HomeMy WebLinkAboutOrdinance 17490-04-2007ORDINANCE NO 17490-04-2007 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF THROCKMORTON STREET RIGHT OF WAY BETWEEN WEST 11'~ STREET AND WEST 12~ STREET LOCATED ADJACENT TO LOT 1, SECTION 7R, FORT WORTH CONVENTION CENTER ADDITION AN ADDITION TO THE CITY OF FORT WORTH, TA,RRANT COUNTY TEXAS AS RECORDED IN CABINET A, SLIDE 11331 OF THE PLAT RECORDS OF TA,RR.ANT COUNTY TEXAS, BEING APPROXIMATELY 1 FOOT WIDE AND 200 FEET LONG AND CONTAINING APPROXIMATELY 0.4 ACRE OF LAND; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That a portion of Throckmorton Street right of way between West 1 l~' Street and West 12~' Street, located adjacent to Lot 1 Section 7R, Fort Worth Convention Center Addition, an addition to the City of Fort Worth, Tarrant County Texas as recorded in Cabinet A, Slide 11331 of the Plat Records of Tarrant County Texas, being approximately 1 foot wide and 200 feet long and containing 0 4 acre of land more or less, and as more specifically described in Exhibit A and `B" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street is released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624) DISCUSSION The City of Fort Worth requests to vacate the above referenced right-of-way and to replat and incorporate it within the adjoining property to accommodate an architectural building element on the new Fort Worth Convention Center Parking Garage The City Plan Commission recommended approval of this request at its meeting on February 28 2007 An acceptable replat (FS-007-048) has been received The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process. The City owns land adjacent to the above referenced right-of-way Since no City funds have been expended to purchase property or easement rights and the City will continue to own the property adjacent to the right of-way after it is vacated collection of the fee value or any portion thereof is recommended by staff to 'be waived This request is in COUNCIL DISTRICT 9 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
