HomeMy WebLinkAboutOrdinance 17533-05-2007Ordinance No 17533-05-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $820 107 50 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $172,073.39 FROM A WATER AND SEWER OPERATING FUND TRANSFER, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH STABILE & WINN INC FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN AND REPLACEMENTS ON PORTIONS OF AVENUE H, AVENUE A, NEWARK AVENUE, AVENUE I, COURT STREET PARKDALE AVENUE, AND AVENUE G (CITY PROJECT NO 00275) PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS' SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $820 107 50 and the Sewer Capital Projects Fund in the amount of $172 073 39 from a Water and Sewer Operating Fund transfer for the purpose of executing a contract with Stabile & Winn, Inc. for pavement reconstruction and water and sanitary sewer main and replacements on portions of Avenue H Avenue A, Newark Avenue, Avenue I Court Street, Parkdale Avenue, and Avenue G (City Project No 00275) SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $820 107 50 and the Sewer Capital Projects Fund in the amount of $172 073 39 from available funds, and 3 Authorize the City Manager to execute a contract with Stabile & Winn Inc. in the amount of $2 572 329 25 for Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Avenue H (South Ayers Avenue to Miller Avenue) Avenue A (Nashville Avenue to Thrall Street) Newark Avenue (Avenue C to East Rosedale Street) Avenue I (South Collard Street to Bishop Street) Court Street (North Dead End to East Vickery Boulevard) Parkdale Avenue (Koch Street to Vickery Boulevard) and Avenue G (South Beach Street to Binkley Street) DISCUSSION On January 10 2006 (M&C C-21241) the City Council authorized the City Manager to execute an engineering agreement with Freese & Nichols Inc. for Pavement Reconstruction and Water and Sanitary sewer main replacement on portions of Avenue H Avenue A, Newark Avenue Avenue I Court Street, Parkdale Avenue and Avenue G (DOE 5145) The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction on all streets mentioned above Street improvements include pavement reconstruction construction of standard concrete curb and gutter driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior to street reconstruction The project was advertised on October 5 2006 and October 12 2006 On November 16 2006 the following bids were received BIDDERS AMOUNTS Logname 30AVENUE H00275 Page 1 of 3 Stabile 8 Winn Inc. $2,572,329.25 McClendon Construction Company Inc. $2,875 003 10 Conaster Construction TX, LP $2 984 636 75 JLB Contracting LP $3 001 107 15 Jackson Construction Ltd $3 024,257 00 Time of Completion 264 -Working Days The new pavement will consist of 7-inch concrete over 6-inch lime stabilized subgrade with 7-inch concrete curb Funding in the amount of $70 583 14 is included for associated water and sewer construction survey project management, pre-construction material testing inspection and project close out (water $60 962.00 and sewer $9 621 14) The contingency funds to cover change orders total $37,236 00 (water $25 000 00 and sewer $7 736 00) Funding in the amount of $154 083 70 is required for associated paving and drainage construction survey project management, pre-construction material testing inspection and project close out. Contingency for pavement reconstruction is $50 504 00 M/WBE -Stabile 8~ Winn Inc. is in compliance with the City's M/1NBE Ordinance by committing to 37 percent M/WBE participation on this combined project. The City's goal on this combined project is 24 percent.
