THIS AGREEMENT OF LEASE, made and entered into this day of Wz"ll—,
1974, by and between the City of Fort Worth, a municipal corporation, acting
herein by and through its Mayor, R. M. Stovall, hereinafter called Lessor and
Lone Star Gas Company, a corporation, hereinafter called Lessee,
W I T N E S S E T H:
LESSOR, for and in consideration of the sum of Ten and No/100 Dollars ($10.00),
cash in hand paid by Lessee, the receipt of-which is acknowledged, and of the
covenants and agreements hereinafter stipulated to be mutually kept and performed
by the parties hereto, DOES HEREBY GRANT, DEMISE, LEASE, AND LET, upon the terms
and conditions hereinafter stated, UNTO LESSEE, its successors and assigns, the
following described lot, tract, or parcel of land, situated in the County of Tar-
rant, State of Texas, to-wit:
BEGINNING at a 3/4-inch x 24-Inch iron T-Bar set in the chain-link fence
along the easterly right of way line of State Highway No. 350 along the
westerly line of said Fort Worth International Airport, said point being
a distance of 64.5 feet N 29041'W along and with said fence from its inter--
section with the fence along the northerly right of way line of the C. R.
I. & P. RR along the southerly line of said Airport, said point also being
the most southerly corner of this tract;
THENCE, N29°41'W along and with said fence along the easterly right of way
line of said State Highway No. 364 a distance of 100.0 feet to a 3/4-inch
X 24-inch iron T-Bar set for the most westerly corner of this tract;
THENCE, N60019'E at a distance of 6.0 feet cross underground telephone
cable, at a distance of 16 feet cross Lone Star Gas Company telephone line,
at a distance of 20.0 feet cross Lone Star Gas Company 16-inch pipeline,
continuing in all a distance of 50.0 feet to a' 3/4--inch X 24-inch iron
T-Bar set for the most northerly corner of this tract;
THENCE, S29°41'E a distance of 100.0 feet to an "X" chipped in a large
flat sand rock for the most easterly corner of this tract;
THENCE S60019'W, at a distance of 5.0 feet pass a 3/8-inch X 12-inch
nail set for reference, at 30 feet cross said Done Star Gas Company
16-inch pipeline, at a distance of 34 feet cross said bone Star Gas
Company telephone line, at a distance of 44 feet cross said underground
telephone cable, continuing in all a distance of 50.0 feet to the place
of beginning and containing 5,000 square feet of land, more or less,

for the exclusive use of Lessee, its successors and assigns, together with the
pI appurtenances thereunto belonging or in anywise appertaining, including the right

of ingress and egress thereto and therefrom at any and all times along a route or
routes to be mutually agreed upon by Lessor and Lessee.

It is understood and agreed that during the term of this lease the Lessee shall
have the right, privilege and option to place, construct, erect, install, operate,
maintain, inspect, repair and replace, on and in the premises aforesaid, such
buildings, cleaners, odorizers, pipes, meters, regulators, valves, fittings and
appurtenances thereto, as may be necessary, convenient or incidental to the car-
rying on of Lessee's business; provided, however, that none of such materials
and equipment shall be placed on said premises by Lessee in excess of fifteen
(15') feet in height, without prior Written consent of Lessor; and provided fur-
ther that written consent of Lessor shall be obtained prior to the erection of
any building hereinabove provided for. Lessee further covenants and agrees that
it will not permit or conduct on the demised premises any construction or acti-
vity that might interfere with the flight operations at Dallas/Fort Worth Re-
gional Airport, and Lessee further agrees that, in its use of the demised pre-
mises, it Will strictly comply with all applicable provisions of the laws,
statutes, ordinances, restrictions and regulations of the United States of Amer-
ica, the State of Texas, the City of Fort Worth or any political subdivision or
agency thereof having jurisdiction over the premises,.
TO HAVE AND TO HOLD unto said Lessee, its successors and assigns, for a term of
forty (40) years from the date hereof; provided however, should Lessee at any
time during the term hereof cease to use said premises, then, as part of the
aforesaid consideration, Lessee shall have the right and option to terminate
this lease by filing of record with the County Clerk of the county, in which
the premises are located, a release hereof, and effective as of the date of
filing of such release as aforesaid this lease shall terminate.
Lessee covenants and agrees to indemnify and hold harmless the City of Fort
Worth, its agents, servants and employees from and against any and all claims
for damages for injuries to persons or property arising out of or incident to
the lease herein granted, or the use and occupancy of the premises or any part
of the Lessor's property by Lessee, or any of its agents, employees or invitees,
and as to City, Lessee does hereby assume all liability and responsibility for
injuries, claims or suits for damages to persons or property of whatsoever kind
or character, whether real or asserted, occurring during the term hereof in con-
nection with the use or occupancy of the premises or any part of the Airport by
Lessee, its agents, servants, employees, contractors, subcontractors, patrons,
guests or invitees.
Lessor agrees that Lessee, keeping the covenants of this lease, shall peaceably
and quietly hold, enjoy, and occupy said premises during said term without hind-
rance, interruption, ejection, or molestation by Lessor or by any other person or
persons whomsoever.
Each and every covenant, agreement, term, provision, and condition herein contain-
ed shall extend to and be binding upon the respective heirs, legal representatives,
successors and assigns of the parties hereto, and shall be deemed and treated as
covenants real running with the premises aforesaid during the term hereof.
It is understood that the person or persons securing this lease on behalf of Lessee
are without authority to make any covenant or agreement not herein expressed.
IN WITLESS WHEREOF, this agreement is executed by the parties hereto, the day
and year first herein written.
