AMENDMENT TO CITY SECRETARY
CONTRACT NO. 29472
THIS contract amendment is entered into by and between the City of Fort Worth
("City "), a home-rule municipality in the State of Texas, acting through Charles
Boswell, its duly authorized Assistant City Manager, and Eagle Construction and
Environmental Services, L.P., a Texas corporation, hereinafter called "Contractor"
both parties acting herein by and through their duly authorized representative.
WHEREAS, the City and Contractor, have entered into that certain agreement
identified as City Secretary Contract No. 29472 for the removal of lead contaminated
soil in the Evans and Rosedale Cultural District area;
WHEREAS, City Secretary Contract No. 29472 not-to-exceed amount was limited to
$103,527.00;
WIUREAS, additional funds are necessary for the continuance of work in order for
the City to gain regulatory closure for the Evans and Rosedale Cultural District area
under the Voluntary Clean-up Program the City has entered into with the Texas
Commission on Environmental Quality;
WHEREAS, the City Council approved additional funds for this project in the amount
of$25, 057.00 on April 28, 2004 through M&C C-20044; and
WHEREAS, it is the mutual desire of the parties to amend said City Secretary
Contract No. 29472 by increasing the contract's not-to-exceed limit by $25,057.00.
NOW, THEREFORE, THIS CONTRACT FURTHER WITNESSETH:
City Secretary Contract No. 29472, currently on file in the office of the City Secretary
of the City of Fort Worth, is hereby amended to increase the contract's not-to-exceed
limit by $25,057.00.

All other terms and conditions of City Secretary Contract No. 29472 remain in full
force and effect.

Adoption of Appropriation Ordinance and Approval of Amendment to City Secretary Contract
No. 29472 with Eagle Construction and Environmental Services, L.P.
RECOMMENDATION:
It is recommended that the City Council:
1) Approve the transfer of$ 25,057.00 from undesignated funds in the Environmental Management
Fund to the Evans and Rosedale Cultural District Lead Remediation Project in the Environmental
Management Project Fund;
2) Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations
in the Environmental Management Project Fund by $25,057.00; and
3) Authorize the City Manager to execute a contract amendment to City Secretary Contract No. 29472
with Eagle Construction and Environmental Services, L.P. for additional work in connection
with the removal of lead contaminated soil in the Evans and Rosedale Cultural District area.
The contract amendment amount is $25,056.60. The not-to- exceed amount of the contract will
be $128,584.00.
DISCUSSION:
On January 6, 2004 (M&C C-19924), the City Council authorized the City Manager to execute a contract
with Eagle Construction and Environmental Services, L.P. in the amount of $103,527.00. The original
contract provides for the furnishing of all labor, materials, and equipment necessary to remove an estimated
5,300 cubic yards (CY) lead contaminated soil on the properties.
This contract amendment is for a continuance of work to gain regulatory closure for the site under the Texas
Commission on Environmental Quality Voluntary Cleanup Program. Based on confirmation sample results
from the first phase of work additional lead-contaminated soil removal is required in areas sampled that
exceeded regulatory levels. An estimated 1,740 cubic yards of additional lead-contaminated soil and
associated overburden will need to be removed in order to comply with state mandates.
Based on the environmental, health and safety issues associated with the project, and in an effort to
maintain consistency for the project, Eagle Construction and Environmental Services, L.P. was asked to
submit a proposed cost estimate to address the remaining amounts of soil to be removed.
The amount for this contract amendment has been set at $25,056.60. Staff considers the price to be fair
and reasonable. The charges for the work to be performed will be in accordance with the unit prices
contained in the original proposal.
Eagle Construction and Environmental Services, Inc. is in compliance with the City's M/WBE Ordinance by

-comrWtting to 10% M/WBE participation. The City's goal on this project is 16%.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon adoption of the attached appropriation ordinance and approval of
above recommendations, funds will be available in the current captial budget, as appropriated, of the
Environmental Management Project Fund.
