AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN
THE AMOUNT OF $307 059 FROM A STORM WATER UTILITY FUND
TRANSFER, FOR THE PURPOSE OF EXECUTING AN ENGINEERING
AGREEMENT WITH TEAGUE NALL AND PERKINS INC FOR CROMWELL
MARINE CREEK/COMANCHE CREEK CULVERT IMPROVEMENTS (CITY
PROJECT NO 00478) PROVIDING FOR A SEVERABILITY CLAUSE, MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-
2007 in the Budget of the City Manager there shall also be increased estimated receipts and
appropriations in the Storm Water Capital Projects Fund in the amount of $307 059 from a Storm
Water Utility Fund transfer for the purpose of executing an engineering agreement with Teague
Nall and Perkins, Inc. for Cromwell Marine Creek,/Comanche Creek Culvert Improvements (City
Project No. 00478).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 17142 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4
ADOPTED AND EFFECTIVE. _ _ Mav 29, 2007
This ordinance shall take. effect upon adoption.

RECOMMENDATION
It is recommended that the City Council
1 Authorize the transfer of $307 059 from the Storm Water Utility Fund to the Storm Water Capital Projects
Fund
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Storm Water Capital Projects Fund in the amount of $307 059 and
3 Authorize the City Manager to execute an engineering agreement with Teague Nall and Perkins Inc. in
the amount of $224 676 for Cromwell Marine Creek/Comanche Creek Culvert Improvements
DISCUSSION
The Storm Water Management Program was established to reduce flooding in Fort Worth preserve
streams minimize water pollution and to operate the storm water system in a more effective manner to fully
comply with state and federal regulatory requirements This will be accomplished by infrastructure
reconstruction and system maintenance master planning enhanced development review and increased
public education and outreach
The scope of this project includes design of culvert and adjacent channel improvements to Marine and
Comanche Creeks to convey the 100-year storm flow
Teague Nall and Perkins, Inc proposes to perform the necessary design work for a lump sum fee of
$224 676 City Staff considers this to be fair and reasonable for the .scope of services proposed
In addition to the contract amount, $82 383 is required by the Engineering Department for project
management.
M/WBE -Teague Nall and Perkins, Inc. is in compliance with the City's MMBE Ordinance by committing
to 24 percent M/WBE participation The City's goal on this project is 24 percent.
This project is located in COUNCIL DISTRICT 7 Masco 45Z and 47A.
FISCAL INFORMATION/CERTIFICATION
The Finance Director certifies that upon approval of the above recommendations and adoption of the

attached appropriation ordinance funds will be available in the current capital budget, as appropriated of
the Storm Water Capital Projects Fund
