP, to provide additional engineering services on the project as requested by the City. In order to obtain two permanent easements from a property owner, it is necessary to change the sanitary sewer alignment and prepare the necessary easements to reflect the changes. Further, in order to comply with the latest requirements of the Texas Commission on Environmental Quality (TCEQ), it is necessary to prepare a Storm Water Pollution Prevention Plan. Wendy Lopez & Associates, Inc., dba LOPEZGARCIA GROUP has submitted a proposal in the amount of$6,748.88 for the additional service to be provided thereby increasing the contract fee from $107,384.60 to $114,133.48. 1 believe this fee is fair and reasonable for the additional services.
