AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
WEST 7TH STREET RIGHT OF WAY LOCATED AT THE NORTHWEST
CORNER OF WEST 7TH STREET AND BAILEY AVENUE, SITUATED IN
THE WM. J BAILEY ADDITION AND THE J W CONNER SURVEY
ABSTRACT NUMBER 355, CITY OF FORT WORTH, TARRANT
COUNTY TEXAS, BEING APPROXIMATELY 222 FEET LONG AND
CONTAINING APPROXIMATELY 7,076 SQUARE FEET OR 0.162
ACRES OF LAND, AS RECORDED IN VOLUME 14238, PAGE 132 AND
VOLUME 14262, PAGE 342 OF THE DEED RECORDS OF TARRANT
COUNTY TEXAS, PROVIDING FOR THE REVERSION OF FEE IN SAID
LAND• THE RETAINMENT OF EXISTING UTILITY EASEMENTS
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.
That a portion of West 7~' Street right of way located at the northwest corner of West 7th
Street and Bailey Avenue, and situated m the WM. J Bailey Addition, an addition to the City of
Fort Worth and the J W Conner Survey Abstract Number 355 as recorded in Volume 14238
Page 132 and Volume 14262, Page 342 of the deed records of Tarrant County Texas, being
approximately 222 feet long and, and contaimng 7 076 square feet or 0 162 acres of land, and as
more specifically described m Exhibits A and `B" attached hereto and incorporated herein by
reference, be and the same is vacated and extinguished.
SECTION 2.
That the fee to the land in the above-described street nght-of way is released and shall
revert to the adjacent owner as provided by law
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances m conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

DISCUSSION
Townsite Co of Fort Worth on behalf of Jagee Real Properties L.P requests to vacate the above
referenced right-of-way and to replat and incorporate it within the adjoining property for the purpose of
mixed-use infill development. The City Plan Commission recommended approval of this request at its
meeting on August 23 2006 An acceptable replat (FS-06-232) has been received Any existing utilities will
be relocated at the applicant's expense or retained within a designated easement, along with an
appropriate plat note that no permanent structures may be constructed or placed thereon
The Department of Engineering Real Property Division states that the fee value of the subject property is
$66 319 81 The City of Fort Worth originally purchased the above mentioned right-of-way for $144 910
The applicant will dedicate rights-of-way for West 7th Street, Barden Street, and 6th Street as part of the
replat. Since the portion of right-of-way that will be dedicated by the applicant is roughly equal to or greater
than the portion of right-of-way that is being vacated staff recommends collection of the fee value or any
portion thereof be waived
