HomeMy WebLinkAboutOrdinance 17377-01-2007ORDINANCE NO. 17377-01 2007 ~. -- `~ AN ORDINANCE VACATING AND EXTINGUISHING A PORTION ~- OF BURNETT TANDY DRIVE BETWEEN MONTGOMERY STREET AND GENDY STREET IN FORT WORTH, TARRA1~iT COUNTY TEXAS AS RECORDED IN CABINET A, SLIDE 8180 OF THE PLAT RECORDS OF TARRANT COUNTY TEXAS; AND CONTAINING APPROXIMATELY 0.502 ACRES OF LAND, MORE OR LESS, PROVIDING FOR THE REVERSION OF FEE IN SAID LAND• THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTNE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That a portion of Burnett Tandy Drive between Montgomery Street and Gendy Street in the City of Fort Worth, Tarrant County Texas as recorded in Cabznet A, Slide 8180 of the Plat Records of Tarrant County Texas; and containing approximately 21,887 square feet or 0.502 acres of land, more or less, and as more specifically described in Exhibits A `B" and `C" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 3. That the fee to the land ~n the above-described street and alley rights-of way is released and shall revert to the adjacent owner as pxovided by law SECTION 4 ri~ That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Waive any and all purchase fee value of the vacated land DISCUSSION Kimley-Horn and Associates Inc. on behalf of the City of Fort Worth,. requests to vacate the above referenced property and to replat it with adjoining property for the expansion of the Fort Worth Museum of Science and History The City Plan Commission recommended approval of this request at its meeting on November 17 2006 An acceptable replat (FS-06-282) has been submitted Any existing utilities will be relocated at the applicant's expense or retained in an appropriately designated easement. The Engineering Department, Real Property Services Division states that the fee value of the subject property is $88 095 18 The original dedication was obtained through the platting process. Since the City of Fort Worth will continue to own the property under and adjacent to the easement after the easement is vacated collection of the fee value or any portion thereof is recommended to be waived The proposed street vacation lies within COUNCIL DISTRICT 7 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
