HomeMy WebLinkAboutOrdinance 18066-04-2008ORDINANCE NO. 18066-04-2008 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF BRYAN AVENUE BETWEEN EAST ALLEN AVENUE AND ST .IOSEPH'S COURT AND BETWEEN RENIAINIDERS OF BLOCKS 1 AND 3, SAINT HELENA ADDITION AND PORTIONS OF TWO ALLEYS LOCATED IN BLOCKS 1 AND 3 OF THE SAINT HELENA ADDITION FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. SE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. THAT the following street and alleys described below 1 A portion of Bryan Avenue Right-of Way lying between East Allen Avenue and St. Joseph s Court, and between remainders of Blocks 1 and 3 Saint Helena Addition, and a portion of Lot 3 in said Bloclc 3 Saint Helena Addition, an addition to the City of Fort Worth as recorded in Volume 63 Page 56 of the Tarrant County Plat records being a variable width right of way and containing 5 787 square feet; 2. a portion of a 10 foot wide alley located in Block 1 Saint Helena Addition, an addition to the City of Fort Worth, Tarrant County Texas, as recorded in Volume 63 page 56 of the Tarrant County Plat Records, containing 1,393 square feet and lying between East Allen Avenue and St. Joseph Court; a portion of a 10 foot wide alley located in Block 3 Saint Helena Addition, an addition to the City of Fort Worth as recorded in Volume 63 Page 56, of t he Tarrant county plat records, containing 767 square feet and .lying between East Allen Avenue and St. Joseph Court; and as more specifically described in Exhibits A `B and `C" attached hereto and incorporated herein, by reference be and the same are vacated and extinguished. SECTION 2. That the fee to the land in the above-described vacated street portion and alleys is hereby released and shall revert to the add acent owner as provided by law SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624) DISCUSSION Gerry Curtis Associates Inc. on behalf of JPS Health Systems, has requested to vacate the above referenced right-of-way and to replat and incorporate them within the adjoining property it will serve as a landscaped entrance to their site In addition by vacating these sections of right of way they will be able to expand and potentially construct a new building in the future The City Plan Commission recommended approval of this request at its meeting on October 24 2007 An acceptable replat (FS-07 232) has been received Any existing utilities will be relocated at the applicant's expense or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process The City does not own land under or adjacent to the above referenced right-of-way Since no City funds have been expended to purchase property or easement rights collection of the fee value or any portion thereof is recommended by staff to be waived This request is located in COUNCIL DISTRICT 8 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds Logname 06VA-07-025 Page 1 of 2 TO Fund/AccountlCenters FROM.
