e Amendment No. 3 STATE OF TEXAS § CITY SECRETARY NO. 31I 5- IA COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Turner Collie & Braden, Inc., (Engineer) made and entered into City Secretary Contract No. 31145 (the Contract) which was authorized by M&C C-20451 on the 21st of December, 2004; WHEREAS, Turner Collie & Braden, Inc. has merged into AECOM USA Group, Inc.; WHEREAS, the Contract involves engineering services for the following project: Ryan Southeast Drainage Improvements Project No. 00092 WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to change the Engineer from Turner Collie & Braden, Inc. to AECOM USA Group, Inc. and include an increased scope of work and revised maximum fee. NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. All references to Turner Collie & Braden, Inc. shall be replaced with AECOM USA Group, Inc. and Engineer shall be and mean AECOM USA Group, Inc. 2. Article I of the Contract is amended to include the revised scope in engineering services specified in a proposal letter dated December 7, 2009, a copy of which is attached hereto and incorporated herein. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $120,784.00. 4. The contractor working on the project has recently requested additional information in regard to connecting the outfall to Sycamore Creek. The City would like to revise the outfall from what was previously designed and has requested that AECOM provide services which will include providing additional survey and a modified design of the outfall. The additional services for this work are described below and will be requested as Amendment No. 3 to the subject contract. Amendment#3 1. Obtain Survey of the outfall area. A swath about 100-ft by 50-ft will be surveyed, including tree diameters. 2. Provide updated P&P sheets(2)to show the revised outfall using gabions. 3. Provide updated quantities for the outfall. The cost to do this additional work is$10,240. A breakdown of this fee is provided as Attachment 1. The survey costs are shown in Attachment 2. DISCUSSION: The 2004 Capital Improvement Program (CIP) includes funds for drainage improvements for Ryan Southeast. The scope of the project consists of the preparation of plans and specifications for the installation of a storm drain system on Cantey Street from Yuma Avenue to Riverside Drive, Riverside Drive from Cantey Street to Colvin Avenue and Judd Street from Riverside Drive to Cobb Park. Turner Collie & Braden, Inc. proposes to perform the necessary design work for a lump sum fee of$96,784. City staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount, $15,840 is required for project management by the Engineering Department. Turner Collie & Braden, Inc. is in compliance with the City's M/WBE Ordinance by committing to 25% MfWBE participation. The City's goal on the project is 18%. This project is located in COUNCIL DISTRICT 8, Mapsco 77U and V.
