HomeMy WebLinkAboutOrdinance 21589-12-2014 ORDINANCE NO.21589-12-2014 AN ORDINANCE ADOPTING A PER ACRE CHARGE PURSUANT TO CHAPTER 35 OF THE CITY CODE AS AMENDED (1986), ARTICLE III, DIVISION 3 "SEWER PER ACRE CHARGES", SECTION 35-81 THROUGH 35-86, FOR THE 1,055.59 ACRES SERVED BY CITY INITIATED SEWER MAIN UNDER DOE #5580 (THE "HICKS INDUSTRIAL PARK SEWER IMPROVEMENTS"); MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE,AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on May 14, 2002, the City Council adopted City of Fort Worth Ordinance No. 15095 providing for the adoption of per acre charges when certain criteria are met; and WHEREAS, on May 20, 2014 the City Council adopted City of Fort Worth Ordinance No. 21251 amending the Ordinance No. 15095 by removing the restrictions of the pipe length or pipe size. WHEREAS, the City of Fort Worth constructed City initiated sewer main under DOE #5580 (the "Hicks Industrial Park Sewer Improvements") and such City initiated sewer main is 18-inches, 15-inches, 12-inches and 8-inches in diameter. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. In accordance with the City Code of the City of Fort Worth as amended (1986), Chapter 35 "Water and Sewers", Article III, Division 3 "Sewer Per Acre Charges" Sections 35-81 through 35-86,the City constructed City initiated sewer main to provide wastewater service to Hicks Industrial Park and the surrounding area and that such City initiated sewer main is 18-inches, 15-inches, 12-inches and 8-inches in diameter. Further, the City Ordinance No.21589-12-2014 Page 1 of 3 Council finds that this sewer main will serve a calculated sewer basin area of 1,055.59 acres, such sewer basin being shown in the attached exhibit. This sewer main is located in the Hicks Field Road, East Hicks Field Road and in the easement from Hicks Industrial Park to Wagley Robertson Road in Council District Number 7. SECTION 2. The City Council also finds that $1,368,352 is the Development Cost for the Main, and that $1,296 is the per acre charge to be assessed within the calculated sewer basin. The City Council further fmds that per acre charge has been calculated in accordance with the requirements of City Code Sections 35-81 through 35-86. SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections Ordinance No.21589-12-2014 Page 2 of 3 of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. DISCUSSION: The 18-inch, 15-inch, 12-inch and 8-inch sewer mains from Hicks Field Road to the connection of the existing 27-inch sewer main M-584 were installed by the Fort Worth Water Department. This 12,863 linear feet of the sewer main will serve the Hicks Industrial Park and east to Fossil Park Estates. The qualified costs used to establish this sewer per acre charge are: Sewer Construction Cost $ 1,063,675.00 Engineering Cost $ 246,986.00 Easements Cost $ 57,691.00 Total Cost $ 1,368,352.00 The sewer per acre charge is $1,296.00 per acre in accordance with City Code Section 35-84. This amount will be reimbursed to the Water Department. This sewer main meets the criteria established under the per acre charge policy. The adoption of this charge is in accordance with the City Code and Water Department policies. The sewer main is located in COUNCIL DISTRICT 7, Mapsco 19T, 19W, 19X, 19Y, 19Z, 33A, 33B, 33C, 33D, 33E and 33F.
