AN ORDINANCE VACATING AND EXTINGUISHING A 250 FOOT
LONG BY 50 FOOT WIDE PORTION OF STAYTON STREET
BETWEEN MUSEUM WAY AND WEST LANCASTER AVENUE
SITUATED WITHIN THE J.M.C. LYNCH SURVEY ABSTRACT NO
955 IN FORT WORTH, TARRANT COUNTY TEXAS AS RECORDED
IN VOLUME 2002, PAGE 468, OF THE DEED RECORDS OF
TARRANT COUNTY TEXAS, AND CONTAINING
APPROXIMATELY 0.302 ACRE OF LAND MORE OR LESS
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND THE
RETAINMENT OF EXISTING UTILITY EASEMENTS REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That a portion of Stayton Street between Museum Way and West Lancaster situated in the
J.M.C Lynch Survey Abstract No 955 m the City of Fort Worth, Tarrant County Texas as
recorded m Volume 2002, Page 468 of the Deed Records of Tarrant County Texas, and
containing approximately 13 140 square feet or 0.302 acre of land, more or less, and as more
specifically described m Exhibits A `B and `C" attached hereto and incorporated herein by
reference, be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street and alley rights-of way is released and
shall revert to the add acent owner as provided by law
SECTION 3
That all ordinances or parts of ordinances m conflict herewith are hereby repealed.
SECTION 4
That this ordinance shall take effect upon adoption.

Being a 0.302 of an acre tract of land situated wzthin the J.M.C Lynch Survey Abstract
955 Tarrant County Texas and being a portion of that certain right-of way known as
Stayton Street (a 50 foot wide right-of way) dedicated to the City of Forth Worth per
Instrument No 20272, and Volume 2002, Page 468, Deed Records, Tarrant County
Texas and being more particularly described by metes and bounds as follows.
Beginning at a S/8 inch capped iron rod found (Dunaway & Assoe., Inc) for the
northwest coirner of the herein described tract, same being on the south right-of way line
of Museum Way (a 60 feet wide nght-af way) and also being on the west right-of way
of said Stayton Street, same being the northeast corner of a tract of land conveyed to
Airport Trinity Tnc. n/k/a Trinity Park Inc as shown by deed recorded in Volume 17053
Page 257 of the Deed Records, Tarrant County Texas, said point being the beginning of
a curve to the left having a radius of 280 00 feet and a chord that bears North 58°19'07"
East, 118.13 feet;
Thence northeasterly with said curve to the left, and said south right-of way hne, through
a central angle of 24°21 19" an arc length of 119 02 feet to a point for the northeast
corner of the herein described tract, same being on the east right-of way line of said
Stayton Street;
Thence Sauth 33°09'35 West, departing said south right-of way hne, with said east
right-of way line, a distance of 320 48 feet to a 5/8 inch capped iron rod found (Dunaway
& Assoc., Inc.) for the northeast corner of Lot 1 Block 1 Herman G. Cox Addition, as
shown by plat recorded in Volume 388-131 Page 85 Plat Records, Tarrant County
Texas, same being in the southern most nght-of way line of said Stayton Street;
Thence North 67°43'03 West, departing said east nght-of way hne and with said south
nght-of way line, a distance of 51 00 feet to a 'Y" cut found in concrete for corner, same
being in the said west right-of way hne of Stayton Street, and the east line of said Trinity
Park tract;
Thence North 33°07'32 East, departing said south right-of way line and with said west
right-of way line and said east line, a distance of 223 18 feet to the POINT OF
BEGINNING and containing 0 302 of an acre of land, more or less.

RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating a 250-foot long and 50-foot wide portion of Stayton Street between
Museum Way and West Lancaster Avenue consisting of 0 302 acre of land situated within J M C Lynch
Survey Abstract 955 Tarrant County Fort Worth Texas, and
2. Waive any and all purchase fee value of the vacated easement.
DISCUSSION
Teague Nall and Perkins, Inc. on behalf of Trinity Park, Inc. requests to vacate the above referenced
property and to replat it with adjoining property for development of Greystone Retirement Home The City
Plan Commission recommended approval of this request subject to approval of the Trinity Parkway Master
Thoroughfare Plan Amendment (MT-006-007) by City Council at its meeting on December 22, 2006 The
City Council approved the Trinity Parkway Master Thoroughfare Plan Amendment (MT-006-007) at its
meeting on January 9 2007 An acceptable replat (FS-006-246) has been submitted
The Engineering Department, Real Property Services Division states that the fee value of the subject
easement is $53 644 05 The original dedication was obtained through donation per instrument No 20272,
and Volume 2002 Page 468 Deed Records Tarrant County Texas. Since no City funds have been
expended to purchase property or easement rights collection of the fee value or any portion thereof is
recommended to be waived
The proposed street vacation lies within COUNCIL DISTRICT 9
