HomeMy WebLinkAboutContract 30746 CITY SECRETAq CONTRACT NO. STATE OF TEXAS § COUNTIES OF TARRANT § AND DENTON 1. This contract is by and between the City of Fort Worth, Grantee, and Women's Haven of Tarrant County , Inc., Service Provider, and in aid of Criminal Justice Division Grant Number WF-03-V30-13414-06, titled Domestic Assault Response Team (DART). It is understood by all parties that payment obligations created by this contract are conditioned upon the availability of State or Federal funds appropriated or allocated for the payment of such obligations. The term of this contract shall commence on September 1,2004, and shall end on October 1,2004,unless extended or terminated as otherwise provided for in this contract. 2. The GRANTEE AGENCY is responsible for closely monitoring the Service Provider and the exercise of reasonable care to enforce all terms and conditions of the grant. Service Provider agrees to fully cooperate in the monitoring process. 3. Requirements of the Uniform Grant Management Standards(UGMS)promulgated pursuant to Section 783,of the Government Code are adopted by reference as part of this contract,including the contract provision as in Section 36, Common Rule of OMB, of the above standards. The GRANTEE AGENCY shall keep all project records. Records shall be retained for a least THREE (3) YEARS, following the closure of the most recent audit report and until any outstanding litigation, audit or claim has been resolved. Records are subject to inspection by CJD, or any state or federal agency authorized to inspect the same. 4. The Service Provider will furnish the following: • Provide emergency shelter to women and children who fear they are in danger of domestic abuse. • Provide programs which meet the immediate physical and emotional needs of clients. • Provide programs for clients which will help curtail the cycle of abuse. • Provide programs to increase public awareness of domestic abuse and to address issues relating to its prevention. • Encourage and coordinate cooperation with other organizations to effect and fulfill the purposes of Women's Haven of Tarrant County, Inc. • One Victim Specialist with an annual salary and fringe benefits of 35�,r1'S'( :�i�l ��1� QElI!i �l 5. Payment for the above will not exceed $3,400 and will be made as follows: one monthly reimbursement with an itemized statement of expenses. 6. Billing for the above will be provided in the same manner as it would be provided to institutional purchasers in the absence of a grant and shall consist of a brief statement of the service or other item provided and the basis for the billing rate. 7. In the event of a default of the Service Provider, the GRANTEE AGENCY may cancel or suspend the contract and the SERVICE PROVIDER shall be entitled to recover for all services provided or materials delivered prior to the cancellation date (or unused materials may be returned) or shall repay any funds advanced for services not yet rendered. 8. All licenses,legal certifications,or inspections required for the services,facilities,equipment, or materials,and all applicable state and federal laws and local ordinances must be complied with by the SERVICE PROVIDER. Failure to comply with this requirement shall be treated as a default. 9. This contract shall automatically terminate on the grant expiration date or any extension date thereof granted by CJD or upon termination of the underlying grant by CJD. All services billed hereunder must be rendered within the grant period. 10. The provisions of this agreement are severable and if for any reason a clause, sentence, paragraph or other part of this agreement shall be determined to be invalid by a court or federal or state agency,board or commission having jurisdiction over the subject matter thereof,such invalidity shall not affect other provisions which can be given effect without the invalid provision. 11. The failure of City or District to insist upon the performance of any term or provision of this agreement or to exercise any right herein conferred shall not be construed as a waiver or relinquishment to any extent of City's or District=s right to assert or rely upon any such term or right on any future occasion. l � �: To 12. Should any action, whether real or asserted, at law or in equity, arise out of the execution, performance, attempted performance or non-performance of this contract and agreement, venue for said action shall lie in Tarrant County, Texas. 13. Authorize the City Manager to apply for and accept, if awarded, four grants from the Governor's Office, Criminal Justice Division in the amount of$228,418; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Federal Awarded Assets Fund by $129,686 from available funds; and 3. Authorize the transfer of $129,686 from the Federal Awarded Assets Fund to the Grants Fund for the City's match; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the State Awarded Assets Fund by $58,670 from available funds; and 5. Authorize the transfer of $58,670 from the State Awarded Assets Fund to the Grants Fund for the City's match; and 6. Authorize the use of volunteer services with an anticipated value of$30,900; and 7. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $447,674 from available funds; and 8. Authorize the City Manager to designate Libby Watson, Assistant City Manager, as the authorized official to accept, reject, or alter the below listed grants, if awarded; and 9. Authorize a contract with Women's Haven at a cost not to exceed $35,150 contingent upon receipt of the grant from the Criminal Justice Division; and 10. Authorize the City Manager to waive indirect costs in the amount of$40,628. DISCUSSION: Each year, the Governor's Office of the Criminal Justice Division funds projects for various law enforcement agencies throughout the state, based on grant applications they submit. Criminal Justice Division grant applications from agencies in the Metroplex area will be reviewed by the North Central Texas Council of Governments (NCTCOG). The Police Department has developed three renewal grants and one new project. Renewal grants can be identified with a slash after the title and a number representing the years the program has been in existence. City of Fort Worth, Texas "agor And councilCommunication DATE REFERENCE NUMBER LOG NAME PAGE 1/14/03 **G-13848 35JUSTICE 2 of 4 SUBJECT FISCAL YEAR 2003-2004 CRIMINAL JUSTICE GRANT PROPOSALS Domestic Assault Response Team (DART)/6 The Domestic Assault Response Team (DART), which began as a federal grant project, will continue to operate teams consisting of a family violence detective and a trained crisis intervention volunteer in the East and North Field Operations Divisions. DART activities include crisis intervention, information and referral, and facilitating admission to the emergency shelter when indicated. Victim services will be provided through the human services administrator, administrative secretary, victim services specialist, and DART volunteers. This is a partnership program with Women's Haven and by contract provides funds for salaries and fringe benefits for a Women's Haven employee to coordinate volunteers and serve as a liaison to the department. During the 2001-2002 grant period, the DART program trained 32 volunteers, and served 588 primary and 722 secondary victims. Enhanced Domestic Assault Response Team/6 This companion program to DART primarily provides for the salaries of the two detectives who are assigned to the program and ride with a trained crisis intervention volunteer. The detectives work closely with the civilian personnel assigned to the DART program. The teams respond to domestic violence calls in the East and North Field Operations Divisions. DART activities include crisis intervention, information and referral, facilitate admission to the emergency shelter when indicated, conduct comprehensive evidence gathering and investigation, and relieve patrol from the scene in a timely manner when the law enforcement process is complete. The DART teams made over 400 responses. Computer Crime Fraud Expansion/3 This program will continue to address computer related fraud crimes, as well as credit card fraud, identity theft, and internet based scams. During the past half decade there has been an explosion in the popularity of the Internet and the use of personal computers. These devices brought speed and convenience for the consumer. An unfortunate side effect to this was that it made many forms of crime faster and more efficient, particularly various fraud offenses. Currently, one detective is handling 51 cases per month. During this grant period training funds have been significantly increased to allow the officer to stay current with this rapidly changing field. Sex Crimes Apprehension and Monitoring (SCRAM) Sexual Assault Training The primary objective of this program is to provide training to the personnel assigned to the Police Department's SCRAM unit who are responsible for investigating all sexually based adult offenses in the City. These investigators must be trained to handle not only the criminal aspect, but also the emotional aspect of the investigation. Often it is the proper handling of the emotional aspect that leads to the needed information for a successful investigation of a sexually based offense. The ever-changing technology also mandates that investigators be trained continually on new and more promising methods that can be deployed in the investigation of these offenses. Formal training in crime scenes, DNA and physical evidence will allow the investigator to better understand and follow the "clues" of the crime and to better present them at the trial of the offender. A well-trained and educated investigator that can document their formal training will be better received by the courts than one that has limited training. The indirect costs are included in the total amount of the grant program. We are asking to waive the indirect costs for the Domestic Assault Response Team and Enhanced Domestic Assault Response Team in the amounts of $15,563 and $25,065, respectively, to avoid making the programs cost prohibitive. The in-kind match of$30,900 is time donated by the volunteers. Additionally, the Criminal Justice Division has mandated that in the event of any misuse or loss of issued Criminal Justice Division funds, the City will replace these funds in full. Pre-applications have been submitted to the NCTCOG in order to meet state budget estimate deadlines. NCTCOG will prioritize all grant applications and, shortly thereafter, it will be known which projects can reasonably be expected to receive state funds. The required matching funds for these grants will be budgeted in the Special Trust Fund as part of the normal budget process.
