ADVANCE FUNDING AGREEMENT
AMENDMENT# 3
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the Texas Department of
Transportation, hereinafter called the State, and the City of Fort Worth, acting by and through its City Council, hereinafter
called the Local Government.
WITNESSETH
WHEREAS, the State and the Local Government executed a contract on May 7, 1997 to effectuate their agreement to
reconstruct the intersection of IH 820 and Randol Mill Road; and,
WHEREAS, Supplemental Agreement No. 1 was executed on August 4, 1999 to recognize an increase in funding of
$1,873,000. This increased the total cost of the project to $3,873,000.
WHEREAS, Supplemental Agreement No. 2 was executed on December 13, 1999 to recognize a change in the funding
percentages from 54%-federal, 46%-local to 70.7%-federal, 5.6%-State and 23.7%-local; and,
WHEREAS, the project was let for$4,044,871 in August 2001; and,
WHEREAS, due to change orders and cost overruns during construction the total cost of the project is estimated to be
$5,765,533; and,
WHEREAS, it has become necessary to amend the contract to recognize an increase of funding of$1,720,662
($1,573,499-federal and $147,163-local);
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto,
the State and the Local Government do agree as follows:

Article 1. Description of Amended Items
Page 8 of 14, Article 13. Project Funding, Section A. The total cost for the construction, right-of-way
and preliminary engineering of the Project is estimated at $5,765,333.
The$5,765,333 is broken down in to$4,431,958-federal, $225,585-state, and $1,107,990-local.
All other provisions of the original contract are unchanged and remain in full force and effect.
Article 2. Signatory Warranty
The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the
organization they represent.
