CONTRACT FOR JOINT ELECTION SERVICES
COUNTY OF TARRANT §
WHEREAS, the Tarrant`County Elections Administrator is the County Officer in charge
,of Tarrant County Election duties; and
WHEREAS, the City of Fort Worth is a home-rule municipal corporation located partly in
Tarrant County and partly in Denton County; and
WHEREAS, on March 4, 1995, the voters of the City of Fort Worth approved the
creation of the Fort Worth Crime Control and Prevention District (the "District") for a
period of five years, together with a one-half cent sales tax to support the District's
operations; and
WHEREAS, pursuant to Section 363.301 of the Texas Local Government Code, the
Fort Worth Crime Control and Prevention District will dissolve on September 30, 2000,
unless the District holds a continuation referendum and a majority of the votes cast in
the referendum are in favor of the District's continuation; and
WHEREAS, on March 1, 2000, the Board of Directors of the Fort Worth Crime Control
and Prevention District adopted a resolution, order and notice calling for an election to
be held on May 6, 2000, on whether to continue the District and its authorized sales tax;
and
WHEREAS, under said resolution, order and notice, the Board of Directors of the.
District authorized the City of Fort Worth to conduct the election on behalf of the District,
including contracting with the Tarrant County Elections Administrator to administer the
election, the costs for which will be reimbursed to the City by the District; and
WHEREAS, it is in the public interest of the inhabitants of the City of Fort Worth and its
Crime Control and Prevention District that the following contract be made and entered
into for the purpose of having Tarrant County furnish certain election services and
equipment needed to conduct the scheduled May 6, 2000, election; and
WHEREAS, on May 6, 2000, the Fort Worth Independent School District will hold an
election to elect members to its Board of Trustees; and
WHEREAS, on May 6, 2000, the Tarrant County College District will hold an election to
elect members to its Board of Directors; and
WHEREAS, the Fort Worth Crime Control and Prevention District, the Fort Worth
Independent School District, and the Tarrant County College District have all adopted
resolutions providing that their respective elections will be held jointly pursuant to
Section 271.002 of the Texas Election Code, and that they shall share equally in the
costs of said elections to the extent that the polling places of each district are
coextensive with the polling places of the other districts; and
WHEREAS, the implementation and actual management and administration of the joint
elections shall be by the Tarrant County Elections Administrator pursuant to contracts to
be entered into between the Tarrant County Elections Administrator and each of the
districts; and
WHEREAS, this contract for election services constitutes the controlling agreement by
which the Fort Worth Crime Control and Prevention District will hold a joint election with
the Fort Worth Independent School District and the Tarrant County College District
pursuant the attached resolutions adopted by the District on March 1, 2000, and
expressly made a part of the terms and conditions of this contract;
NOW THEREFORE, the City of Fort Worth, a home-rule municipal corporation located
in Tarrant County and Denton County, hereinafter referred to as "City", acting herein
pursuant to the authority and direction expressed by the Fort Worth Crime Control and
Prevention District, and Tarrant County, acting herein by and through its duly authorized
elections Administrator, hereinafter referred to as "County", do hereby covenant and
agree as follows:
I. DUTIES AND SERVICES OF TARRANT COUNTY:
The Tarrant County Elections Administrator agrees to coordinate, supervise, and
handle all aspects of administering the election on the continuation of the Fort
Worth Crime Control and Prevention District in accordance with the provisions of
Section 31.100, of the Texas Election Code, the joint election resolutions
adopted by the Fort Worth Crime Control and Prevention District, the Fort Worth
Independent School District, and the Tarrant County College District, and as
further outlined in this Agreement, and in Exhibit "B" hereof.
The County shall be responsible for performing the following duties and shall
furnish the following services and equipment:
(a) Arrange for the notification, training, and compensation of all election judges and
alternate judges, and of all clerks, and the judge to the Central Counting Station.

The Elections Administrator will be responsible for notifying each election judge
and alternate judge of his or her appointment and for determining the number of
clerks and other election workers authorized to work at each voting location.
Election judges shall be responsible for picking up election supplies and
materials at the place determined by the Tarrant County Elections Administrator.
(b) Pay cost of election judges and clerks.
(c) Procure, prepare, proof, and distribute ballots.
(d) Procure, prepare, and distribute election judge kits and provide training.
(e) Procure, prepare, and distribute tables and chairs, transport equipment to and
from the polling places.
(f) Procure and deliver to polling places all OPTECH EAGLE equipment. The rental
cost shall include programming, preparation, delivery and pick-up of equipment,
use of ballot boxes, and use of voting booths. (See Exhibit "C")
(g) Arrange for the use of voting places.
The Elections Administrator will select and arrange for the use of and payment of
all voting locations approved by the Fort Worth Crime Control and Prevention
District. Voting locations will be, whenever possible, those locations listed on
Exhibit "A" of this Agreement. Voting precincts may be combined upon the
approval of the Fort Worth Crime Control and Prevention District. In the event a
voting location is not available, the Elections Administrator will notify the City of
any change from the locations listed on Exhibit "A". At such time as commitments
for voting locations in all precincts are secured, the Elections Administrator shall
furnish the City a list of all such locations and their corresponding precincts for
final approval. Thereafter, the Elections Administrator immediately shall notify the
City of any changes to the final list.
The final list of voting locations secured by the Elections Administrator shall be
furnished to the City no later than February 15, 2000.
(h) Supervise the conduct of early voting in person and by mail and supply personnel
to serve as deputy early voting clerks. County will furnish the Early Voting
Equipment as prescribed in Exhibit "D" attached hereto.
With respect to the Fort Worth Crime Control and Prevention District election,
Robert Parten, Tarrant County Elections Administrator, will serve as Early Voting
Clerk in compliance with Sections 83.001 and 83.005 of the Texas Election
Code. Gloria Pearson, Fort Worth City Secretary, will serve as Chief Deputy
Early Voting Clerk. Other early voting clerks will be appointed as needed to

process early voting by mail and to conduct early voting at the branch early
voting locations.
Early voting for the elections will be conducted on weekdays beginning April 19, 2000,
and continuing through May 2, 2000. Voting will be conducted at the locations, and
times indicated below:

Extended hours for early voting shall take place at all early voting sites on
Saturday, Monday and Tuesday, April 29, May 1, and May 2, 2000 from 7:00
a.m. to 7:00 p.m.,each day and Sunday, April 30, 2000 from 11:00 a.m. to 4:00
p.m.
Any person eligible to vote early by personal appearance may do so at any one
of the early voting locations.
(1) All requests for early voting by mail which are received by the City will be
transported on the day of receipt to the Office of the Tarrant County Elections
Administrator for processing. Persons voting by mail will send their marked
ballots to the Office of the Tarrant County Elections Administrator.
(j) All early voting ballots (those cast by mail and those cast by personal
appearance) will be prepared for counting by an Early Voting Ballot Board
appointed by the Fort Worth Crime Control and Prevention District in accordance
with Section 87.001 of the Texas Election Code.
(k) Arrange for use of a Central Counting Station and for tabulating personnel and
equipment needed at the Counting Station and assist in preparation of programs
and test materials for tabulation of the ballots to be used with electronic voting
equipment.
(1) Provide legal notice of the date, time, and place of the testing of the electronic
tabulation equipment and conduct such testing.
(m) Supervise the handling and disposition of election returns, voted ballots, etc., and
tabulate official returns and assist in preparing the tabulation for the official
canvass.
Each precinct judge will bring the voted ballots, the election returns, and supplies
to the Central Counting Station at the Tarrant County Courthouse or designated
county building immediately after the polls close on election day.

The Tarrant County Elections Administrator will be responsible for establishing
and operating the Central Counting Station to receive and tabulate the voted
ballots in accordance with the provisions of Section 127.002 of the Texas
Election Code, and of this Agreement. The Counting Station Manager shall be
Robert Parten pursuant to Section 127.003 of the Texas Election Code.
Tabulation Supervisors shall be Linda Funkhouser and Gayle Hamilton pursuant
to Section 127.004 of the Texas Election Code. Assistant to Tabulation
Supervisors shall be Leo Angell pursuant to Section 127.005 of the Texas
Election Code. Presiding Judge of the Counting Station shall be Jeanne Lyon.
The Manager of the Central Counting Station will electronically deliver to the City
timely cumulative reports of the election results as precincts are tabulated. The
City Secretary of the City will be responsible for releasing cumulative totals and
precinct returns from the election to the media and the general public. The place
of release will be the office of the City Secretary, City of Fort Worth, 1000
Throckmorton Street, Fort Worth, Texas 76102.
The County Elections Administrator will prepare the unofficial canvass report
after all precincts have been counted, and will deliver a copy of the unofficial
canvass to the City of Fort Worth as soon as possible after all returns have been
tabulated, but in no event later than 10:00 a.m. , Monday, May 8, 2000.
(n) Tarrant County will conduct a manual count of at least one percent (1%) of the
election precincts or in three precincts, whichever is greater, on Tuesday, May 9,
2000, and submit a written report of the results to City Secretary Gloria Pearson
by 5:00 p.m. Wednesday, May 10, 2000, in accordance with Section 127.201 of
the Texas Election Code.
(o) Provide at no cost for the storage of elections records for sixty (60) days as
provided by law.
(p) Provide, if necessary, assistance in translating the ballots into Spanish. (No
charge.)
(q) Provide list of voters who voted.
(r) Calculate each portion of the total costs and divide the costs between those other
jurisdictions conducting a joint election with the Fort Worth Crime Control and
Prevention District, including the Fort Worth Independent School District and the
Tarrant County College District as set out in the joint election resolutions
previously provided to the County Elections Administrator.
II. DUTIES AND SERVICES OF CITY OF FORT WORTH
The City shall, at its sole cost and expense, perform the following:

(a) Prepare appropriate documents for assisting the Elections Administrator in
establishing the precincts and polling places and in selecting the election judges
for each polling place and the members of the Early Voting Ballot Board.
(b) Prepare all election orders, resolutions, notices, and other pertinent documents
for adoption by the Board of Directors of the Fort Worth Crime Control and
Prevention District, and for execution by the appropriate District officer; and be
responsible for all actions required by law for calling the election, appointing the
presiding judges, alternate judges, judge of the Central Counting Station, and
other election officers, establishing precincts and polling places, handling
contests, canvassing the returns and declaring the results.
(c) Obtain the tabulating supervisor and assistants and the Central Counting Station
Manager, as recommended by the Elections Administrator.
(d) Prepare and publish in the official City newspaper, and post, all required election
notices.
(e) Deliver to the Elections Administrator on February 21, 2000, or as soon as
possible, the official wording that is to be printed on the ballot with the exact form,
orders, wording and spelling that is to be used. The City Secretary shall have the
right to review and approve the final form and wording of the proposed ballot as it
is related to the election.
(f) Provide the services necessary to translate any election documents into Spanish.
(g) Pay any additional costs incurred by the Elections Administrator if a recount for
the election is required, or the election is contested in any manner.
(h) Prepare and submit to the U.S. Department of Justice under the Federal Voting
Rights Act of 1965, the required submissions on voting changes.
(i) Establish phone service (21ines) at five Early Voting locations, no later than April
1, 2000. (Log Cabin Village, Southwest Regional Library, Fire Station #31, Fort
Worth Municipal Bldg., Riverside Community Center)
(j) Bills shall be submitted to the City by the Elections Administrator and payment
shall be made directly by the City to the Elections Administrator, who will be
responsible for payment to all parties who have provided services, supplies, and
voting locations for the elections. The City shall not be liable to any third parties
for any default by the County in connection with holding the election, including
the failure by the County or its Elections Administrator to pay for services,
supplies, and voting locations for the election.
111. PAYMENT FOR SERVICES

(a) For and in consideration of the complete and satisfactory performance of the
services described in Section I, "Duties and Services of Tarrant County", the City
will pay Tarrant County on the basis of the actual costs incurred by Tarrant
County in furnishing same, plus an administrative fee of 10% of such actual
costs; provided, however, that in no event shall payment by the City to Tarrant
County for actual costs and administrative fees exceed the total sum of
$89,284.80 without the formal approval of the Fort Worth City Council.
The estimated costs to be incurred by Tarrant County in conducting the election,
plus 10% administrative fee, are reflected on Exhibit "B" attached hereto.
(b) As partial payment of the above described contract price, the City shall pay to
Tarrant County the sum of $44,000.00, at the time this contract is approved and
executed by the City. The balance for such services shall be paid within thirty
(30) days from the receipt of the bill for same, said billing to follow the date of the
election.
(c) In the event the balance due reflects an actual cost and administrative fee of
greater than $45,284.80, then the City Secretary will present to the City Council
for consideration a request for payment of that portion of the balance due which
is greater than the estimated $89,284.80.
(d) If the estimated costs exceed the actual expenses incurred by the County, the
amount of the difference shall be refunded to the City.

V. JOINT ELECTIONS:
This contract and agreement is entered into by the City of Fort Worth on behalf of
the Fort Worth Crime Control and Prevention District, and shall constitute a Joint
Election Agreement for purposes of conducting joint elections by the Fort Worth
Crime Control and Prevention District, the Fort Worth Independent School
District, and the Tarrant County College District, as authorized by those certain
resolutions adopted by the Fort Worth Crime Control and Prevention District,
copies of which are attached hereto and expressly made a part hereof.

Tarrant County,Texas, a corporate body politic, hereinafter designated as"the County", represented in this
Agreement by the Elections Administrator, hereby agrees to rent the following work stations to the hereinafter
identified organization on the terms stated below.
City of Fort Worth, Texas
hereinafter designated as"Renter", has requested the rental of 14 Early Voting Workstation(s) at $250.00 per unit.
1.
The rental period for work station(s) shall commence on the 19th day of April 2000 and continue
through the 2nd day of May ,2000. Rental shall not extend to a date which will interfere with subsequent
elections for which the County is responsible.
II.
Only equipment which the County believes to be in safe operating condition will be provided to the extent
provided by law and the Renter agrees to hold the County harmless for any damages arising from the use thereof.
III.
Renter agrees to reimburse the County for the costs to repair damages to the said equipment during such
time as the County does not have control custody of said equipment.
The equipment will be delivered by the County to:
City of Fort Worth Early Voting Sites designated in the Election Services Contract
between the City and the County,
and picked up by the County at said place. '/

Tarrant County, Texas, a corporate body politic, hereinafter designated as "the County", represented in this Agreement by the
Elections Administrator, hereby agrees to rent the following voting machine(s) to the hereinafter identified organization on the terms

II.
