HomeMy WebLinkAboutOrdinance 18417-12-2008Ordinance No. 18417 12 2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS CAPITAL PROJECTS FUND IN THE AMOUNT OF $2,063,880 00 FOR THE PURPOSE OF AUTHORIZING THE EXECUTION OF A LOCAL PROJECT ADVANCE FUNDING AGREEMENT (LPAFA) WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR A CITYWIDE PROJECT TO EXPAND THE TRAFFIC SIGNAL SYSTEM (KNOWN AS ITS PROJECT 5); PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009 in the Budget of the City Manager there shall also be ed stimated receipts nd appropriations in the Grants Capital Projects Fund the amount of $2,063,880 00 for the purpose of uthorizing the ution of Local Project Advance Funding Agreement (LPAFA) with the T xas Department of T ansportation fora itywide project to xpand the traffic ignal system (known ITS Project 5). SECTION 2. That should any portion, section part of a ction of this rdinance be declared alid, operative or void for any eason by urt of ompetent jurisdiction, uch decision, opinion or judgment shall in way impair the emaining portions, sections, parts of ctions of this rdinance, which id emaining provisions shall be and emain in full force nd effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18283 and all other rdinances nd appropriations amending the same ept those nstances where the provisions of this rdinance are direct conflict with such other rdinances nd appropriations, in which nstance id conflicting provisions of said prior ordinances and appropriations are hereby expressly epealed. December 16.2008 CSJ #0902-48-587 and 0902-48-588 District # 02 Code Chart 64 #15000_ Project: Expand Traffic Signal S. sy tem Agreement #• 02-8XXF6005 STATE OF TEXAS § COUNTY OF TRAVIS § LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING AGREEMENT For an STP-MM Project (On and Off State System) THIS Local Project Advance Funding Agreement (LPAFA) is made by and between the State of Texas acting by and through the Texas Department of Transportation hereinafter called the State and the City of Fort Worth, acting by and through its duly authorized officials hereinafter called the 'Local Government. WITNESSETH WHEREAS a Master Agreement Governing Local Transportation Project Advance Funding Agreements (MAFA) between the Local Government and the State has been adopted effective August 28, 2000, and states the general terms and conditions for transportation projects developed through this LPAFA, and WHEREAS the Texas Transportation Commission passed Minute Order 108410 that provides for the development of and funding for the project described herein and WHEREAS the Governing Body of the Local Government has approved entering into this LPAFA by resolution or ordinance attached hereto and made a part hereof as Attachment A for development of the specific project which is identified in the location map shown as Attachment B NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed as hereinafter set forth it is agreed as follows AGREEMENT 1 The period of this LPAFA is as stated in the MAFA, without exception 2 Termination of this LPAFA shall be under the conditions as stated in the MAFA, without exception 3 Amendments to this LPAFA shall be made as described in the MAFA, without exception 4 Scope of Work The scope of work and project limits for this LPAFA is described as improving and expanding the existing communication system from the City of Fort Worth (CFW) Traffic Management Center (TMC) to Intelligent Transportation System (ITS) field devices The major tasks are noted below Install new modems at approximately 300 traffic signals Install new communication drops and upgrade existing cable drops Develop wireless access points at sites not accessible by CATV or other hard-wire connections and install wireless modems Install and upgrade approximately 30 traffic cameras including cable or wireless modems to support the video transmissions AFA-LPAFA_OnSys Page 1 of 18 Revised 01/24/2008 CSJ #09.02-48-587 and 0902-48-588 District # 02 Code Chart 64 # 15000_ Project: Expand Traffic Signal S sy tem Agreement #• 02-8XXF6005 Install a TMC traffic video management system Replace existing NEMA controllers and cabinets with Type 170 or ATC controllers and cabinets Obtain training related project hardware and software Obtain test equipment related to project equipment. Provide video and data sharing for aCenter-to-Center link (as noted in the North Central Texas Council of Governments Regional Data and Video Communication System project) Design and install fiber optic ducts, cable, and related equipment to complete the connection from the CFW TMC to the transportation centers noted below This connection is to serve the following centers o Transvision o CFW 911 Bolt Street office o CFW Police Traffic office o James Avenue Service Center Install fiber optic cable from the CFW TMC via Lancaster Avenue to TxDOT's Satellite 4 building and install fiber electronics to transmit data and video between each center Upgrade or replace the existing signal system software to add and improve features including a GIS map interface and measurements for level of service on arterial signal systems Develop and install equipment to measure level of service on arterial streets Prepare a citywide fiber master plan including the establishment of fiber and duct standards for inclusion into city roadway projects a tabulation and assessment of regional fiber form a collaboration plan among city departments and regional agencies, and a plan and process for initiating a fiber plant for citywide applications Identify and purchase necessary computer hardware and software to support the project functions Perform city force and consultant information technology work related to firewall and security procedures Examine city communication network functions and establish procedures for securing data brought into the city network from the hard-wire and wireless connections Establish procedures to manage the traffic camera sharing among city and other agencies Fund communication service contracts until the project is complete Develop and execute multi-use lease and License agreements necessary to exchange data and video with TxDOT This will be a Local Let contract. A consultant will be hired for duties that may include project management, coordination of design and construction design ITS PS&E, prepare project documentation conduct construction inspection or oversight, supply or install signal system software, and prepare as-built drawings and records Charter Communication will install and upgrade the CATV system City forces, including city inspectors, will manage the project, perform design and construct improvements using Local Force Account. Some construction may be City Let. AFA-LPAFA_OnSys Page 2 of 18 Revised 01/24/2008 CSJ #0902-48-587 and 0902-48-588 District # 02 Code Chart 64 #15000 Project: Expand Traffic Si nal System Agreement #• 02-8XXF6005 Reference documents that provide additional clarification and background to this project include North Texas Regional ITS Architecture Compliance Document, Communications from a City TMC to Field Devices February 2007 CFW ITS Communication Master Plan November 2003 Regional Comprehensive Intelligent Transportation Systems Program for the North Texas Region -Communications Analysis and Recommendations April 2000 5 Right of Way and Real Property shall be acquired under one of the following procedures (check either a. or b.) a Purchase by the State Acquisition of right of way shall be the responsibility of the State as stated in the MAFA, without exception unless otherwise provided in Special Provisions and/or Attachment C A warrant or check in the amount of the Local Government's estimated participation as reflected in Attachment C shall be made payable to the Texas Department of Transportation and transmitted to the State prior to release of the Project by Right of Way Division or within thirty (30) days from receipt of the State's written notification whichever is earlier OR b X Purchase by the Local Government for the State Acquisition of right of way shall be the responsibility of the Local Government, as stated in the MAFA, without exception unless otherwise provided in Special Provisions and/or Attachment C 6 'Donations of real property may be credited to the Local Government's funding obligation for cost of right of way to be acquired for this project. This section shall apply only to projects for which there is no federal financial assistance and for which the State is responsible for acquisition of the right of way Credit for all real property other than property which is already dedicated and/or in use as a public road donated by the Local Government to the State shall be based on the property's fair market value established as of the effective date of this LPAFA. The fair market value shall not include increases or decreases in value caused by the project and should include the value of the land and improvements being conveyed excluding any damages to the remainder The Local Government will provide to the State all documentation to support the determined fair market value of the donated property Such documentation shall include an appraisal of the property by a qualified appraiser unless the Local Government determines that an appraisal is unnecessary because the valuation problem is uncomplicated and the fair market value is estimated at no more than $10 000 00 The cost of appraisal will be the responsibility of the State The State will review the submitted documentation and make a final determination of value, provided however the State may perform any additional investigation deemed necessary including supplemental appraisal work by State employees or employment of fee appraisers Credit shall be given only for property transferred at no cost to the State after the effective date of this LPAFA and the State s issuance of a letter of funding authority and only for property which is necessary to complete this project. Credit shall be in lieu of monetary contributions required to be paid to the State for the Local Government's funding share of the right of way to be acquired for this project. The total credit cannot exceed the Local Government's matching share of the right of way obligation under this LPAFA, and credits cannot be reimbursed in cash to the Local Government, applied to project phases other than right of way nor used for other projects In the event the Local Government's monetary contributions to the State for acquisition of right of AFA-LPAFA_OnSys Page 3 of 18 Revised 01/24/2008 CSJ #_0902-48-587 and 0902-48-588 District # 02 Code Chart 64 #15000_ Project: Expand Traff-ic Signal S• sy tem Agreement #• 02-8XXF6005 way when added to its donation credits exceed the Local Government's matching share of the right of way obligation there will be no refund to the Local Government of any portion of its contributed money 7 Adjustment of eligible utilities and payment of costs associated with such adjustment shall be provided by the State (or) X Local Government and shall be in accordance with provisions set forth in the MAFA. 8 Environmental Assessment and Mitigation will be carried out as stated in the Master Agreement, without exception 9 Compliance with Texas Accessibility Standards and ADA will be as stated in the MAFA, without exception 10 Architectural and Engineering Services will be provided by the Local Government, as stated in the MAFA without exception The Local Government is responsible for performance of any required architectural or preliminary engineering work. The State may review and comment on the work as required to accomplish the public purposes of the State The Local Government will cooperate fully with the State in accomplishing these local public purposes to the degree permitted by State and Federal law Improvements will be designed to meet, at the minimum AASHTO standards 11 Construction Responsibilities will be carried out by the Local Government, as stated in the MAFA, without exception This will be a Local Let contract. A consultant will be hired for duties that may include project management, coordination of design and construction design ITS Plans Specifications and Engineering (PS&E) prepare project documentation conduct construction inspection or oversight, supply or install signal system software, and prepare as-built drawings and records Charter Communication will install and upgrade the CATV system City forces including city inspectors will manage the project, perform design and construct improvements using Local Force Account. 12 Project Maintenance will be undertaken as provided for in the MAFA, without exception 13 Local Project Sources and Uses of Funds a Project Cost Estimate A Project Cost Estimate is provided in Attachment C Any work done prior to federal authorization will not be eligible for reimbursement. It is the Local Government's responsibility to verify with the State that the Federal Letter of Authority has been issued for the work covered by this Agreement. b A Source of Funds estimate is also provided in Attachment C Attachment C shows the percentage and estimate dollar amount to be contributed to the project by federal state, and local sources c. In the event the State determines that additional funding is required by the Local Government at any time during the development of the Project, the State will notify the Local Government in writing The Local Government will make payment to the State within thirty (30) days from receipt of the State s written notification f Whenever funds are paid by the Local Government to the State under this Agreement, the Local Government shall remit a check or warrant made payable to the 'Texas Department of Transportation Trust Fund The check or warrant shall be deposited by the State in an escrow account to be managed by the State Funds in the escrow account may only be applied by the State to the Project. If after final Project accounting excess funds remain in the escrow account, those funds may be applied by the State to the Local Government's contractual obligations to the State under another advance funding agreement. g If any existing or future local ordinances commissioners court orders rules policies, or other directives including but not limited to outdoor advertising billboards and storm water drainage facility requirements, are more restrictive than State or Federal Regulations, or if any other locally proposed changes including but not limited to plats or replats result in increased costs, then any increased costs associated with the ordinances or changes will be paid by the local government. The cost of providing right of way acquired by the State shall mean the total expenses in acquiring the property interests either through negotiations or eminent domain proceedings including but not limited to expenses related to relocation removal and adjustment of eligible utilities h The state auditor may conduct an audit or investigation of any entity receiving funds from the state directly under the contract or indirectly through a subcontract under the contract. Acceptance of funds directly under the contract or indirectly through a subcontract under this contract acts as acceptance of the authority of the state auditor under the direction of the legislative audit committee to conduct an audit or investigation in connection with those funds An entity that is the subject of an audit or investigation must provide the state auditor with access to any information the state auditor considers relevant to the investigation or audit. 14 Document and Information Exchange The Local Government agrees to electronically deliver to the State all general notes, specifications contract provision requirements and related documentation in a Microsoft® Word or similar document. If requested by the State the Local Government will use the State s document template The Local Government shall also provide a detailed construction time estimate including types of activities and month in the format required by the State This requirement applies whether the Local Government creates the documents with its own forces or by hiring a consultant or professional provider 15 Incorporation of Master Agreement Provisions This LPAFA incorporates all relevant provisions of the Master Advance Funding Agreement (MAFA) in effect on the date of final execution of this LPAFA, unless such MAFA provision is specifically excepted herein Any conflict between the terms of the MAFA and this LPAFA shall be governed and controlled by this LPAFA. 16 Insurance If this agreement authorizes the Local Government or its contractor to perform any work on State right of way before beginning work the entity performing the work shall provide the State with a fully executed copy of the State's Form 1560 Certificate of Insurance verifying the existence of coverage in the amounts and types specified on the Certificate of Insurance for all persons and entities working on State right of way This coverage shall be maintained until all work on the State right of way is complete If coverage is not maintained all work on State right of AFA-LPAFA_OnSys Page 5 of 18 Revised 01/24/2008 CSJ #0902-48-587 and 0902-48-588 District # 02 Code Chart 64 #15000_ Project: Expand Traffic Signal S• stem Agreement #• 02-8XXF6005 way shall cease immediately and the State may recover damages and all costs of completing the work 17 Signatory Warranty The signatories to this agreement warrant that each has the authority to enter into this agreement on behalf of the party represented 18 Special Provisions _N/ IN TESTIMONY HEREOF the parties hereto have caused these presents to be executed in duplicate counterparts THE LOCAL GOVERNMENT ATTEST Marty Hendrix City Secretary APPROVED' Fernando Costa Acting Assistant City Manager Contract Authorization Date. Authorize the City Manager to accept $144 472 00 in State funds, 4 Authorize the transfer of $846 191 00 from the 2004 Capital Improvement Program to the Grants Capital Projects Fund towards the City's match including direct State costs for plan review and oversight; 5 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Fund by $2 063 880 00 and 6 Authorize payment in the amount of $40 295 00 to Texas Department of Transportation for the City's portion of Texas Department of Transportation's administrative oversight and inspection of installed materials DISCUSSION The Regional Transportation Council established funds for this grant program under the Transportation Equity Act of the 21st Century (TEA-21) transportation legislation The $2 063 880 00 set aside for this project is composed of 52 percent Federal 7 percent State and 41 percent City funds. The Transportation and Public Works Department (TPW) is ready to begin ITS Project 5 to improve and expand the Traffic Management System (TMS) to deploy an upgraded Intelligent Transportation System (ITS) communication system to transmit data to traffic signals install new traffic cameras and install other ITS devices TPW plans to connect 300 traffic signals Citywide to the Traffic Management Center (TMC), deploy 30 traffic cameras at critical intersections and enhance other aspects of the TMS In 2004 TPW completed an ITS Communication Master Plan (M&C C-18423 City Secretary Contract No Logname 20ITS5 Page 1 of 2 26626) to establish a strategy for the design and implementation of an improved Citywide traffic communication network. The plan identified improvements to the existing communication system from the TMC to on-street traffic devices including traffic signals traffic cameras and other ITS devices This plan is ready to be deployed One goal of the TMS is to manage and improve the flow of traffic on the City's roadways Using the system staff can monitor and rapidly adjust traffic signal timing in response to roadway incidents Therefore incidents and congestion will be identified corrective actions evaluated and adjustments made in a timely manner The project is also to expand the traffic camera system and allow for the transmission of images for the new traffic cameras. Currently the TMS provides traffic video images to the City's cable TV channel for morning broadcasts and also to the Emergency Operations Center and the Backup 911 Center for major roadway incident monitoring The project will make the new traffic cameras available to additional City staff TPW has developed a project agreement with the Texas Department of Transportation (TxDOT) for this next ITS project deployment. For this project TPW intends to engage a consultant to assist with project management, perform planning and design and oversee other consultant and construction contracts.
