AN ORDINANCE VACATING AND EXTINGUISHING A 200 FOOT
PORTION OF A 12 FOOT WIDE ALLEY SITUATED IN THE W.J.
BOATS SUBDIVISION, OF BLOCK 3, EVAN'S SOUTH ADDITION, AN
ADDITION TO THE CITY OF FORT WORTH AS RECORDED IN
VOLUME 106, PAGE 28, PLAT RECORDS, TARRANT COUNTY
TEXAS, FROM A POINT AT PULASKI STREET TO A POINT AT
VERBENA STREET AND CONTAINING APPROXIMATELY 2,400
SQUARE FEET MORE OR LESS; PROVIDING FOR REVERSION OF
FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That an approximately 200 foot portion of a 12 foot wide alley contauxing approxmately
2,400 square feet, and being located in the W.J Boaz's Subdivision, of Block 3 Evan s South
Addition, and addition to the City of Fort Worth, as recorded m Volume 106, Page 28, Plat
Records, Tarrant County Texas, from a point at Pulaski Street to a point at Verbena Street, and
contazmng approxnmately 2,400 square feet, more or less, and as more specifically described ~n
Exhibits A `B" and `C" attached hereto and incorporated herein by reference be and the same
is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley is hereby released and
shall revert to the adjacent owner as provided by law
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances m conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

being more particularly described by metes and bounds as follows (bearings referenced to
the west line Missouri Avenue}
BEGINNING at a found 5/8-mch iron rod with cap marked 'BHB INC" (found iron rod)
for the northeast corner of Lot 10 of said Addition, being on the south right of way line
for Pulaski Street (60 foot right of way);
THENCE EAST with the south line of Pulaski Street, a distance of 12.00 feet to found
iron rod for the northwest corner of Lot 5 of said Addition,
THENCE SOCJTH with the east line of said alley a distance of 200 00 feet, to a found
iron rod for the southwest corner of Lot 20 of said Addition, being on the north right-of
way line of Verbena Street {32 foot right-of way);
THENCE WEST with the north lme of Verbena Street, a distance of 12.00 feet to a found
iron rod for the southeast corner of Lot 9 of said Addition,
THENCE NORTH, with the west line of said alley a distance of 200 00 feet to the

RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating a 12 foot wide by 200 foot long alley in the W J Boaz's subdivision of Block
3 Evan s South Addition as recorded in volume 106 page 28 PRTCT from a point at Pulaski Street to a
point at Verbena Street, in the City of Fort Worth Texas, and containing approximately 2,400 square feet of
land
2. Waive any and all fee value of the vacated area in accordance with City Ordinance No 13767 (M&C G-
12532, April 6 1999)
DISCUSSION
Paul Hubert of Baird Hampton & Brown on behalf of the City of Fort Worth has requested that the City
vacate the above referenced property and to replat it as a new lot for the development of Ella M Shamblee
Library Reviewing City departments and public utility companies have raised no objections to this request.
The City Plan Commission recommended approval of this request at its meeting on January 25 2006 A
replat (FS-05-351) has been submitted Any existing utilities will be relocated at the applicant's expense or
retained in an appropriately designated easement.
The Engineering Department, Real Property Services Division states that the fee value of the subject
property is $4 800 00 The original dedication was obtained through the platting process. Since no City
funds have been expended to purchase the property or easement rights collection of the fee value or any
portion of the fee value is recommended to be waived Additionally on April 6 1999 (M&C G-12532)
Council approved Ordinance number 13767 which allows reversion of the City's interest to an abutting
property owner without payment of cash consideration in central City redevelopment neighborhoods The
applicable criterion for this vacation is a center city area needing revitalization
