TATION CONTRACT LXIII (63), DOE NO. 3358, WATER PROJECT NO.
PS58-070580175510
The proposed amendment will allow Gutierrez, Smouse, Wilmut & Associates, Inc.,
(GSWA) to provide additional engineering services on the project as requested by the City.
It has been determined that, at three separate locations, the existing sanitary sewer service
lines cross onto and traverse the abutting neighbor's property. As the proposed service lines
follow the same alignment, it will be necessary to create new permanent easements to include
these service lines. GSWA will provide the required surveying and engineering to generate
the essential instruments. This will simplify the consent issues that may arise between prop-
erty owners and offer a way to record the easements to avert disputes in the future.
The original contract was previously revised by the following amendments:
Amendment No. 1 allowed for additional survey efforts to generate topographic information
and prepare additional permanent easements, which were not a part of the original contract.
Amendment No. 2 provided for the additional engineering services for the redesign necessary
to lower a sewer lateral to provide sufficient grade to adequately convey sewage from previ-
ously unknown basement service lines, which connected to the existing service lines. Ini-
tially it was designed with the intent to rehabilitate the lateral via pipe enlargement.
Amendment No. 3 allowed for the design of 18 sewer service reroutes, primarily in an alley-
way. This included the preparation of additional plan sheets and specifications beyond the
scope of the original design requirements.
Amendment No. 4 provided for the engineering services to design 580 linear feet of new 8-
inch sanitary sewer main along with 100 linear feet of new sanitary sewer service lines. The
additional effort was necessary in order to provide trouble free sealer-service to the residents
located in the area. -

Gutierrez, Smouse, Wilmut & Associates, Inc., has requested a fee of$1,869.00 for the addi-
tional services to be provided thereby increasing the contract fee from $101,845.55 to
$103,714.55. I believe this fee is fair and reasonable for the additional services provided.
Please authorize this additional design fee by your signatures on the attached contract
amendment form.

WHEREAS, the City of Fort Worth (City) and Gutierrez, Smouse,
Wilmut & Associates, Inc. , (Engineer) made and entered into City
Secretary Contract No. 26802, (the Contract) which was authorized
by the City Council by M&C C-18597 on the 22nd day of May 2001;
and subsequently revised by four previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Sanitary Sewer
Rehabilitation Contract LXIII (63) .
WHEREAS, it has become necessary to execute Amendment No. 5
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:

Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated January 30, 2004, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $1, 869 .00 .
2 .
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $103, 714 .55.

Mr. Domenech:
This letter is our formal request for Supplemental Authorization to be compensated for
additional engineering services as requested by the City.
Justification
In .reviewing the location of existing private sanitary sewer services from the existing
public main to the each home owner's house, City staff determined there were three
locations where additional permanent sewer easements will be required. These three
locations involve a sewer service line for one lot crossing another lot owned by another
homeowner to get to the existing/proposed public main. It has been determined that
two of these locations will require new easements while one will require the permanent
easement that was previously developed to be revised. These easement issues were
not in the original engineering contract scope or any of the previous amendments,
therefore additional surveying and engineering coordination will be required. GSW's
contract with the MWBE surveyor is attached.
The additional costs are summarized below:
• Additional surveying for 2 new easements and one revised
Easement (2601 & 2609 College Ave. and 2620 Lipscomb St.) $ 1,350.00
• Additional engineering coordination for easements $ 519.00
