AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY
LOCATED BETWEEN WEST BERRY STREET AND BOWIE STREET
ADJACENT TO LOTS S, 1-C, 1-B, AND 1 A OF BLOCK 11 OF FOREST
PARK ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY TEXAS AS RECORDED IN VOLUME 310, PAGE
49 AND VOLUME 388-46, PAGE 277 OF THE DEED RECORDS OF
TARRANT COUNTY TEXAS, BEING AN ALLEY 12 FEET WIDE BY
205.25 FEET LONG AND CONTAINING 2,463 SQUARE FEET OR O.OS6
ACRE OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID
LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That an alley located between West Berry Street and Bowie Street, and adjacent to Lots 5
1-C, 1 B and 1 A of Block 11 of Forest Park Addition, an addition to the City of Fort Worth,
Tarrant County Texas as recorded in Volume 310, Page 49 and Volume 388-46, Page 277 of the
Deed Records of Tarrant County Texas and being an alley twelve {12) feet wide and containing
2,463 square feet or 0 056 acre of land, and as more specifically described in Exhibits A `B"
and `C" attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the easement to the land ~n the above-described vacated alley is hereby released and
shall revert to the ad}acent owner as provided by law
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

A PORTION OF A 12 FOOT WIDE ALLEY
ADJACENT TO LOTS 5,1-C,1-B AND 1-A
OF BLOCK 11 OF FOREST PARK ADDITION
FORT WORTH, TARRANT COUNTY TEXAS
BEING a 12 foot wide alley bounded on the east by a portion of lot 1-C of Block 11and on the west by
Lot 1-A and Lot 1-B of Block 11 as recorded in Volume 388-46, Page 277 of the Deed Records of
Tarrant County Texas (D R.T C T) and on the west by Lot 5 of Block 11 as recorded in Volume 310,
Page 49 of the D.R.T C T and being more particularly described as follows.
Beginning at the southeast corner of said Lot 1-A, in the north right-of-way line of West Berry Street;
THENCE, North 00°34'21 West, along the east line of said Lot 1-A at 105.25 ft. passing the
northeast comer of said Lot 1-A at the southeast comer of said Lot 1-B continuing along the east line
of said Lot 1-B at 155.25 ft. passing the northeast comer of said Lot 1-B at the southeast corner of
said Lot 5 continuing along the east line of said Lot 5 in all a distance of 205.25 ft. to the northeast
comer of said Lot 5
THENCE, North 89°25'44" East, 12.0 ft. to a point in the west line of said Lot 1-C•
THENCE, South 00°34'21 East, along the west line of said Lot 1-C, a distance of 205.25 ft. to the
southwest corner of said Lot 1-C in the north right-of-way line of West Berry Street;
THENCE, North 89°25'42° West, along the north right-of way line of said West Berry Street, a
distance of 12.0 ft. to the Point of Beginning and containing 2,463 square feet of land.

Adopt an Ordinance Vacating a 0 056 Acre Portion of an Unnamed Alley between West Berry Street
and Bowie Street in the City of Fort Worth
RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating a portion of an alley right-of-way between West Berry Street and Bowie
Street, being approximately 12 feet wide by 205 25 feet long consisting of 0 056 acre of land in the Forest
Park Addition located in the City of Fort Worth as filed in Volume 388-46 Page 277 and Volume 310 Page
49 of the Deed Records of Tarrant County Texas.
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624)
DISCUSSION
J B Davies Inc. of Fort Worth on behalf of Texas Christian University requests to vacate the above
referenced right-of-way and to replat and incorporate it within the adjoining property for the purpose of
commercial development. The City Plan Commission recommended approval of this request at its meeting
on November 17 2006 An acceptable replat (FS-06-240) has been received Any existing utilities will be
relocated at the applicant's expense or retained within a designated easement, along with an appropriate
plat note that no permanent structures may be constructed or placed thereon
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting The City
does not own land under or adjacent to the above referenced right-of-way Since no City funds have been
expended to purchase property or easement rights collection of the fee value or any portion thereof is
recommended by staff to be waived
This request is in COUNCIL DISTRICT 9
