HomeMy WebLinkAboutOrdinance 17476-04-2007Ordinance No. 17476=04-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $15,243 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $21 988 FROM A WATER AND SEWER OPERATING FUND TRANSFER, FOR THE PURPOSE OF EXECUTING AMENDMENT NO 2 TO CITY SECRETARY CONTRACT NO 29739 WITH FREESE AND NICHOLS INC FOR CITY PROJECT NO 00237 PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $1.5,243 and the Sewer Capital Projects Fund in the amount of $21 988 from a Water and Sewer Operating Fund transfer for the purpose of executing Amendment No. 2 to City Secretary Contract No. 29739 with Freese and Nichols, Inc. for City Project No 29739 SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 ADOPTED AND EFFECTIVE. April 3. 2007 This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Water Capital Project Fund in the amount of $15 243 00 and the Sewer Capital Project Fund in the amount of $21 988 00' and 3 Authorize the City Manager to execute Amendment No 2 to City Secretary Contract No 29739 with Freese and Nichols Inc. in the amount of $33,231 00 to provide for additional engineering services thereby increasing the contract amount to $208 069 00 DISCUSSION On March 23 2004 (M8~C C-20003) the City Council authorized an engineering agreement with Freese and Nichols Inc. in the amount of $150 052.00 for Water and Sanitary Sewer Improvements to serve the Thompson Road and Riverside North Area The agreement was subsequently revised by one previous amendment (administratively approved by the City Manager on October 6 2005) in the amount of $24 786 00 that provided for additional sanitary main design on the project, as requested by the Water Department. The project consists of engineering design services for the installation of water and sanitary sewer mains on Old Denton Road (Silver Road to Thompson Road) and Thompson Road (Old Denton Road to Flower Tree Drive) Due to proposed new development within the immediate vicinity of the project area, a segment of project sewer main Main-454 must be relocated from directly behind proposed residential property into public street right-of-way that will be dedicated by the developer of the subdivision It is also necessary to relocate the proposed 16-inch water main along N Riverside Dr to provide water service to the new development.
