FORT WORTH WATER DEPARTMENT PRETREATMENT SERVICES
CONTRACT
WHEREAS, the City of Fort Worth and the City of Pantego entered into a contract for the
treatment of wastewater, such contract being City of Fort Worth City Secretary Contract No.
15902, dated May 8, 1987; and
WHEREAS, the City of Pantego is required by said contract to adopt and enforce an
industrial pretreatment ordinance within its jurisdiction; and
WHEREAS, the City of Pantego has requested that the City of Fort Worth perform
sampling of industrial wastes within the jurisdiction of the City of Pantego, as well as performing
the analysis of such samples; and
WHEREAS, the City of Fort Worth is agreeable to performing the sampling and analysis
on behalf of the City of Pantego.
NOW, THEREFORE, the City of Fort Worth, hereinafter referred to as "Fort Worth", and
the City of Pantego, hereinafter referred to as "Pantego", hereby agree as follows:
1.
As of the date of this agreement, there is one Significant Industrial User (SIU) within the
jurisdiction of Pantego, such as Texas Pneumatic Systems, Inc. (TPS). This agreement and the
charges contained herein are for the one existing SIU. Except as provided otherwise herein, if
additional SIUs locate within Pantego's jurisdiction, this agreement will be either amended to
include the additional S1Us or Fort Worth's obligations hereunder shall be limited to the existing
SIU.
2.
Fort Worth agrees to perform the following basic services which are related to Industrial
Connection and Monitoring, section 9 of City of Fort Worth City of Fort Worth City Secretary
Contract No. 15902 (the Contract), for Pantego:
a) With Pantego representative(s), conduct an annual inspection of one SIU facilities within
the jurisdiction of Pantego.
b) Obtain a minimum of two (2) samples per year from the SIUs for analysis and
compliance with the Contract. Sampling and analysis shall be in accord with Exhibit "A"
attached.
c) Assist Pantego in conducting two (2) semi-annual reports of SIUs by providing forms to
Pantego to be forwarded to the SIU and for return to Fort Worth.
d) Assist Pantego with an annual survey and permitting of new SIUs within Pantego's
jurisdiction.

e) Assist Pantego in determining if new industries within Pantego's jurisdiction are required
to be permitted so as to be in compliance with the Contract.
3.
Pantego agrees to pay Fort Worth for the basic services required hereunder as follows:
a) The sum of $ 161.68 monthly for pretreatment services described under Section 2.
b) A monthly Customer Service Charge in the amount of$25.00
These charges shall be included in the monthly wastewater statement submitted to Pantego
pursuant to the Contract and shall be paid at the time such statement is due and payable.
4.
Pantego agrees to pay to Fort Worth for additional services as may be requested by
Pantego:
a) Pantego agrees to pay Fort Worth an additional fee for services provided to support and assist
pretreatment related enforcement actions by Pantego against noncompliant SIUs. A fee not to
exceed $100.00 per employee per day for such services requiring Fort Worth attendance at
show cause hearings, administrative hearings or meetings involving enforcement actions.
b) Pantego agrees to provide Fort Worth written notice 96 hours in advance to appear and testify
in enforcement actions.
c) Anything beyond the scope of contract for sampling will be at cost per sample for listed
parameters as listed on Exhibit A.
These charges shall be included in the monthly wastewater statement submitted to Pantego
pursuant to the Contract and shall be paid at the time such statement is due and payable.
5.
This agreement shall terminate on December 31, 2005, unless renewed as herein after
specified. Pantego may renew this agreement on a yearly basis by giving Fort Worth at least thirty
(30) days prior written notice of its intent to renew. Within fifteen (15) days after receipt of such
notice Fort Worth shall advise Pantego of any escalation in charges. Within three (3) business
days, Pantego shall confirm in writing that it agrees to the escalation in charges. Failure to so
notify Fort Worth shall render the agreement terminated at the end of the then current term.
6.
Nothing contained in this agreement shall be construed as amending, limiting or reducing
Pantego's obligations contained in the Contract.

The cost for TL'S follows the same procedure as for Fort Worth's permitted industrial users. It
includes sampling and analysis cost. Administration cost for inspection, permitting and sampling
are also included in cost calculation. Sampling events are held at six-month intervals.
