WHEREAS, the City of Fort Worth (CITY) and Halff Associates, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No. 43789, (the
CONTRACT) which was authorized by M&C C-25819 on the 11 day of September
2012 in the amount of $749, 823. 00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Neighborhood Transportation Connections for Pedestrians and
Bicycles; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $29, 900 . 00 which was administratively authorized on
January 25, 2013, Amendment Number 2 in the amount of $7, 200 . 00 which was
administratively authorized on July 25, 2013, and Amendment Number 3 in
the amount of $7, 500. 00 which was administratively authorized on October
1, 2013 .
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated September 5, 2014, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $195, 200 . 00 . (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $989, 623 . 00 .

All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect .

As per your request, Halff Associates is pleased to submit this fee proposal for$195,200 to provide engineering
services to design the Mistletoe Heights pedestrian bridge crossing and the Trinity River low water crossing of
the Quanah Parker/Handley Ederville Trail.
A. Mistletoe: Halff will design a pedestrian bridge access with intermediate piers that crosses the Trinity
River and a reroute the pedestrian access approaching the bridge.
B. Quanah Parker: Halff will design a low water crossing will consisting of modifying the existing dam
structure that will cross the Trinity approximately 150 feet west of the Handley Ederville Road Bridge to
allow bike and pedestrian access. The signage and pavement marking plan will include approximately
9,000 If of on-street bike lanes along Jack Newell Boulevard, Riverbend Drive, Midway Road and Burns
Street. Per our understanding of the requirements,the specific tasks are identified as follows:
Project Summary:
A. Mistletoe ($28,400):
1. Design Services($18,000):
a. Structural/Trail Design: The structural/trail work will include the reroute of the pedestrian
access and design of a pedestrian bridge system with intermediate pier locations. This scope of
work will include:
i. Preparation of 60%, 95% and 100% construction drawings and specifications for the
bridge abutment,concrete piers and associated retaining walls.
ii. Construction Administration, including review of RFI's and shop drawings for the
proposed bridge crossing.
2. H&H ($5,400):
During the design of the Clear Fork crossing at Mistletoe Heights the regulatory hydraulic model
used by the USACE was updated. The regulatory water surfaces in the vicinity of the project

were increased in the updated model, which will require additional effort to minimize the
hydraulic impacts of the crossing.
a. The H&H/Floodplain Analysis scope of work will include:
i. Obtain USACE CDC model (version effective January 01, 2014)
ii. Develop revised existing hydraulic model utilizing detailed field survey.
iii. Incorporate crossing and associated pedestrian trail improvements into hydraulic model
to assess impacts to water surface elevation and valley storage.
iv. Work with civil and structural engineers to minimize hydraulic impacts of the crossing
and associated pedestrian trail.
3. Aquatic Survey Coordination($5,000):
This scope of services is for coordination with both the Texas Parks and Wildlife Department (TPWD)and
the City of Fort Worth Parks Department to determine what actions will be required by TPWD regarding
the presence/absence survey for state-listed threatened freshwater mussels within the Clear Fork Trinity
River for the new bridge associated with the Mistletoe Heights Project in Tarrant County, Texas. From
July 29 through July 31, 2014, a presence/absence survey for state-listed threatened mussels was
performed by Halff Associates for the North Texas Tollway Authority (NTTA) Chisholm Trail Parkway
(CTP) project, located approximately 1,200 linear feet (I.f.) downstream of the proposed new bridge.
During this survey, no state-listed threatened mussels were documented; however, an unidentified
mussel was located, and final species identification via DNA analysis is pending.
Preliminary evaluation of the proposed bridge crossing indicated that a presence/absence survey via
SCUBA and/or tactile search methodology may not be feasible. The proposed new bridge is located
approximately 400 LF upstream of a low-head dam, known as City Dam. In addition, the Clear Fork
Pump Station and associated water intake structure for the City of Fort Worth are located approximately
250 LF downstream of the proposed bridge location. The dam and water intake structures pose
significant safety risks that limit the ability to conduct state-listed threatened mussel survey activities.
Because no state-listed threatened mussel species were documented during the recent CTP survey
located approximately 1,200 LF downstream of the proposed project and known safety hazards exist
within the project area, there is the potential that a typical presence/absence survey may not be
required by TPWD. Coordination with TPWD and the City will be necessary to determine what actions
will be required for this project in accordance with Chapters 67 and 68 (Sections 68.002 and 68.015) of
the TPWD Code; 31 Texas Administrative Code (TAC) §65.175 & 176; and the TPWD Aquatic Resource
Relocation Plan Guidelines. The professional services to be provided by Halff Associates, Inc. (Halff) on
the project will include the below tasks.
a. Project Coordination
Development and maintenance of effective communication between Halff, the City of Fort
Worth, and TPWD will be a key factor in achieving successful and expedient project completion.
All correspondence and coordination through TPWD will be handled with the concurrence of the
City of Fort Worth. Halff will oversee the preparation of documents and manage the following
project activities described in items(A) and (B) below.

i. Project Meetings. This task will include one (01) project meeting and site visit as well
as one (01) project meeting via teleconference to determine the survey requirements.
Should additional meetings be required, these would be conducted under a
supplemental scope of services.
ii. Survey Requirement Documentation. Halff will document applicable project-related
meetings and will forward meeting minutes in electronic format to the appropriate City
of Fort Worth and TPWD representatives and other project team members, as
applicable. Final documentation detailing TPWD-required mussel presence/absence
survey activities will be prepared by Halff and submitted to the City of Fort Worth and
TPWD upon the completion of coordination activities.
iii. Service Completion. After project completion and contract finalization, Halff will submit
project files/exhibits to the City of Fort Worth and/or TPWD upon request. Copies of
project files will be retained by Halff for a minimum of three (03)years after submittal
of originals to the City of Fort Worth and/or TPWD.
Deliverables
• The survey requirement documentation will include descriptive text (general
project description, site description), agreed upon survey methodology, site
photographs, and associated figures/exhibit (electronic copy and up to three (03)
hard copies).
• Project files and exhibits (upon request)
b. Quality Assurance/Quality Control
Halff will conduct comprehensive quality assurance/quality control reviews for all deliverables
throughout the duration of the project.
B. Quanah Parker ($166,800):
The City of Fort Worth is requesting the design of a crossing of the West Fork of the Trinity River upstream
of Handley Ederville Road via a low-water crossing in the vicinity of an existing channel dam. In addition they
have requested a re-route of the on-street bike facilities from the low water crossing to the TRE Station.
1. Design Services($59,700):
a. On-Street/Off-Street Trail Design:The Trail Design scope of work will include:
i. One(01)site visit.
ii. Preparation of 60%,95%and 100%construction plans that will include:
1. Typical sections.
2. Tree Removal/Demolition Plan.
3. Off-Street Trail Plan and Profile.
4. Quantity Summary Sheets.
5. Traffic control plans

b. Structural Design: The structural work will include the design of a reinforced concrete structure
to be used as a pedestrian low water crossing. Where feasible, the new structure will use
elements of the existing outfall structure to help support it.This will include:
i. Preparation of construction drawings and specifications for widening the existing
concrete outfall structure to become an pedestrian accessible low water crossing.
ii. Construction Administration, including review of RFI's and shop drawings for the
proposed low water crossing.
2. Geotechnical Services($2,700):
a. Driller and technicians will evaluate subsurface conditions with two (02) borings of
approximately 50 to 60 feet in depth for the proposed low water crossing.
b. An engineering analysis and evaluation of the field and laboratory data will be performed for the
project, based on available project data. Information to be provided in the report includes:
i. Plan of borings illustrating the approximate location of each boring and scale to which
the drawing is made
ii. A log of each boring indicating the boring number, depth of each stratum, soil
classification and description, and groundwater information
iii. Description of the field exploration and laboratory testing
iv. Summary of laboratory test results
v. Discussion of subsurface soil and groundwater conditions
vi. General discussion of the site geology
vii. Estimated soil movements
viii. Recommendations for foundation type, depth, and allowable loading for bridges and
retaining walls
ix. Foundation construction recommendations
x. Lateral earth pressure for retaining wall design
xi. Pavement Section Designs
xii. Recommendations for backfill
xiii. Earthwork recommendations
3. H&H ($28,000):
a. The H&H/Floodplain Analysis scope of work will include:
i. One (01)site visit.

current effective hydraulic model for this reach of the West Fork and develop revised
existing hydraulic model utilizing detailed field survey.
iii. Incorporate proposed crossing and associated pedestrian trail improvements into
hydraulic model to assess impacts to water surface elevation and valley storage.
iv. Work with civil and structural engineers to minimize hydraulic impacts of the crossing
and associated pedestrian trail.
v. Prepare draft hydraulic memo documenting the preliminary hydraulic analysis of the
proposed crossing.Submit copies to City of Fort Worth, USACE, and TRWD for review.
vi. Coordinate with City of Fort Worth, USACE, and TRWD to start the CDC permitting
process.
vii. Attend meeting with City of Fort Worth, USACE, and TRWD.
viii. Prepare CDC Permit and submit to USACE.
ix. Prepare Floodplain Development Permit and submit to City of Fort Worth.
x. Address City of Fort Worth, USACE,and TRWD review comments and issue final memo.
4. Survey($25,500):
a. Survey scope of work will include:
i. Topographical survey of the affected area from the south side of the Trinity River to Jack
Newell Blvd.
ii. Tying bottom of the Trinity River Adjacent to the existing low water crossing
iii. Tying existing trees and surface utilities.
iv. Tying existing property corners to the property at the corner of Jack Newell Blvd and
Handley Ederville Rd.
v. Tying the existing limits of overhead utility easement form the top of the TRWD levee to
Jack Newell Blvd.
vi. Defining the limits of ROW along Handley Ederville Rd. from the top of levee to Jack
Newell Blvd.
4. Aquatic Survey Coordination ($5,000):
This scope of services is for coordination with the Texas Parks and Wildlife Department (TPWD), the City
of Fort Worth Parks Department, and the Tarrant Regional Water District (TRWD) to determine what
actions will be required regarding aquatic species, including mussels, fish, and turtles, within the West
Fork Trinity River for the new low water crossing associated with the Handley Ederville Project in Tarrant
County, Texas. The proposed new low water crossing is located along an existing low head dam
operated by TRWD. Preliminary evaluation of the proposed low water crossing indicated that a
presence/absence survey for state-listed freshwater mussel species via SCUBA and/or tactile search
methodology may not be feasible due to the presence of the low head dam and associated safety issues.
In addition, at this time it has not been determined what areas within the West Fork Trinity River would
need to be dewatered in order to complete construction.
Coordination with TRWD and the City will be required to determine what is feasible regarding the
dewatering process within the West Fork Trinity River as well as safety issues associated with conducting
survey and/or relocation activities for aquatic species adjacent to the existing low head dam. In
addition, coordination with TPWD and the City will be necessary to determine what actions will be

required for this project in accordance with Chapters 67 and 68 (Sections 68.002 and 68.015) of the

S. Special Services($48,000):
a. Environmental ($46,000):
This Scope of Work supplements the original Scope of Work in the above-referenced contract
regarding "Scope of Services —Section 9.0 Special Services; Subsection 9.7 Preliminary
Environmental Analysis." The five connections associated with the proposed Transportation
Connections for Pedestrians and Bicycles Project was originally scoped to be processed as one
Programmatic Categorical Exclusion (PCE)or Blanket Categorical Exclusion (BCE)document. The
amended state rules governing environmental review for transportation projects became
effective in April 2014, which eliminated all PCE/BCE classifications and reclassified them as
Categorical Exclusions (CEs). While work was in progress, the proposed Transportation
Connections for Pedestrians and Bicycles Project was elevated to a CE. In addition, the
Mistletoe Heights Neighborhood — Forest Park Connection and Quanah Parker Park
Connection have been going through design changes resulting from ongoing coordination with
the Texas Department of Transportation (TxDOT), City of Fort Worth, and Halff Associates. In
the interest of moving the project forward, three of the five proposed connections (the
Meadowbrook Connection, the River Park Trailhead, and the South Hills Neighborhood —
Westcreek Drive Connection) were environmentally cleared as one CE. Additional effort is
required beyond the original scope and budget to process the Mistletoe Heights Neighborhood
—Forest Park and Quanah Parker Park Connections.
Halff will provide additional environmental services as described in this scope of work for the
proposed Transportation Connections for Pedestrians and Bicycles in the City of Fort Worth.
These revised tasks will only apply to the Mistletoe Heights Neighborhood — Forest Park
Connection and Quanah Parker Park Connection, and supersede the listing of tasks described
in Task 9.7 in the original contract (9.7.1 through 9.7.6) as well as add new Tasks 9.7.7 through
9.7.10. This Supplemental Scope of Work does not alter any other aspects of the original
contract or previous amendments except as explicitly stated herein. The additional tasks
included in this scope of services, including a new description of deliverables, are listed
below:
9.7 Preliminary Environmental Analysis
9.7.1 An environmental review and appropriate documentation is required for the
proposed project in accordance with the National Environmental Policy Act (NEPA)
of 1969 and the Council on Environmental Quality (CEQ) Regulations, 23 Code of
Federal Regulations (CFR) Part 771, 43 Texas Administrative Code (TAC) Chapter 2,
Subchapter C, and Federal Highway Administration (FHWA) Technical Advisory (TA)
T6640.8A. The environmental process will follow guidance published by TOOT
(February-May 2014) regarding Categorical Exclusion (CE) determinations. The
project is considered a "c-list" CE project based on 23 CFR 771.117(c)(3)

additional sub-tasks will be necessary to receive a CE determination from the TxDOT
Fort Worth District.
This supplemental scope of work and fee estimate are based on the assumption that
the proposed improvements for the Mistletoe Heights Neighborhood — Forest Park
Connection and the Quanah Parker Park/Handley TRE Connection can be processed
together as one CE and would meet the requirements of 23 CFR 771.117,
Categorical Exclusions.
The U.S. Army Corps of Engineers (USACE) may have authority under 33 USC 408
(Section 408) to ensure the proposed improvements associated with the Mistletoe
Heights Neighborhood — Forest Park Connection at the Clear Fork Trinity River
would not change the local flood protection project's authorized scope, purpose, or
functionality or increase risks to public safety. In the event the Mistletoe Heights
Neighborhood — Forest Park Connection is determined by the USACE to be subject
to Section 408, USACE review and approval would be required for this trail segment
and would be performed under a supplemental work order. In the event it is
determined that a CE is not the appropriate level of documentation for the
Mistletoe Heights Neighborhood — Forest Park Connection or the Quanah Parker—
Handley TRE Connection, Halff will notify the city and a supplemental scope of work
will be prepared to allow completion of other suitable documentation.
9.7.1.1 The purpose of this subtask is to provide scoping documentation to the TxDOT Fort
Worth District to initiate the CE process. Halff will complete the required forms and
submit to the TxDOT Fort Worth District Environmental Coordinator. This task
includes one meeting with the city and the TxDOT Fort Worth District. The following
items will be submitted to the TxDOT Fort Worth District for review and approval,
and revised in accordance with comments received from TxDOT, as necessary:
• Preliminary Project Scope Form for CEs
• Environmental Information Request Form
• Risk Assessment Form including:
• Biological Resources
• Water Quality
• Noise
• Indirect and Cumulative Impacts
• Public Involvement
• Final Project Scope Form for CEs
• Project Schedule for Deliverables
Halff will obtain updated digital environmental information available from
appropriate local, state, and federal agencies. Data collected through this task will
be stored in Geographical Information Systems (GIS)format.
9.7.1.2 The purpose of this subtask is to prepare resource agency coordination requests and
technical reports for resources that require additional assessment as defined in the

risk assessment phase of the project. These technical reports will be used by TxDOT
to initiate resource/regulatory agency coordination and to obtain
feedback/approval from agencies, as applicable. This project is anticipated to
require the following technical reports as further described in Tasks 9.7.3 through
9.7.8.

• Water Resources Technical Report
• Archeological Studies Project Coordination Request (PCR)
• Historical Studies PCR
• Hazardous Materials Initial Site Assessment (ISA)

PCRs and technical reports will be submitted to the TxDOT Fort Worth District and
revised in accordance with comments received from TxDOT.
9.7.2 Data Collection and Environmental Constraints Mapping
A site visit of the project area will be performed to document existing conditions.
This task includes taking on-site photographs of existing conditions.
9.7.3 Biological Investigations
This task includes an assessment of the project's compliance with the following
federal and state regulatory requirements.
• Endangered Species Act of 1973
• Migratory Bird Treaty Act and Golden Eagle Protection Act
• Fish and Wildlife Coordination Act
• Farmland Protection Policy Act
• Executive Order on Invasive Species
• Executive Memorandum on Environmentally and Economically Beneficial
Landscaping
• Texas Parks and Wildlife Department (TPWD) Coordination per
Memorandum of Understanding (MOU) (reissued 2013)
An assessment will be conducted for vegetation and protected habitat impacts in
accordance with the 2013 MOU between TxDOT and the TPWD. Associated
mapping and a Biological Evaluation Form will be completed. This task does not
include threatened or endangered species surveys or Section 7 consultation with
the United States Fish and Wildlife Service under the Endangered Species Act. If
necessary,these services can be provided under a supplemental scope of work.
9.7.4 Water Resources Investigations
This task includes preparing a Water Resources Technical Report to document
compliance with the following:

A jurisdictional determination of waters of the United States, including wetlands,
will be made within the anticipated ROW for the project. This determination will
include delineation of the boundaries and ordinary high water mark of jurisdictional
waters within the ROW. Preparation of a Preconstruction Notification (PCN),
mitigation plan or a USACE Section 404 Individual Permit Application is not included
in this scope of work. The West Fork Trinity River downstream of Riverside Drive is
considered a navigable water by the USACE Fort Worth District; the proposed
crossing would require coordination and written authorization from the USACE
under Section 10 of the Rivers and Harbors Act. Once permitting requirements have
been properly identified,an additional scope and fee can be prepared.
9.7.5 Cultural Resources Project Coordination Requests
Cultural resources investigations must be conducted in compliance with the
requirements of Section 106 of the National Historic Preservation Act (NHPA) [16
USC § 470(f)] and implementing regulations (36 CFR Part 800). Archeological
investigations must be performed in compliance with the Antiquities Code of Texas
(13 TAC 26 and Title 9, Chapter 191, Subchapters A-F of the Texas Natural Resources
Code, as amended) due to the City of Fort Worth being a political subdivision of the
State of Texas.
A records review will be conducted to identify recorded archeological or historic
sites within the area of potential effects (APE) for the proposed project. This task
includes preparing Archeological and Historic Structures PCRs. This task does not
include cultural resources surveys, evaluation of National Register of Historic Places
(NRHP) eligibility for any resources, evaluation of effects on NRHP-eligible or -listed
sites, or Section 4(f) evaluations. These services can be provided under a separate
scope of work and cost estimate, if necessary.
9.7.6 Hazardous Materials Initial Site Assessment Technical Report
A Hazardous Materials ISA will be conducted and a technical report will be
prepared. The ISA will assist in determining the presence or likely presence of any
hazardous substances or petroleum products in the project study area and identify
any conditions that may indicate an existing release, a past release, or a material
threat of a release of any hazardous substances or petroleum products into the

ground, groundwater, or surface water of the project area. The ISA will include
records review, site reconnaissance, evaluation of recorded sites and conditions
observed during the site visit, and report preparation. The scope of work does not
include a Phase I Environmental Site Assessment performed in accordance with
applicable American Society for Testing and Materials (ASTM)standards.
9.7.7 Socioeconomics Technical Report
A technical report will be prepared documenting the population and income
characteristics of the immediate area surrounding the proposed project, and
identifying potential impacts on Environmental Justice (EJ) and Limited English
Proficiency (LEP) populations as well as potential impacts on community cohesion.
9.7.8 Air Quality Technical Report
A technical report will be prepared documenting the project area attainment status
relative to the National Ambient Air Quality Standards (NAAQS), as well as project
exemption from an air conformity determination, project exemption from a traffic
air quality analysis, and project consistency with the Metropolitan Transportation
Plan (MTP) and the Transportation Improvement Program/Statewide Transportation
Improvement Program (TIP/STIP).
9.7.9 EPIC Sheet
An environmental permits, information, and commitments (EPIC) design sheet will
be prepared and submitted to the TxDOT Fort Worth District, and revised in
accordance with comments received from TxDOT.
9.7.10 Prepare CE Determination Form
Halff will prepare and submit a draft CE Determination Form for TxDOrs
consideration for approval of the proposed project.
b. Accessibility Review($2,000):
Halff will submit drawings and specifications to the Texas Department of Licensing and
Regulation for review of accessibility. We will incorporate any comments received and make
adjustments to the plans as needed.
Exclusions:
1. CLOMR (or LOMR upon completion of project construction)submittal to FEMA.
2. 408 permit coordination with the USACE.
3. Formal hydraulic report.
4. Environmental technical reports for the following items are excluded from this scope of services: noise,
indirect impacts,cumulative impacts, and public involvement.
5. This scope of services does not include state-listed threatened mussel presence/absence survey
activities, the preparation of an Aquatic Resource Relocation Plan (ARRP), and/or species recovery and

DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of
Amendment No. 4 to the Engineering Agreement with Halff Associates, Inc., (City Secretary Contract No.
43789) in an amount of $195,200.00 for additional design and engineering services related to the
Neighborhood Transportation Connections for Pedestrians and Bicycles Project; thereby, revising the total
contract amount to $989,623.00.
On May 3, 2011, (M&C G-17267) the City Council authorized the City Manager to execute a Local Project
Advance Funding Agreement with the Texas Department of Transportation (TxDOT) for a Transportation
Enhancement Program - Neighborhood Transportation Connections for Pedestrians and Bicycles Grant.
The 80 percent federal participation is $4,416,100.00 while the 20 percent local participation share is
$1,104,025.00, together totaling $5,520,125.00.
On September 11, 2012, (M&C C-25819) the City Council authorized an Engineering Agreement with Halff
Associates, Inc., in the amount of$749,823.00 for the design and engineering of Neighborhood
Transportation Connections for Pedestrians and Bicycles Project.
Contract Amendment No. 1 ($29,900.00) added additional topographic survey, tree survey, hydraulic
study, geotechnical investigation services and preparation of trail easement documents to the consultant's
scope of services for an alternate trail route from what was originally included in the project scope;
Contract Amendment No. 2 ($7,200.00) added additional topographic survey, tree survey and schematic
design services and Contract Amendment No. 3 ($7,500.00) added additional topographic survey and tree
survey. Engineering and design services in this contract amendment include additional structural design
and hydraulic study for the Mistletoe Heights bridge required due to a proposed change to the bridge
location, structural engineering for the design of a low water crossing near Handley Ederville Road that
was not in the original contract and aquatic survey coordination required by the Texas Parks and Wildlife
Department.
