HomeMy WebLinkAboutContract 25694 CITY SECRETARY CONTRACT No, AMENDMENT NO. 1 STATE OF TEXAS 3 CITY SECRETARY CONTRACT (No M&C Needed) COUNTY OF TARRANT 3 WHEREAS, the City of Fort Worth (City) and BLACK & VEATCH, L.L. P. , (Engineer) made and entered into City Secretary Contract No. 24590, (the Contract) which was authorized by the City Council by M&C C-17213 on the 12TH day of JANUARY, 1999; and WHEREAS, the Contract involves engineering services for the following project : CONSTRUCTION MANAGEMENT AND INSPECTION SERVICES FOR NORTHSIDE III WATER TRANSMISSION MAINS. WHEREAS, it has become necessary to execute Amendment No. l to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract : 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated March 9, 2000, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $14, 740 . 00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $65, 280 . 00 . Fort Worth Department of Engineering 1000 Throckmorton Fort Worth, Texas 76102 Subject: Contract Amendment 1 - City Contract 24590 Dear Ms. Johnson: We are respectfully requesting a contract amendment for the above referenced project in the amount of$14,740.00. The amendment request is for additional construction management, field inspection and conflict resolution that was required to address design discrepancies, unknown underground conditions and operational problems encountered with existing water utilities. In addition, the City has requested that Jackson Construction Company extend this waterline from the intersection of Bowman Roberts Road and Bailey Boswell Road to Lake County Estates west of Boat Club Road. This amendment is required due to changes in our scope of work during execution of this contract. The change in the nature of the work required more construction management and field inspection. Resolution of conflicts also required additional hours by more experienced and higher compensated staff than budgeted in the original scope of work. The following is a summary of the major project impacts: 1. The engineering design omitted 150 feet of 30-inch tunnel bore from the bid proposal form. In an effort to reduce the impact of this omission, we sought approval for alternative construction methods from Tarrant County and processed required change orders with the construction contractor. 2. The engineering design included incorrect coordinates for the new fencing boundaries on the McNeil and Elkins properties. Installation of the fencing as shown on the design drawings would have resulted in the inclusion of property boundaries that were intended but not obtained by boundary documents. Identifying this land rights discrepancy and determining the differences from intended boundaries and actual boundaries obtained required additional project management time. 3. Service lines for the Kenneth Reed property were not included in the engineering design drawings. We negotiated many proposal cycles with the contractor before agreeing to get this work completed. the imagine•build company- I(,�� ,. J4PP� Yeo City of Fort Worth B&V Project 62063.500 W.D. The pipe at the terminus of the 16-inch line on Bob Hanger St. was found to be ductile iron pipe (DIP) rather than reinforced concrete cylinder pipe (RCCP) as indicated on the drawings. The pipe connection was redesigned in the field. 5. The location of utilities at the tie-in at the intersection of Old Decatur and Boswell Road was different than indicated on the drawings resulting in change orders and field design changes. 6. An existing water line that was connected to the new line was found to be stagnate and required significant coordination of activities to clean, flush, chlorinate, sample, test and re-testing to improve conditions in the existing line and new line. This work had to be coordinated between Fort Worth Water Department field operations, plant operations and laboratory, and the contractor. In addition Black & Veatch conducted the field sampling activities to resolve this issue. 7. Significant Construction Management time was required to address damage claims at the Walton property for allegations of improper drainage conditions due to construction activities. Our preconstruction videotape of the property indicated no property impacts from construction activities. Several meetings were required regarding the final restoration of this property. 8. Construction management and construction inspection for the extension of the water line to Lake Country Estates. The detailed breakdown of the additional labor charges for Items 1 through 7 is contained in the attached table. No. PW77-060770140340 March 9, 2000 Page No.3 We have attached a copy of our initial proposal letter for corroboration with the budget letter amount shown in the previous table. As-Built redline drawings, copies of our documentation and project files need to be produced and submitted in addition to the above hours. We propose Terra Mar for testing services and Accuracy Plus for clerical services to fulfill the additional obligations for Item 8, in the amount of $1,385.00 Thus, the total charges shall be as follows: Items 1 — 7: $ 5,530.00 Item 8 $ 9,210.00 Total $14,740.00 Construction contract change orders will be approximately $500,000 or 25% of cost for this water transmission main project. Our additional time and contract amendment request on this project represents approximately 3% of the construction contract change orders.
