AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
AN ALLEY LOCATED BETWEEN BAILEY STREET AND BARDEN
STREET ADJACENT TO LOTS 1 THROUGH 4 AND LOTS 5
THROUGH 10 OF BLOCK 2 OF THE W.M. BAILEY ADDITION AN
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY
TEXAS AS RECORDED IN VOLUME 388-310, PAGE 61 OF THE PLAT
RECORDS OF TARRANT COUNTY TEXAS, BEING AN ALLEY 12
FEET WIDE, AND CONTAINING 0.0745 ACRES OF LAND•
PROVIDING FOR REVERSION OF FEE IN SAID LAND PROVIDING
THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES,
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That a portion of an alley located between Bailey Street and Barden Street, adjacent to
Lots 1 through 4 and Lots 5 through 10 of Block 2 of the W.M. Bailey Addition, an addition to
the City of Fort Worth, Tarrant County Texas as recorded m Volume 388-310 Page 61 of the
Plat Records of Tarrant County Texas and being an alley twelve (12) feet wide and contaimng
0 0745 acre of land, and as more specifically described m Exhibits A and `B attached hereto
and incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land m the above-described vacated alley is hereby released and
shall revert to the adjacent owner as provided by law
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances m conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

12' WIDE ALLEY ABANDONMENT
BEING 3 365 square feet of land situated in Block 2 of the WM Bailey Addition an
Addition to the City of Fort Worth, Tarrant County Texas as shown on map recorded in
Volume 388-310 Page 61 Plat Records, Tarrant County Texas being a portion of #hat
certain 12-foot wide alley in said 81ock 2 and further described as follows:
Beginning at an 'X" found on the southerly line of said 12-foot alley and being the
northwesterly corner of Lot 5 of said Block 2 and being on the easterly right-of--way line
of Barden Street (a 50-foot wide right-of-way);
Thence North 00°01'02" West along said right-of--way of Braden Street, 12.00 feet to a
boat spike found on the northerly line of said 12-foot alley and the southwesterly corner
of Lot 4 of said Block 2;
Thence South 89°50'38 East along said 12-foot alley 266 17 feet to the southerly line of
Bailey Avenue an 80-foot wide right-of-way
Thence South 35°00'17" East along said Bailey Avenue 14 68 feet to an "X" found on
the southerly line ofi said 12 foot alley
Thence North 89°50'38" West along said southerly line 274 58 feet to the POINT OF
BEGINNING and containing a computed area of 3,244 square feet or 0 0745 acre of
land

SUBJECT
Adopt an Ordinance Vacating a 0 0745-Acre Alley between Bailey Street and Barden Street in the
City of Fort Worth
RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating an alley right-of-way between Bailey Street and Barden Street, being 269
feet long by 12 feet wide consisting of 0 0745 acre of land in the W M Bailey Addition located in the City of
Fort Worth as filed in Volume 388=310 Page 61 Plat Records, Tarrant County Texas and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M8~C G-15624)
DISCUSSION
Townsite Co of Fort Worth on behalf of Jagee Real Properties L.P requests to vacate the above
referenced right-of-way and to replat and incorporate it within the adjoining property for the purpose of
mixed-used infill development. The City Plan Commission recommended approval of this request at its
meeting on June 28 2006 An acceptable replat (FS-06-232) has been received Any existing utilities will be
relocated at the applicant's expense or retained within a designated easement, along with an appropriate
plat note that no permanent structures may be constructed or placed thereon
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process
The City does not own land under or adjacent to the above referenced right-of-way Since no City funds
have been expended to purchase property or easement rights collection of the fee value or any portion
thereof is recommended by staff to be waived
This request is in COUNCIL DISTRICT 7
