AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
MARGARET STREET BETWEEN LOCKS AVENUE AND LOVELL
AVENUE, BROOKLYN HEIGHTS ADDITION AND A PORTION OF AN
UNNAMED ALLEY BETWEEN MONTGOMERY STREET AND
MARGARET STREET LOCATED WITHIN BLOCK 13, BROOKLYN
HEIGHTS ADDITION AN ADDITION IN THE CITY OF FORT WORTH,
TEXAS, PROVIDING FOR THE REVERSION OF FEE IN SAID LAND•
THE RETAINMENT OF EXISTING UTILITY EASEMENTS,
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS.
SECTION 1.
THAT the following street and alley described below
1 A 60 feet wide by 132 feet long portion of Margaret Street, located between Locke
Avenue and Lovell Avenue, and containing approximately 0 18 acre of land in the
Brooklyn Heights Addition, City of Fort Worth, Texas, as filed m Volume 388-156,
Page 21 of the Tarrant County Plat Records, and
2. A 12 feet wide by 240 feet long portion of an unnamed alley located between
Montgomery Street and Margaret Street, containing approximately 0 066 acre of land
m Block 13 Brooklyn Heights Addition, an addition to the City of Fort Worth, Texas
as filed m Volume 63 Page 13 of the Tarrant County Plat Records,
and as more specifically described in Exhibits A and `B attached hereto and incorporated
herein by reference, be and the same are vacated and extinguished.
SECTION 2.
That the fee to the land in the above described street and alley rights-of way is released
and shall revert to the adjacent owner as provided by law
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located m that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances m conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

1 Adopt the attached ordinance vacating a portion of the following rights-of-way•
a) Margaret Street between Locke Avenue and Lovell Avenue being approximately 60 feet wide by 132 feet
long consisting of 0 18 acre of land in the Brooklyn Heights Addition located in the City of Fort Worth as
filed in Volume 388-156 Page 21 of the Tarrant County Plat Records, and
b) Unnamed alley between Montgomery Street and Margaret Street, being approximately 12 feet wide by
240 feet long consisting of 0 066 acre of land in the Brooklyn Heights Addition located in the City of Fort
Worth as filed in Volume 63 Page 13 of the Tarrant County Plat Records, and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624)
DISCUSSION
Gerry Curtis Associates Inc. of Fort Worth on behalf of Ross & Matthews, P C and Railhead Partners,
Ltd request to vacate the above referenced rights-of-way and to replat and incorporate them within the
adjoining property to be used as parking and building maintenance access. The City Plan Commission
recommended approval of this request at its meeting on November 17 2006 An acceptable replat (FS-006-
210) has been received Any existing utilities will be relocated at the applicant's expense or retained within
a designated easement, along with an appropriate plat note that no permanent structures may be
constructed or placed thereon
The City of Fort Worth originally obtained the above mentioned rights-of-way through the platting process
The City does not own land under or adjacent to the above referenced rights-of-way Since no City funds
have been expended to purchase property or easement rights collection of the fee value or any portion
thereof is recommended by staff to be waived
This request is in COUNCIL DISTRICT 9
