AN ORDINANCE VACATING AND EXTINGUISHING A PORTION
OF GALVESTON AVENUE, BETWEEN WEST HUMBOLT STREET
AND WEST PULASKI STREET SITUATED ADJACENT TO LOT
1R1R, BLOCK 1, VANDERVOORT ADDITION AND BLOCK 4,
MULKEY SUBDIVISION IN THE CITY OF FORT WORTH,
TARRANT COUNTY TEXAS AS RECORDED IN CABINET B, SLIDE
3156 AND VOLUME 31, PAGE 278, OF THE PLAT RECORDS OF
TARRANT COUNTY TEXAS, AND CONTAINING
APPROXIMATELY 0.115 ACRE OF LAND, MORE OR LESS,
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND THE
RETAINMENT OF EXISTING UTILITY EASEMENTS, REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That a portion of Galveston Avenue, between West Humbolt Street and West Pulaski Street,
situated on the adjacent to Lot 1R1R, Block 1 Vandervoort Addition, an addition to the City of
Fort Worth, Tarrant County Texas as recorded m Cabinet B, Slide 3156 of the Plat Records of
Tarrant County and Block 4 of Mulkey Subdivision, a subdivision m the City of Fort Worth, as
recorded m Volume 31 Page 278 of the Plat Records of Tarrant County Texas; and contaimng
approximately 0 115 acre of land, more or less, and as more specifically described m Exhibits
A and `B" attached hereto and incorporated herein by reference, be and the same is vacated
and extinguished.
SECTION 2.
That the fee to the land in the above-described street and alley nghts-of way is released and
shall revert to the adjacent owner as provided by law
SECTION 3.
That all ordinances or parts of ordinances m conflict herevv~th are hereby repealed.
SECTION 4
That this ordinance shall take effect upon adoption.

Field notes for• (VACATION OF A PORTION OF GALVESTON AVENUE )
A portion of Galveston Avenue lying on the west side of Lot 1R1 R Block I VANDERVOORT
ADDITION, an addition to the _City of Fort Worth, Tarrant County Texas according to the plat
thereof recorded m Cabinet B, Slide 3156 of the Plat Records of Tarrant County Texas and on
the east side of Block 4 of MULKEY SUBDIVISION according to the plat thereof recorded in
volume 31 page 278 of the said Plat Records and described by metes and bounds as follows
Beginning at a 5/8 capped Iran set in the west line of said Lot 1R1R and the east line of said
Galveston Avenue from which a 5/8" capped iron recovered for the southwest corner of said Lot
1R1R at the intersection of the north line of West Pulaski Street and the east line of said
Galveston Avenue bears south 108 feet.
Thence west, crossing said Galveston Avenue, 50 feet to the southwest comer of Lot 1 in said
Block 4 in the west line of said Galveston Avenue
Thence north, along the east line of said Block 4 and the west line of said Galveston Avenue,
100-19/100 feet to the northeast corner of said Block 4 at the intersection of the west line of said
Galveston Avenue and the south line of West Humbolt Street.
Thence east, crossing said Galveston Avenue, 50 feet to the east line of said Galveston Avenue
and the west line of said Lot IRIR.
Thence south, along the west line of said Lot 1 R1 R and the east line of said Galveston Avenue,
100-19/100 feet to the place of beginning and containing 5009 square feet.
The basis for bearing is the west line of Lot 1 R1 R per plat call ~~

RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating a portion of Galveston Avenue right-of-way between West Humbolt Street
and West Pulaski Street, being approximately 50 feet wide by 100 feet long (consisting of 0 115 acre of
land) lying on the west side of lot 1 R1 R, Block 1 Vandervoort Addition located in the City of Fort Worth as
filed in Cabinet B Slide 3156 of the Plat Records of Tarrant County Texas and on the east side of Block 4
of Mulkey Subdivision located in the City of Fort Worth as filed in volume 31 page 278 of the Plat Records
of Tarrant County Texas and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (MC G-15624)
DISCUSSION
Brookes Bakers Surveyors of Fort Worth on behalf of Kroger (Vandervoort's Dairy Foods) requests to
vacate the above referenced right-of-way and to replat and incorporate it within the adjoining property for
the purpose of developing secured parking areas as encouraged by the Department of Homeland Security
The City Plan Commission recommended approval of this request at its meeting on November 17 2006 An
acceptable replat (FS-06-178) has been received Any existing utilities will be relocated at the applicant's
expense or retained within a designated easement, along with an appropriate plat note that no permanent
structures may be constructed or placed thereon
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process.
The City does not own land under or adjacent to the above referenced right-of-way Since no City funds
have been expended to purchase property or easement rights, collection of the fee value or any portion
thereof is recommended by staff to be waived
