HomeMy WebLinkAboutContract 32748 AMENDMENT NO. 5 STATE OF TEXAS S CITY SECRETARY CONTRACT NO.,,�4 (M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and TranSystems Corporation Consultants (Engineer) made and entered into City Secretary Contract No. 26807 , (the Contract) which was authorized by the City Council by M&C C- 18571 on the 24th day of April 2001 and; subsequently revised by 4 previous amendment ; and WHEREAS , the Contract involves engineering services for the following project: WHEREAS, it has become necessary to execute Amendment No. 5 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I , of the Contract is amended to include the additional engineering services specified in M&C C- 21151 , adopted by the City Council on 15th day of November and further amplified in a proposal letter dated July 18 2005, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $ 83,885 .00 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $ . 1, 101,786 .00 J ^ p 3 . Department of Engineering City of Fort Worth 1000 Throckmorton Fort Worth, Texas 76102 Reference to: Summary and Scope of Services Sanitary Sewer Main 244-A Village Creek Parallel Collector Amendment No. 5 Dear Mr. Sahu, In an effort to expedite construction on the above project, the Water Department has decided to move forward with the bid solicitation process for Contract 2. As a result, both Contract 1 and 2 will be under construction at the same time with Contract 1 being 3-4 months ahead of Contract 2. These two phases of the project are very complex (siphon under Village Creek, 90" pipe, minimum grades, bore under IH-30, tunneling Meadowbrook Blvd., utilities, adjacent golf course, large junction structures, etc) and are in an urban environment. Traditional construction for this type of project would dictate starting at the very down stream end of the project and progressing upstream. This method allows for adjustments to be made during construction with the ability to reflect those changes and their impacts to the next upstream phase. Concurrent construction greatly increases the risk of being limited to costly solutions for unanticipated conflicts. It is our understanding that the City is going to dedicate the necessary staffing to achieve full time inspection. As you know our current contract with the City concludes with"Pre- Construction Services" which basically involves assistance during bidding, bid tabs and recommendation of award. No construction services are included in our contract. We believe however that the City needs to have engineering support from the engineer involved in the design of this project. As you know this project has many complexities relating to property owners and public agencies. Another compounding complexity of this project is that the City put this project on hold for over a year. During this period of time a complete changeover in staff in the City of Arlington has occurred as well as fuzzy recollections from all agencies. We believe you will need our assistance on coordinating with the following; 1. Between contractors relating to concurrent construction issues, 2. Utility companies, 3. Property owners, 4. TxDOT, 5. TRA, l r, 6. City of Arlington, 7. U.S. Army Corps of Engineers. In addition to the above coordinating issues we anticipate providing the City with additional engineering assistance throughout construction. This assistant could insure timely responses to issues on any necessary field changes. We also believe frequent construction coordination meetings will be needed throughout the project. Contractors, Water Dept., TranSystems and impacted agencies should attend. You may recall we provided similar services for M-253 which also had critical time, property owner concerns and construction issues. The below referenced fees are estimates based on a 15 month construction schedule for the project. The actual cost may be more or less depending on how long construction lasts. We propose to provide the below services on an hourly basis for the below estimated fee: • Shop Drawing Reviews $8,250 • Engineering assistance on: $69,575 - Concurrent Construction issues - Permit renewals - Property Owner coordination - Meetings • Mileage/Reproductions $1,260 • Re-bidding of Phase 2 (reproductions) $4,800 Total $ 83,885* Please refer to the attached spreadsheet that was used to reflect the hours we negotiated for this work. Please note this does not include hydraulic modeling of the M244a/City of Arlington sewer mains. *Full time inspection provided by City forces. In an effort of good faith we have already been performing work outside our contract by attending meetings with contractor, working with contractor on concurrent construction issues, reviewing shop drawings, attending meetings with City of Arlington, etc. We are also getting 1-2 calls a day from the contractor, suppliers, and City staff. All questions are related to substitution considerations, coordination with agencies (that we have already permitted project with), scheduling, etc. We respectfully request your consideration on this issue. DISCUSSION: On April 24, 2001, (M&C C-18571) the City Council authorized the City Manager to execute an engineering agreement with Transystems Corporation Consultants for Sanitary Sewer Main 244A Parallel Relief Study and design for a fee not to exceed $727,760.00. This contract was previously revised by the following four amendments: . Amendment No. 1 was approved on May 21, 2002, for $179,141.48 for an additional 4,000 linear feet of sewer line (M&C C-19089) . Amendment No. 2 was approved on March 3, 2003, for $18,897.00 to add geotechnical investigation . Amendment No. 3 was approved on September 16, 2003, for $72,556.00 for developing plans and specifications for odor control and atonement of portions of existing sanitary sewer main M-503 . Amendment No. 4 was approved on September 24, 2004, for $19,546.52 to include a 36-inch bypass sewer along US 80 and supplemental pipe testing specifications Amendment No. 5 provides for additional services requested by the Water Department for coordination between contractors, utility companies, property owners, TxDOT, TRA, the City of Arlington and the U.S. Army Corps of Engineers. Contract 1 is under construction and contract 2 has been advertised. These services were required based on the recommendation made by the engineer as a result of concurrent construction of this project and will require additional assistance by the engineer during construction phases of the remainder of these contracts. These services were not included in the original scope. City staff considers the proposed fee of $83,885.00 to be fair and reasonable for the scope of additional services to be performed. Transystems Corporation Consultants is in compliance with the City's M/WBE Ordinance by committing to an additional 6% M/WBE participation on this Amendment No. 5. The City's goal on this Amendment is 5%. This project is located in COUNCIL DISTRICT 5.
