BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009 there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $136 731 00 and the Sewer Capital Projects Fund in the amount of $69 109 00 from available funds, for the purpose of authorizing a contract with Tri-Tech Construction, Inc. for Ryan Southeast Drainage Improvements (Project Number 00092) SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVE[YA$'TO FOR1~tI~gcND LF~E'~CLITY ity A ADOPTED AND EFFECTIVE. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $136 731 00 and the Sewer Capital Projects Fund in the amount of $69 109 00 and 3 Authorize the City Manager to execute a contract with Tri-Tech Construction Inc in the amount of $989 073 15 for construction of the Ryan Southeast Drainage Improvements DISCUSSION The 2004 Capital Improvement Program (CIP) included funds for the design of capital projects of storm drain facilities to alleviate recurring flooding problems in various locations On December 21 2004 (M&C C-20451) the City Council authorized the City Manager to execute an engineering agreement with Turner Collie & Braden `Inc. for the design of the Ryan Southeast Drainage Improvements This design resulted in the recommendation for the construction of storm drain facilities in the following locations Talton Avenue Cobb Park Drive to Ash Crescent Street South Riverside Drive Colvin Street to Cantey Street Cantey Street South Riverside Drive to Yuma Avenue The drainage improvements along South Riverside Drive a segment of US Hwy 287 Business will be partially funded through an Advance Funding Agreement with the Texas Department of Transportation (TxDOT) TxDOT has agreed to participate in funding these improvements in the amount of $70 830 00 This agreement was approved by City Council on November 8 2005 (M&C C-21134) The work also includes the rehabilitation of the streets by base pulverization cement stabilization and surface overlay with H M.A.C (hot mix asphaltic concrete) Logname• 20RYANSOUTHEAST Page 1 of 3 The Water Department has determined that the existing water main on Cantey Street and the sanitary sewer main on Talton Avenue are severely deteriorated and should be replaced prior to the street rehabilitation The project was advertised for bid on January 29 2009 and February 5 2009 in the Fort Worth Star Telegram The following bids were received on February 26 2009 Bidders Amount Time of Completion Tri-Tech Construction Inc. $989 073 15 130 Working Days Burnsco Construction Inc $1 012 568 30 Laughley Bridge & Construction Co $1 016 474 00 Jackson Construction Ltd $1 035 462 00 Conatser Construction TX, LP $1 059 124 50 Pipeworks Construction LLC $1 063 744 50 Earth Builders L P $1 415 075.20 Funding in the amount of $30 329 00 is included for associated water and sewer project management, construction survey material testing and project close out (water $18 439 00 and sewer $11 890 00). The contingency funds to cover change orders total $11 202 00 (water $6 000 00 and sewer $5,202 00) Funding in the amount of $91 525 00 is included for associated storm drain and paving construction survey project management, materials testing inspection and project closeout. The contingency fund for possible change orders for storm drain construction and paving is $25 000 00 M/WBE -Tri-Tech Construction Inc. is in compliance with the City's M/WBE Ordinance by committing to 30 percent M/WBE participation The City's goal on this project is 17 percent.
