HomeMy WebLinkAboutOrdinance 17485-04-2007ORDINANCE NO 17485-04-2007 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF OLD DENTON ROAD LOCATED THE IN THE FRANCISCO CUELLA SURVEY ABSTRACT NUMBER 266, THE HOPKINS DAVIDSON SURVEY ABSTRACT NUMBER 437 AND BEING A PORTION OF A TRACT OF LAND DESCRIBED BY DEED TO ONE PRAIRIE MEADOWS, LTD RECORDED IN VOLUME 14705, PAGE 520, CITY OF FORT WORTH, TARRANT COUNTY TEXAS AND BEING APPROXIMATELY 950 FEET LONG AND 60 FEET WIDE AND CONTAINING 1.162 ACRES OF LAND MORE OR LESS, PROVIDING FOR THE REVERSION OF FEE IN SAID LAND• THE RETAINMENT OF EXISTING UTILITY EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That a portion of Old Denton Road located in the Francisco Cuella Survey Abstract Number 266 and the Hoplcros Davidson Survey Abstract No 437 City of Fort Worth, Tarrant County Texas and being a portion of that certain tract of land as described by deed to One Prairie Meadows, Ltd. and recoded in Volume 14705 Page 520 (Tracts I & II), County Records, Tarrant County Texas, and being approximately 950 feet long and 60 feet wide and containing 1 162 acres of land, more of less and as more specifically described in Exhibit A attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street and alley nghts-of way is released and shall revert to the adjacent owner as provided by law SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located m that easement are relocated at the owner's expense. SECTION 4 That all ordinances or parts of ordinances in conflict herev~nth are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Survey Abstract No. 437 City of Fort Worth, Tarrant County Texas and being a portion of that certain tract of land as described by deed to One Prairie Meadows, Ltd. and recorded in Volume 14745 Page 520 (Tracts I & In, County Records, Tarrant County Texas, and being more particularly described by metes and bounds as follows: BEGINNING at the northeast corner of that portion of Old Denton Road vacated by City of Fort Worth ordinance No 16078 adopted by the City Council of the City of Fort Worth, Texas, m regular session on August 17 2004 THENCE S 42°18'55"W 74.91 feet along the northerly end of said vacated portion of Old Denton Road, THENCE N 00°26'44'E, 896 81 feet; THENCE N 21°56'07"W 109 16 feet to a point in the northerly line of said One Prairie Meadows, Ltd. tract II, THENCE S 89°58'08 'E, 91.57 feet along the northerly line of said One Prairie Meadows tract I & II, THENCE S 00°26'44 `W 942 73 feet to the POINT OF BEGINNING and containing 1 162 acres of land, more or less. Waive any and all purchase fee value of the vacated land in accordance with City policy (M8~C G-15624) DISCUSSION Carter & Burgess, Inc. of Fort Worth on behalf of One Prairie Meadows, requests to vacate the above referenced right-of-way and to replat and incorporate it within the adjoining property for the purpose of residential development. The City Plan Commission recommended approval of this request at its meeting on November 18 2005 An acceptable replat (FP-05-129) has been received Any existing utilities will be relocated at the applicant's expense or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon The City of Fort Worth originally obtained the above mentioned right-of-way through prescription The City does not own land under or adjacent to the above referenced right-of-way Since no City funds have been expended to purchase property or easement rights, collection of the fee value or any portion thereof is recommended by staff to be waived This request is in COUNCIL DISTRICT 2 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
