MEMORANDUM OF UNDERSTANDING FOR VACCINE FACILITES DURING AN
EMERGENCY
This Memorandum of Understanding is made and entered into this ajgtday of
2001;by and between Fort Worth Independent School District ("DISTRICT"), and the
City of Fort Worth ("City") and Tarrant County ("County"), through their respective Public
Health Departments ("DEPARTMENTS"), all of Tarrant County, State of Texas:
WHEREAS, the District is an Independent School District organized under
Education Code Chapter 11; and
WHEREAS, the Departments are Local Health Departments under Chapter 121
of the Health and Safety Code; and
I.
PURPOSE
The Departments are required by the Texas Department of Health to plan and
prepare for a public health emergency which may result from natural or man-made
causes. During such an emergency, it may be necessary to immunize or treat a
massive number of citizens in Tarrant County. The Departments and the District agree
that the District possesses facilities that are qualified to serve this purpose if a mass
immunization or treatment is necessary. The District agrees to make its facilities
available for purposes of mass immunization or treatment, under the terms set out
below.
II.
PUBLIC HEALTH EMERGENCY
This agreement will go into effect only if:
1. The local health authority of the City and the County agree and declare
that large scale immunization or treatment is necessary as a control
measure for an outbreak of communicable disease; and
2. Classes at the facility are either not scheduled, or are canceled.
3. Furthermore, if a public emergency does arise under the terms of this
agreement, an Interlocal Agreement pursuant to Chapter 791 of the Texas
Government Code, shall be executed by all parties and it shall describe
the cost and compensation necessary and due to each party.

III.
OBLIGATIONS OF THE DEPARTMENTS
1. The Departments shall supply or arrange for all equipment, vaccine, medicine
and personnel necessary to administer the vaccine or medication.
2. The Departments shall supply or arrange for all equipment and personnel
necessary for staffing, security, crowd control and other tasks, except as
described in section IV below.
3. The Departments shall be responsible for disposal of medical waste and
disinfection at the facility following its use for the emergency. The Health
Authority of either the County or City shall provide written assurance of its safety
for use as a school facility following its use.
4. The Departments will be responsible for any damage to property belonging to the
District as a result of its use during the public health emergency, and to the
extent they can be determined, costs for utilities described in section IV below.
5. The Departments are responsible for the acts and negligence of its employees or
volunteers, under state and federal law.
IV.
OBLIGATIONS OF THE DISTRICT
1. The District shall allow for the use of its facilities and all utilities (gas, electric,
water, and telecommunications) normally associated with its use as a school
facility.
2. The District shall provide use of all rooms, fixtures, and equipment existing at the
facility that the Department regards as necessary for on site use during the
period of the emergency.
3. The District shall provide at least one person on-site during the period of
emergency use with access to the rooms, fixtures and equipment described
a bove.
4. The District shall allow the training and usage of school nurses as medical
volunteers at the mass dispensing sites.
5. The District shall be responsible for the acts and negligence of its employees or
volunteers, under state and federal law.

V.
TERM
This agreement becomes effective when approved by the governing bodies of
the District and Departments. It may be canceled by any participating party by giving
thirty (30) days written notice to the other parties, otherwise it remains in effect for five
(5) years and may be renewed by mutual agreement.
