BOATS SUBDIVISION, OF BLOCK 3, EVAN'S SOUTH ADDITION, AN ADDITION TO THE CITY OF FORT WORTH AS RECORDED IN VOLUME 106, PAGE 28, PLAT RECORDS, TARRANT COUNTY TEXAS, FROM A POINT AT PULASKI STREET TO A POINT AT VERBENA STREET AND CONTAINING APPROXIMATELY 2,400 SQUARE FEET MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That an approximately 200 foot portion of a 12 foot wide alley contauxing approxmately 2,400 square feet, and being located in the W.J Boaz's Subdivision, of Block 3 Evan s South Addition, and addition to the City of Fort Worth, as recorded m Volume 106, Page 28, Plat Records, Tarrant County Texas, from a point at Pulaski Street to a point at Verbena Street, and contazmng approxnmately 2,400 square feet, more or less, and as more specifically described ~n Exhibits A `B" and `C" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated alley is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances m conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Waive any and all fee value of the vacated area in accordance with City Ordinance No 13767 (M&C G- 12532, April 6 1999) DISCUSSION Paul Hubert of Baird Hampton & Brown on behalf of the City of Fort Worth has requested that the City vacate the above referenced property and to replat it as a new lot for the development of Ella M Shamblee Library Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting on January 25 2006 A replat (FS-05-351) has been submitted Any existing utilities will be relocated at the applicant's expense or retained in an appropriately designated easement. The Engineering Department, Real Property Services Division states that the fee value of the subject property is $4 800 00 The original dedication was obtained through the platting process.
