COOKS LANE & LOWERY ROAD
A. The School District agrees to install or to cause to have installed, the street, storm
drainage, street lighting, street name sign and other community facilities
improvements shown as "Current Improvements" on the attached Exhibit A. The
construction cost estimate for "Current Improvements" is shown on the attached
Exhibit B.
B. The School District agrees to comply with all city accepted practices, ordinances,
regulations, as well as provisions of the City Charter, the City Subdivision
Ordinance, City Design Standards and the current Policy for Installation of
Community Facilities in the design, contracting and installation of required "current
improvements".
C. The School District agrees to comply with the General Requirements contained
herein (Attachment A).
D. As shown on the attached "Summary of Cost", the School District agrees to fund its
share of Current Improvements. In addition, School District agrees to pay the City
for its share of the cost of street, storm drainage, street lighting, street name sign
and other community facilities shown as Future Improvements on the attached
Exhibit C. Payment will be made contemporaneously with the execution of this
agreement.
E. The estimated total cost of Current and Future Improvements and related support
services specified in this agreement, including design, construction and inspection is
estimated to be $1,207,214.
In accordance with the City's current Policy for Installation of Community Facilities
as shown in the "Summary of Cost" on page 3, the School District shall contribute
$656,724 of the total amount (54.4% of the total cost) and the City shall contribute
$550,490 of the total amount (45.6% of the total cost). In the event the total cost of
Current and Future Improvements exceeds $1,207,214, the additional costs shall be
shared in the percentages ascribed to each party.

F. The School District, at its sole cost and expense, agrees to acquire and provide all
necessary rights of way and easements required to construct Current and Future
Improvements provided for in this agreement.
G. The School District agrees to relieve the City of any responsibilities for any
inadequacies in the cost estimates supplied for Current and Future Improvements.
H. The School District also agrees to install or adjust all of the required utilities to serve
the development, whether required for Current Improvements or Future
Improvements.
I. The School District agrees that no street construction or storm drainage will begin
prior to City Council approval of this Community Facilities Agreement. (Article
104.100, Ordinance 7234).
J. City agrees to provide, at School District's sole cost and expense, sewer
improvements to the 20-acre School site at Lowery Road and Cooks Lane. The
School District has deposited the amount of $200,000 with the Water Department for
sewer improvements. Prior to beginning construction, City shall advise School
District if any additional funds are required. Within thirty (30) days after notification,
School District shall deposit with City such additional funds as may be necessary. If
change orders are required during the course of construction that increase the cost
of construction, City shall notify School District of such change order(s). School
District shall deposit with the City the cost of the change order(s) within ten (10) days
after such notification. It is the intent of the parties hereto that the School District is
solely responsible for all costs related to the sewer improvements, including but not
limited to engineering and construction cost and acquisition of easements.

1. Forty-two (42) feet and wider street include sidewalk cost. Sidewalks will be installed

ATTACHMENT A
GENERAL REQUIREMENTS
A. It is agreed and understood by the parties hereto that upon acceptance by the City, title to all
facilities and improvements mentioned hereinabove shall be vested at all times in the City of
Fort Worth, and School District hereby relinquishes any right, title, or interest in and to said
facilities or any part hereof.
B. It is further agreed that the deposit by the School District for Future Improvements does not
obligate City to constrict the Future Improvements, such decision to construct the Future
Improvements being solely determined by the City. If the Future Improvements are not
under contract within eight years from date hereof, the deposit shall be returned to School
District, without payment of any interest.
C. A cash deposit shall be made in the Treasury of the City of Fort Worth for the cost of
improvements noted herein. The City of Fort Worth will not pay the School District interest
on any such cash deposit.
(1) At such time that the contract is bid for these projects, the cash deposit shall
be adjusted to one hundred twenty five percent (125%) of the actual bid price.
No contract shall be awarded and no work order shall be issued until such
adjustment is made.
(2) When a cash deposit is made, the additional twenty-five percent (25%)
beyond the one hundred percent (100%) of the estimated School District's share
represents additional funds for change orders during the course of the project.
This twenty five percent (25%) shall be considered the School District's change
order fund.
E. The City shall assume its share of the cost of the Future Improvements to Cooks Lane
covered by this agreement along with the engineering fee only if funds are available for
such participation. In the event that no funds are available for City participation, the School
District may award the contract for these improvements. In such event, City shall refund to
School District the funds deposited for the Future Improvements without payment of any
interest.
F. Anything to the contrary herein notwithstanding, for and in consideration of the promises
and the covenants herein made by the City, the School District covenants and agrees as
follows:

1. The School District shall delegate to the City the authorization to provide and/or
construct water and/or sanitary sewer facilities, storm drainage, street improvements
and street lights as prescribed herein.
2. The School District covenants and agrees to deliver to the City a payment guarantee
in accordance with the provisions of Paragraph C,Page A-1 of this agreement.
3. The School District covenants and agrees to pay to the City its share of the estimated
construction costs at the time that agreement is executed by the parties. The amount
of such estimated payment shall be computed as set out in the Summary of Cost as
presented on page 3 and shall be subject to adjustment to actual costs upon final
completion of the subject work. Any additional payments shall be made promptly
upon demand by City; it being understood that such payments will be made after the
receipt of bids for work, but in every case prior to the award of any construction
contract, unless otherwise specifically set out herein.
4. The School District covenants and agrees that it discriminates against no individual
involving employment as prohibited by the terms of Ordinance No. 7278 (as
amended by Ordinance No. 7400), an ordinance prohibiting discrimination in
employment practice because of race, creed, color, religion, national origin (except
for illegal aliens), sex or age, unless sex or age is a bonafide occupational
qualification, subcontractor or employment agency, either furnishing or referring
applicants to such School District, nor any agent of School District is discriminating
against any individual involving employment as prohibited by the terms of such
Ordinance No. 7278 (as amended by Ordinance No. 7400).
G. Venue of any action brought hereunder shall be in Fort Worth, Tarrant County,Texas.
H. The following descriptions of work apply, as appropriate, to the areas included in the
Community Facilities Agreement:
1. STREETS
Streets as shown in Exhibit_A will be in accordance with plans and specifications
prepared by the City's engineer and approved by the Director of Engineering.
2. STORM DRAINAGE
Storm drain improvements will be in accordance with plans and specifications
prepared by the City's engineer and approved by the Director of Engineering.

3. STREET LIGHTING
a. Installation of streetlights will be in accordance with engineering plans and
specifications approved by the Transportation and Public Works Department.
b. Streetlights on residential and / or collector streets can be installed using overhead
or underground conductors with the approval of the City.
c. Streetlights on arterial streets shall be installed with underground conduit and
conductors.
d. An one and one-fourth inch (1-'/4") schedule 40 PVC conduit shall be installed at
the depth not less than 30 inches and at least 18 inch behind the curb, "clear from
all other utilities".
e. An one and one-fourth inch (1-'/4") schedule 40 PVC conduit shall be installed
between streetlights proposed for installation and the power source to become
operational.
f. A three inch (3") schedule 80 PVC conduit is required when crossing streets at
depth not less than 30 inches, unless indicated otherwise on the plans. Concrete
pull boxes shall be provided at the crossing points. All items are to be provided
and installed by the City.
g. Luminaire ballast shall be rated for multitap operation and each luminaire shall
have it's own photocell.
5. TRAFFIC CONTROL DEVICES
a. The street name sign installations required by this development as reflected in the
Summary of Costs presented on page 3.
b. The City will install the street name signs upon final approval of the street
construction. The street name signs will remain the property of, and will be
maintained by, the City.
6. OTHER WORK
In the event that other work is required, it will be included as specific requirements to
Community Facilities Agreement as mutually agreed upon between the School District
and the City of Fort Worth.

SUBJECT COMMUNITY FACILITIES AGREEMENT WITH THE FORT WORTH INDEPENDENT
SCHOOL DISTRICT FOR ROADWAY IMPROVEMENTS TO LOWERY ROAD AND
COOKS LANE TO SERVE A NEW ELEMENTARY SCHOOL
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute a Community Facilities
Agreement (CFA) with the Fort Worth Independent School District (FWISD) for the installation of
community facilities to serve the new elementary school that is currently under construction in the
southwest quadrant of the Lowery Road and Cooks Lane intersection.
DISCUSSION:
The FWISD has executed a proposed contract for community facilities to serve the new elementary
school that is currently under construction in the southwest quadrant of the Lowery Road and Cooks
Lane intersection. The improvements to Lowery Road and Cooks Lane (see attachment) need to be
completed before the new elementary school is opened August 1, 2000.
These improvements will provide 48 feet of pavement adjacent to the school property, and will tie into
the existing 24 feet of pavement west of the site. In addition, an interim intersection design with
connections to Cooks Lane and Lowery Road to the east will be provided. The improvements will also
provide for a northbound left turn lane on Cooks Lane in order for buses to enter the school site.
FWISD has dedicated the right-of-way (110 feet) for the future widening of Cooks Lane along the
frontage of the FWISD property.
FWISD is paying for its share of the current improvements to Lowery Road and future improvements to
Cooks Lane. The City has received a check from FWISD in the amount of $656,724, which represents
$364,341 for current improvements to Lowery Road, and $292,383 for future improvements to Cooks
Lane.
The $364,341 for current improvements to Lowery Road includes costs for:

Street Lights $ 16,320
Engineering Design $ 58,697
Inspection $ 24,877
The $292,383 for future improvements to Cooks Lane includes costs for:
Paving $147,547

Based on the current CFA policy, the City will contribute its share of the improvements to Lowery Road.
The City is contributing $246,859 for current improvements to Lowery Road, and $303,631 for future
improvements to Cooks Lane.
The $246,859 for current improvements to Lowery Road includes costs for:

Inspection $ 20,853
The $303,631 for future improvements to Cooks Lane includes costs for:

The City will fund its share of future improvements at the time actual construction occurs.
The total costs for current improvements to Lowery Road and future improvements to Cooks Lane is
$1,207,214.
The Water Department has received a check from FWISD in the amount of $200,000 for sewer
improvements to serve the new elementary school. FWISD is solely responsible for all costs related to
the sewer improvements including, but not limited to, engineering and construction costs and
acquisition of easements.
This project is located in COUNCIL DISTRICT 4.
