HomeMy WebLinkAboutContract 30450-A1 AMENDMENT No. 1 THE STATE OF TEXAS § CITY SECRETARY CONTRACT NO. 30,45o- Q (M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Camp Dresser & McKee Inc., (Engineer) made and entered into City Secretary Contract No. 30450, (the Contract) which was authorized by the City Council by M&C C-20235 on the 24`h day of August, 2004; and WHEREAS,the Contract involves engineering services for the following project: 35 MGD Expansion of the Eagle Mountain Water Treatment Plant and Pump Station WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in M&C C-24569, adopted by the City Council on November 9, 2010, and further amplified in a proposal letter dated August 16, 2010, a copy of which is attached hereto and incorporated herein. The cost to the City for the additional professional services to be performed by the Engineer total $148,000.00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid the Engineer for all work and services under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed $4,793,213.00. Project Manager Fort Worth Water Department 1511 11thAvenue Fort Worth,Texas 76102 Subject: Eagle Mountain Water Treatment Plant—Phase III Expansion Project No.P164-060164052003 City Secretary Contract No.30450 M&C C-20235,August 24,2004 Amendment No. 1 —Scope of Work Proposal Dear Mr.Harder: This letter presents a scope of work proposal for additional engineering services requested by the City of Fort Worth for the referenced project. The work tasks include the following items: 1. Updating and repacking the original design documents for Clearwell No.3 and associated facilities. 2. Providing bidding services and general services during construction of Clearwell No.3. 3. Updating the previously prepared Environmental Information Document(EID),required by the Texas Water Development Board (TWDB) for State Revolving Fund(SRF)funded project. 4. Conducting a tracer study for the Phase III ozone contact basin to develop baffling factors (T10/T) for use in developing disinfection CT for the plant. A discussion of each of these tasks is presented below. Clearwell No.3-Design CDM designed the Eagle Mountain WTP-Phase III Expansion in 2005, to bring the treatment capacity to 105 MGD. Clearwell No.3 was included as part of this design as an Add-Alternate bid item. Because the bids were higher than expected,it was decided to remove Clearwell No.3 from the construction project. Clearwell No.3 will increase treated water storage at the plant to 10.5 million gallons. This equates to 10%of plant capacity,a reasonable amount of storage for proper operation of the plant and pumping facilities. consulting•engineering•construction•operations CDM Mr.Harder August 16,2010 Page 2 The scope of work for repackaging the design documents will include plans (general/civil, process/mechanical,structural,electrical and instrumentation)and specifications for the following items: 1. Clearwell structure and drain box 2. Filtered Water Valve Vaults No.2 and No.3 3. Yard piping 4. Roadway C, west of Clearwell No.3. CDM will attend two meetings during the design process—intial meeting and review meeting at completion of the design. Following this review meeting,CDM will incorporate comments for final design set. Bidding and General Services During Construction Bidding Services. CDM will reproduce and distribute contract documents to prospective bidders and vendors and maintain a log of distribution. Thirty(30)sets of Ih-size plans and specifications will be provided for distribution. Five (five) sets of full size drawings will also be prepared. CDM will also provide electronic copies for posting on the City's project management website. CDM will attend the pre-bid conference for the construction project and answer,by written addenda,contractors' and suppliers' functional and technical questions during bidding phase.If necessary,such clarifications will be included in addenda. CDM will prepare conformed documents,incorporating addenda items into the plans and specifications and provide 10 sets of Ih size plans and specifications and 5 sets of full size plans for use by City staff and Contractor during construction. CDM will prepare eight sets of contract documents,with appropriate bonds,insurance, contracts,M/WBE documentation and other forms,for contracts between the City and Contractor. Construction Services. CDM will perform technical and functional review of all shop drawings and other submittals. CDM will respond to all RFIs,as requested by the City's resident inspector. CDM will review and comment on all Change Order requests and initiate Change Order requests when appropriate. CDM will attend monthly construction meetings (12),and provide up six additional site visits to view construction issues as requested by the City.CDM will not provide resident inspection services or construction management related services such as logging and distributing shop CDM Mr. Harder August 16,2010 Page 3 drawings and submittals,preparing change orders,reviewing contractor pay estimates,and coordinating work and schedule with the general contractor. Environmental Information Document Alan Plummer Associates,Inc. (APAI)prepared the original EID for the Eagle Mountain WTP- Phase III project. APAI will update this EID as part of this proposed amendment to CDM's contract. The work involved will include the following: 1. One site investigation will be conducted to visually assess the area for the proposed clearwell. 2. The original EID will be updated by APAI using new guidance established by TWDB in 2010. Twelve copies of the draft EID will be sent to the City and coordinating agencies. 3. The draft EID will be circulated to the agencies identified in the TWDB DWSRF guidance for review and comment. APAI will work with the City to draft a public notification and prepare a presentation for the public hearing. APAI will attend one public hearing. APAI will also draft a wetland and floodplain management notice for agency coordination. 4. Upon close of the 30-day comment period, APAI will request responses from all pertinent agencies and incorporate comments into the final EID. The ETD will be submitted to TWDB for final review. Twelve copies of the final EID will be provided. Tracer Study A tracer study will be conducted on one of the two Phase III ozone contact basins. The work involved will include the following: L Prepare a tracer study protocol outlining the procedures,equipment,and supplies necessary for conducting a tracer study. Coordinate with the plant staff concerning availability of time,facilities,and desired flow rates for the tracer study. 2. Conduct tracer study at the Eagle Mountain WTP. It is anticipated that set up,tracer testing,and clean up can be completed in one day. Two to three personnel will assist in collecting and analyzing samples. It is anticipated the hydrofluosilicic acid will be used as the tracer chemical. 3. Prepare tracer study report with revised CT study and submit to TCEQ for approval. 4. Two meetings with City staff to review tracer study protocol and to review tracer study results and CT development. CDM Mr.Harder August 16,2010 Page 4 The attached figure shows the fee development for the additional work. The total proposed fee is$148,000. Please note that the M/WBE firm utilization is 18%of the total fee request. This is slightly less than the current M/WBE goal for the project. We anticipate completion of the design phase within six weeks. Construction should take approximately 12 months. The tracer study should be completed with documents sent to TCEQ within six weeks. If this proposal is acceptable to the City we will prepare an amendment to our contract for execution. Please contact me if you have any questions or comments. Sincerely, J. DISCUSSION: On August 24, 2004, (M&C C-20235) the City Council authorized the City Manager to execute an engineering agreement with Camp, Dresser& McKee, Inc., in the amount of$4,645,213.00 for the design of the Eagle Mountain Water Treatment Plant Phase III Expansion. As part of this contract, Camp, Dresser& McKee, Inc., prepared a design for a 3.5 million gallon clearwell, used to store treated water prior to pumping into the distribution system. On October 25, 2005, (M&C C-21110) the City Council authorized the City Manager to execute a contract for the construction of the Eagle Mountain Water Treatment Plant Phase 111 Expansion Project. The 3.5 million gallon clearwell was included as part of the bid package as an additive altemate, but was not included in the construction contract due to funding limitations. Amendment No. 1 compensates Camp, Dresser& McKee, Inc.,for the work required to repackage the clearwell design into bid documents, bid the project and perform professional services during the construction of the clearwell. In addition, the amendment includes preparation of an environmental information document necessary to secure drinking water state revolving funds for construction and an ozone contactor tracer study necessary for the Texas Commission on Environmental Quality (TCEQ) to approve a higher baffling factor for ozone contactors. Camp, Dresser& McKee Inc., is in compliance with the City's MI BE Ordinance by committing to an additional 18 percent M/WBE participation on this Amendment No. 1. The City's goal on this amendment is 18 percent. This project is located at the Eagle Mountain Water Treatment Plant, 6801 Bowman Roberts Road, COUNCIL DISTRICT 7.
