HomeMy WebLinkAboutOrdinance 17475-04-2007Ordinance No. 17475-04-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $185,613 FROM A STORM WATER UTILITY FUND TRANSFER, FOR THE PURPOSE OF EXECUTING AN ENGINEERING AGREEMENT WITH TCB, Inc., FOR PROJECT NO 00482; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $185,613 from a Storm Water Utility Fund transfer for the purpose of executing an Engineering Agreement with TCB, Inc., for Project No. 00482. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and efFect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 ADOPTED AND EFFECTIVE: Apn13, 2007 This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $185 613 00' and 3 Authorize the City Manager to execute an engineering agreement with TCB Inc. the amount of $128 780 00 for Milam-Robinhood Drainage Far East Fort Worth Drainage and Wilbarger-Hughes Storm Drain Extensions. DISCUSSION The Storm Water Management Program was established to prevent flooding in Fort Worth presence streams, minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by improving infrastructure reconstruction and system maintenance master planning enhanced development review and increased public education and outreach The scope of this project includes the design of storm drainage facilities at Milam-Robinhood Far East of Fort Worth at Meadowbrook south and a storm drain extension at Wilbarger-Hughes Street. TCB Inc. proposes to perform the necessary design work for a lump sum fee of $128 780 00 City Staff considers this to be fair and reasonable for the scope of services proposed In addition to the contract amount, $56 833 00 is required by the Engineering Department for project management. M/WBE TCB Inc. is in compliance with the City's MNVBE Ordinance by committing to 25 percent M/WBE participation The City's goal on this project is 22 percent.
