HomeMy WebLinkAboutOrdinance 17493-04-2007Ordinance No 17493 -04 -2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENTS FUND IN THE AMOUNT OF $407 414 70 FROM PRIOR DEVELOPER CONTRIBUTIONS FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE NEW DEVELOPMENT FUND TO EXECUTE A COMMUNITY FACILITIES AGREEMENT WITH JABEZ DEVELOPMENT L.P FOR THE INSTALLATION OF COMMUNITY FACILITIES TO SERVE PALMILLA SPRINGS PHASE I PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS- SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Special Assessments Fund in the amount of $407 414 70 from prior developer contributions for the purpose of transferring said funds to the New Development Fund to execute a Community Facilities Agreement with Jabez Development, L.P for the installation of community facilities to serve Palmilla Springs, Phase I SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $407 414 70 from the Special Assessments Fund to the New Development Fund 3 Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the New Development Fund in the amount of $407 414 70 from available funds, and 4 Authorize the City Manager to execute a Community Facilities Agreement (CFA) with Jabez Development, L.P for the installation of community facilities to serve Palmilla Springs Phase I DISCUSSION Jabez Development, L.P the developer of Palmilla Springs, Phase I has executed a proposed contract for community facilities to serve a single family (114 lot) development located in west Fort Worth bounded on the north by Chapin Road and on the south by Interstate 30 (see attached map) The project includes construction of the full (55 -feet) section of Chapin Road adjacent to Palmilla Springs, and a half (39 5 -feet) section from the development boundary to Chapel Creek Boulevard The City collected future - improvement funds for the northern half of Chapin Road through the CFAs of three adjacent developments Trail Ridge Estates, Westview Addition Phase 1 and Westview Addition Phase 2. Jabez Development, L.P is requesting reimbursement from the City for construction of the northern half of Chapin Road from the previously collected CFA funds. The estimated costs of all community facilities for Palmilla Springs, Phase 1 including construction of Chapin Road are as follows ITEM A. Construction 1 Streets 2.
