UON pATE~ i S-Fab-07 071 50 )F ~ ~F ~xh~~i~ City of Fort Worth, Texas Mayor and Council Communication .~ ~ ~ ___r COUNCIL ACTION Approved on 7/10/2007 Ord No 17636-07 2007 DATE Tuesday July 10 2007 LOG NAME 06VA-06-043 REFERENCE NO *PZ 2743 SUBJECT Adopt an Ordinance Vacating a 1 049 Acre Portion of Alta Vista Road from the South Right-of Way of Proposed Alta Vista Road to the North Line of Proposed North Beach Street in the City of Fort Worth and Approve Conveyance of the Vacated Right-of Way to the Adjacent Property Owners RECOMMENDATION It is recommended that the City Council 1 Adopt an ordinance vacating a portion of Alta Vista Road right-of-way from the south right-of-way of proposed Alta Vista Road to the north line of proposed North Beach Street; being approximately 55 feet wide by 880 feet long consisting of 1 049 acres of land in the J Chirino Survey Abstract No 265 the G W Parker Survey Abstract No 1251 and J McDonald Survey Abstract No 1106 City of Fort Worth Tarrant County Texas 2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624) and 3 Authorize the City Manager to execute the quitclaim deeds conveying the right-of-way to Hillwood Saratoga, L.P McPherson Ranch Home Owners Association and North Tarrant 226 J V DISCUSSION Carter & Burgess Inc. of Fort Worth on behalf of Hillwood Saratoga L.P requests to vacate the above referenced right-of-way in conjunction with the construction and dedication of North Beach Street and the new alignment of Alta Vista Road which will intersect North Beach Street at a 90 degree angle in conformance with the Master Thoroughfare Plan The vacation of this remnant portion of the old Alta Vista Road will allow removal of the existing paving thus alleviating potentially unsafe conditions that will occur if the roadway surface is left intact. At its meeting on January 24 2007 the City Plan Commission recommended approval of the subject street vacation and approved a waiver of the re-plat requirement, contingent on the applicant dedicating a utility easement by a separate instrument to preserve an easement for the existing utilities within the right-of-way The applicant agreed to record a utility easement by separate instrument simultaneously with the right-of-way vacation The vacated right-of-way will revert back to the adjacent property owners to be platted at such time as that property develops. The City of Fort Worth originally obtained the above mentioned right-of-way through platting process and prescription The City does not own land under or adjacent to the above referenced right-of-way Since no City funds have been expended to purchase property or easement rights, collection of the fee value or any portion thereof is recommended by staff to be waived This request is in COUNCIL DISTRICT 2.
