WHEREAS, the City of Fort Worth (City) and Alan Plummer Associates, Inc.
(Engineer) made and entered into City Secretary Contract No. 27615, the "Contract") on
the 26th day of March 2002; and
WHEREAS, the Contract involves engineering services for the following project:
Wastewater diversion from East of Eagle Mountain Lake drainage basin
to Big Fossil Creek drainage basin and Low Pressure Sewer System to
serve the South Shore of Lake Worth
WHEREAS, it has become necessary to amend said Contract to include an
increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the Contract:
1.
Attachment A as referenced in Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter dated March 30, 2004, a copy
of which is attached hereto and incorporated herein. The cost to City for the additional
services to be performed by Engineer shall not exceed $154,549.
2.
Article II of the Contract is amended to provide for an increase in the maximum fee
to be paid to Engineer for all work and services performed under the Contract, as amended,
so that the total fee paid by the City for all work and services shall not exceed the sum of
$1,173,918.78.
3.
All other provisions of the Contract, which are not expressly amended herein, shall
remain in full force and effect.

Dear Ms. Rafalko:
1 am pleased to submit the enclosed Amendment No. 5 to City Secretary Contract No.
27615 for the South Shore Low Pressure Sewer System. The additional services include
preparing contract documents for installation of grinder pumps on individual lots and
providing pre-construction and general construction administration services for the
installation of grinder pumps,increasing the overall length of gravity sewer from the original
scope, and designing low-pressure sewer line for additional length of sewer.
I. Grinder Pump Installation
The original contract scope included providing specifications for the residents along the low-
pressure sewer system portion of the project to purchase and install grinder pumps on the
individual lots. During the course of the project,the City has decided to take responsibility
for purchasing, installing and maintaining the grinder pumps on the individual lots. The
City proposes to obtain a general contractor to furnish and install the grinder pump stations
for approximately 100 homes.
The proposed scope of work in Amendment No. 5 will include the following:
Preparing Contract Documents for the purchase and installation of grinder
pumps on the individual lots, and the connection of the grinder pumps to the
low-pressure sewer system,
Assisting the City in advertising and awarding the project,
d Providing General Construction Representation for the Installation Construction
project. The General Construction Representation includes making at least 3

100 homes. The field representation will include assisting the City and resident
in selecting an acceptable location for the grinder pump station, route of the
discharge line,observing the progress and quality of work and assisting the City
and contractor in resolving resident issues.
A fee table based upon hourly work is attached. The total fee for the above scope is
$115,549, of which approximately$71,750 is an allowance for the field representation for
the installation of individual grinder pumps.
To meet the M/WBE requirements of the original contract, we propose to use Multatech
Engineering, Inc.to provide 450 hours of the total 600 hours of the field representation. A
proposal letter from Multatech is attached for this work. Multatech's fee would be a not-to-
exceed fee of$50,000.
111, Additional Work Performed
When the above-referenced contract for the design of the Lake Worth South Shore Low-
Pressure Sewer System was originally developed,the Opinion of Probable Construction Cost
for the project was $1,459,730. This cost was based on a length of 28,100 linear feet of
sewer, which included 1,400 linear feet of gravity sewer and 26,700 linear feet of small
diameter low-pressure sewer. With the final route selected, we now have a revised total
amount of pipeline on the project. The total amount of sewer line included in the project is
38,400 linear feet, which is an increase of 10,700 linear feet of total pipeline length over the
original amount in the contract.
Also, the City requested that the gravity line portion be extended as far as possible east and
west of the Castle Circle Lift Station. Therefore,the project now includes 10,700 linear feet
of gravity sewer and 27,700 linear feet of small diameter,low-pressure sewer. The revised
Opinion of Probable Construction Cost is $2,600,000 for the total project. Changing the
collection system from a low pressure system,as originally proposed,to a gravity system as
requested by the City, resulted in a greater design effort and an increase in the number of
drafting hours as plan and profiles sheets are necessary.
The set of construction plans currently includes 31 drawings showing the pipeline length, 12
plan and profile drawings for gravity sewer lines and 19 plan drawings for the low-pressure
sewer system. The average length of pipeline designed per sheet is 1,200 linear feet. If the
set of drawings matched the length in the original opinion of cost, the number of sheets
would have been 23, with only 2 plan and profile sheets. Overall, 8 plan view drawings
have been added to the design set to show the additional 10,700 linear feet of pipeline
length. Also, there are 10 drawings modified to be plan and profile sheets.

Therefore, we respectfully request the City amend the contract to provide the following
additional fees:
For S additional sheets overall at$3,000 per sheet: $24,000
For 10 sheets modified to show plan and profile
at an increase of$1,500 per sheet: $15,000
Subtotal for Additional Pipeline Design $39,000

This work is proposed to be accomplished on a time and material basis in accordance with
the following charges:

The total amount will not exceed $154,549 without the CITY'S written authorization.

Amendment No. 5 to City Secretary Contract No. 27615 with Alan Plummer Associates, Inc. for the
Design of the Lake Worth South Sewer System
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 5 to City
Secretary Contract No. 27615 with Alan Plummer Associates, Inc. for the Design of the Lake Worth South
Sewer System in the amount of$154,549, increasing the total contract amount to $1,173,918.78.
DISCUSSION:
On March 26, 2002 (M&C C-19022), the City Council authorized the execution of an engineering agreement
with Alan Plummer Associates, Inc. in the amount of$958,152 for the design of a wastewater diversion from
Eagle Mountain Lake drainage basin to the Big Fossil Creek basin and the design of the Lake Worth South
Shore Sewer System.
The Water Department, the Legal Department and the Department of Engineering conducted a series of
meetings with the South Lake Shore Neighborhood Association and the Lake Worth Civic Club to discuss
the Lake Worth Land Sales Program and the installation of water and sewer utilities to serve existing
development at Lake Worth.
The original scope of the low pressure system included only a small diameter force main in the right-of-way
and required customers to install the necessary private improvements at their own cost with their own
contractors. The community expressed concerned that an average homeowner would not posses the
expertise to oversee installation and properly maintain the individual grinder pumps.
Water Department staff conducted a national survey to determine how other cities with similar systems
delineate the responsibility and found that in most cases the utility owns and maintains the grinder pumps
and the low-pressure sewer mains for an additional fee added to each customer's utility bill. The customer
also typically pays for the electricity necessary to operate the grinder pump, about $3 per month. City staff
is evaluating the possibility of a new wastewater rate class for the grinder pump customers and will present
this matter separately at a later date.
As a result of the meetings, the City agreed to maximize the length of gravity sewer to serve the south
shore area (thereby minimizing the number of lots that would require grinder pumps) and to install and
maintain the grinder pumps necessary for the operation of the low-pressure sewer system.
Amendment No. 5 includes additional design services to increase the length of gravity sewer, increase the
overall length of pipeline, prepare specifications for the installation of grinder pumps on individual residential
lots and provide general construction representation for the grinder pump installation.
This project is located in COUNCIL DISTRICT 7.

Alan Plummer Associates, Inc. is in compliance with the City's M/WBE Ordinance by committing to 32%
MIWBE participation on this Amendment No. 5.
