AUTHORIZING THE DEDICATION OF 49.6 ACRES OF PARKLAND WITHIN
NORTHWEST COMMUNITY PARK AS A NATURAL AREVOPEN SPACE IN
PERPETUITY, AS REQUIRED BY THE TEXAS PARKS AND WILDLIFE DEPARTMENT'S
URBAN OUTDOOR RECREATION GRANT.
WHEREAS, the City Council desires to provide quality park facilities for the
residents of Fort Worth;
WHEREAS, on March 1, 2011, the City Council adopted Resolution Number
3971-03-2011, authorizing an official from the City of Fort Worth ("City") to apply for
an Urban Outdoor Recreation Grant from the Texas Parks and Wildlife Department's
("TPWD") Local Park Grant Program to support the development of Northwest
Community Park ("Park");
WHEREAS, on August 21, 2011, the TPWD awarded a $1,000,000.00 grant to the
City, and the City entered into a grant agreement with the TPWD on September 21, 2011
(City Secretary Contract Number 42309);
WHEREAS, on September 25, 2012, the City Council authorized the acceptance,
by way of appropriation, of the full $1,000,000.00 in grant funds (Mayor and Council
Communication No. C-25888);
WHEREAS, as part of the grant, the TPWD requires the City to dedicate a portion
of the Park as a natural area/open space in perpetuity; and
WHEREAS, in accordance with Section 24-37 of the Fort Worth City Code, the
Parks and Community Services Director proposes to set aside 49.6 acres of natural
area/open space within the Park to satisfy the requirements of the grant.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
In order to fulfill the requirements of the TPWD's grant to the City for the
development of the Park, the City Council of Fort Worth, Texas hereby designates 49.6
acres of parkland in the Park for natural area/open space, the approximate location of
which is set forth in the attached exhibit.

Authorize Execution of a Construction Contract with The Fain Group, Inc., in the Amount of$819,428.50 for
the Construction of Park Improvements at Northwest Community Park and Adopt Resolution Dedicating
49.6 Acres of Parkland Within Northwest Community Park as Natural Area/Open Space (COUNCIL
DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the execution of a construction contract with The Fain Group, Inc., in the amount of
$819,428.50 for the construction of park improvements at Northwest Community Park; and
2. Adopt the attached resolution dedicating 49.6 acres of parkland within Northwest Community Park as
Natural Area/Open Space in perpetuity, as required by the Texas Parks and Wildlife Department Urban
Outdoor Recreation Grant(City Secretary Contract No. 42309).
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the award and execution of
a construction contract to The Fain Group, Inc., in the amount of$819,428.50 for the construction of
Phase I park improvements at Northwest Community Park and to adopt the attached resolution dedicating
49.6 acres of parkland within Northwest Community Park as a Natural Area/Open Space in perpetuity.
On March 1, 2011, (Resolution No. 3971-03-2011)the City Council authorized the City Manager to apply
for the Urban Outdoor Recreation Grant in the amount of$1,000,000.00 from the Texas Parks and Wildlife
Department (TPWD). At that time, the City was negotiating for the purchase of the property and used the
value of the Park as the source of the local match. On June 14, 2011, (M&C L-15210)the City Council
authorized the purchase of 245.77 acres for the Park in the amount of$7,000,000.00 and esitmated
closing cost up to $45,000.00. On September 21, 2011, (City Secretary Contract No. 42309)the City
entered into a grant Agreement with TPWD for the$1,000,000.00 awarded for the Urban Outdoor
Recreation Grant.
On September 25, 2012, (M&C C-25888)the City Council authorized award of an Engineering Agreement
with Gary Paul Kutilek d/b/a the Landscape Alliance, in the amount of$188,790.00 for the design and
engineering of park improvements at Northwest Community Park(City Secretary Contract No. 43928).
Upon the conclusion of public input meetings held November 27, 2012 and February 25, 2013 and
following the Park Board endorsement of the Northwest Community Park Master Plan on November 24,
2013, construction document preparation was initiated for Phase I of the proposed park improvements.
The project was advertised for bids on October 23, 2014 and October 30, 2014 in the Fort Worth Star-

On November 13, 2014, the following bids were received and tabulated:

Base Bid improvements include dam improvements, spillway reconstruction, concrete trail, a fishing pier,
signage-kiosk, concrete parking, metal gates, post and cable fencing, a junior soccer field with goals,
picnic tables and site restoration/re-vegetation.
Approved bid alternates include a soft surface hiking trail, dredging the pond around the fishing pier and
an additional picnic table.
It is recommended that the total bid amount of$819,428.50, as submitted by The Fain Group, Inc., be
approved for award of contract. In addition to the contract cost, associated contingency funding for
construction inspection, change orders and testing is estimated in the amount of$28,571.50 for a project
construction phase total of$848,000.00.
M/WBE OFFICE- The Fain Group, Inc., is in compliance with the City's BDE Ordinance by committing to
15 percent MBE participation on this project. The City's MBE goal for this project is 15 percent.
Permitting fees shall be waived for this project as noted in the Specifications and Contract Documents for
Northwest Community Park; Division I - General Requirements- Section 01100 - Summary of Work-
Note. No.3.
The annual operating impact is estimated to be$2,210.00 for softscape (turf/plantings) and hardscape
(built) maintenance in areas where new park amenities will be constructed.
Construction is anticipated to commence in early 2015 and be completed by the summer 2015. Contract
time is 180 calendar days.
In accordance with the requirements set forth in the TPWD Urban Outdoor Recreation Grant received for
this project,the City Council is asked to adopt the attached resolution dedicating 49.6 acres of parkland
within Northwest Community Park as a Natural Area/Open Space in perpetuity.
Northwest Community Park is located in COUNCIL DISTRICT 7.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated in the Grant Capital Projects Fund.
