HomeMy WebLinkAboutOrdinance 17513-04-2007ORDINANCE NO 17513-04-2007 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO 13896, AS AMENDED CODIFIED AS APPENDIX A OF THE CODE OF THE CITY OF FORT WORTH, BY AMENDING SUBSECTION 6.504 `SINGLE FAMILY RESIDENTIAL DESIGN STANDARDS" OF CHAPTER 6, `DEVELOPMENT STANDARDS" ARTICLE 5 `RESIDENTIAL DESIGN STANDARDS" TO REQUIRE DESIGN STANDARDS AND FRONT YARD AND STREET PARKWAY TREES FOR ALL DETACHED SINGLE FAMILY BUILDING PERMITS, AMEND CHAPTER 9 `DEFINITIONS" TO ADD A DEFINITION FOR INFILL HOUSING PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Sustainable Neighborhood Committee of the City Council m review of adopted standards for detached single family residential permits has determined that design standards should apply to all such permits including mfill housing; and WHEREAS, such design standards currently apply only to developments of three lots or more; and WHEREAS, the Committee has also determined that additional landscaping by the provision of front yard and street parkway trees on all detached single family residential infill lots will enhance neighborhoods, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. Section 6.507 `Single Family Residential Design Standards" of Chapter 6 `Development Standards" Article 5 `Residential Design Standards" of Ordinance No 13896 the Zoning Ordinance of the City of Fort Worth, is amended to add a new paragraph `D" to require front yard and street parkway trees for all infill housing and to apply design standards to all detached single family residential permits to read as follows. 6.507 Single Family Residential Design Standards Any detached single family residential dwelling constructed after the effective date of this ordinance ( )shall be required to conform to the following architectural and tree planting requirements A. Exterior walls shall consist of a minimum of 50% masonry Exposures to a minor arterial or wider street shall required 100% masonry construction except where such building face is obscured by a minimum six (6) foot masonry wall. 'Masonry" shall include brick, stone, cementitious fiber concrete products or stucco Similar products made from such materials and/or durable recycled material shall be allowed as approved by the Building Official. C. No attached garage facing a public or private street may project greater than eight (8) feet in front of the front wall of the house in all Single Family Districts. D An infill house shall be required to have one minimum 3 caliper front yard tree of choice, and one minimum 3 caliper street parkway tree as approved by the City Forester In all instances, a minimum of 40% canopy cover per lot must be achieved m accordance with Section 6.301.x. 2 SECTION 2. Chapter 9 Definitions, of Ordinance No 13896 the Zoning Ordinance of the City of Fort Worth, Section 9 101 Defined Terms is amended to add a definition for `Infill Housing" as follows. INFILL HOUSING any detached single family dwelling developed, reconstructed or enlarged by more than 50% of the original structure five (5) years or more following final plat of the property SECTION 3 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. 3 SECTION 5. All rights and remedies of the Crty of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and cnmmal, whether pending m court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6. The City Secretary of the Crty of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days m the official newspaper of the Crty of Fort Worth, Texas, as authorized by Section 52.013 Texas Local Government Code.
