SUBJECT: Environmental Use Agreement - Drake Realty Group
Ms. Watson
Drake Realty has requested to amend the Right-Of-Way Use Agreement To Install A
Well For Environmental Monitoring, City Secretary Contract No. 30762. The amendment
would provide for an extension of time to install the monitoring well, perform sampling,
and plug the well. Based on their letter (attached), Drake Realty's consultant was not
able to perform the necessary work in the amount of time allotted due to scheduling
difficulties.
The original contract was written with a short window to perform the work because a
Street Scape Project was planned to start in the area. Based on a conversation with Ms.
Christa Sharpe, Transportation of Public Works Department (TPW), TPW will not be
performing any groundwork until January, (e-mail attached).
Pursuant to Section 7 of the Agreement between the two parties, the term may extended
upon proof of necessity for up to five (5) years. Based on this information Environmental
Management agrees that the contract should be amended by extending the completion
date to December 17, 2004, by which time all work shall be completed and the well shall
be plugged. By your signature below, along with the attached signed request from the
User, this extension shall become an amendment to the Agreement.

Re:Request for an Extension of the Environmental Use Agreement Dated October 22, 2004
related to the use of the City Right of Way behind the curb adjacent to the west side of North
Main Street at 501 North Main Street.
Dear Mr. Breitling:
Please be informed that we could not complete the drilling activities for which the City of Fort Worth
authorized us to use the City Right of Way through the above referenced agreement. The delay in
initiating the activities was mainly due to lack of availability of a drilling rig and weather conditions.
As of to date, we have scheduled the drilling on December 1, 2004 and after that we will need at least
one additional week to complete the sampling activities. Therefore, we request an extension of the
Environmental Use Agreement for at least two weeks so that the data required by the Texas
Commission on Environmental Quality (TCEQ) can be collected.
We have already notified the City of Fort Worth Traffic and Public Works Department regarding our
planned drilling activities and also the Texas One Call/Dig TESS (Confirmation#043290679) has
been notified. We sincerely appreciate your assistance in this matter. Should you have any questions,
