AN ORDINANCE AMENDING SECTIONS 35-57 4(a), `WATER
TAP CONNECTIONS AND SECTIONS 35-57.5(a), `SEWER TAP
CONNECTIONS" OF CHAPTER 35 `WATER AND SEWERS"
ARTICLE III `CHARGES" OF THE CODE OF THE CITY OF
FORT WORTH (1986), AS AMENDED BY AMENDING CERTAIN
RATES AND CHARGES, MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL
ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY
CODE IN CONFLICT HEREWITH, PROVIDING A SAVINGS
CLAUSE PROVIDING A SEVERABILITY CLAUSE, AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH.
SECTION 1.
That Section 35 57 4(a), `Water Tap Connections" Amcle III `Charges" of Chapter 35
of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and
read as follow

That Section 35-57.5(a), `Sewer Tap Connections" Article III `Charges" of Chapter 35
of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and
read as follow

SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are m direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and such Code are hereby
repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation m this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 4
This ordinance shall take effect on October 1 2007

Adopt an Ordinance Amending Section 35-57 4(a) `Water Tap Connections and Section 35-57 5(a)
Sewer Tap Connections of Chapter 35 `Water and Sewers of the City Code to Revise the Water
and Sewer Tap Fees
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance to revise the water and sewer tap
fees to be effective on October 1 2007
DISCUSSION
The proposed ordinance will amend Section 35-57 4(a) `Water Tap Connections and Section 35-57 5(a)
Sewer Tap Connections of Chapter 35 `Water and Sewers of the City Code
The proposed tap fees increase will recover the actual costs incurred by the City when providing tap
installation services for developers Developers may use this service at their option in lieu of hiring
independent engineers and contractors to construct the water and sewer taps for their developments
The proposed tap fees reflect the actual construction costs incurred by the Water Department when the
developers request water and sewer taps To date only a small percentage of the developers use this
construction service offered by the City
Black and Veatch a consultant hired by the City reviewed and analyzed the Water Department's
miscellaneous fees. The consultant found that

2. The Water Department recovers an average of 50 percent of what is expended to install new water and
wastewater service taps and
3 The material and labor costs included in this service have increased at a steady rate over the last 10
years.
The result of the analysis also indicated that the existing tap fees were significantly less than the fees
charged by other municipal water utilities (See Exhibit 1)
The Water Department presented this proposed amendment to the following committees and received
favorable support:
Development Advisory Committee
Infrastructure and Transportation Committee
Central City Redevelopment Committee
Retail Water and Wastewater Rates Committee
