WHEREAS, the City of Fort Worth (City) and Spiars & DeOtte,
Inc. , (Engineer) made and entered into City Secretary Contract No.
22573, (the Contract) which was authorized by the City Council by
M&C C-15932 on the 13th day of March 1997; and subsequently revised
by two previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Sanitary Sewer
Rehabilitation Contract XLV (45) .
WHEREAS, it has become necessary to execute Amendment No. 3 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated March 24,
2000, a copy of which is attached hereto and incorporated herein.
The cost to City for the additional design services to be performed
by Engineer total $1, 961.56.

Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $135,850.56.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mr. Sholola:
Dunaway Associates Inc. (DAI) is pleased to present this Amendment No. 3 for the following
additional services that were beyond our original scope of services:
Survey and design of the additional of about 71 LF of M-74R.
Design of the addition of about 169 LF of M-74.
A summary of the budget which is based on the actual expenses incurred is as follows:

Principal (0.5 Hr @ $100.00/ Hr) $ 50.00
Engineer(25.0 Hr @ $66.35 / Hr) $1,658.75
CADD Technician (1.5 Hr @ $46.20 / Hr) $ 69.30
Draftsperson (5.0 Hr @ $31.35 /Hr) $ 156.75
Printing / Reproduction $ 26.76

Spiars & DeOtte, is requesting reimbursement for the additional design and survey ser-
vices they provided as requested by the City.
The amendment will reimburse Spiars and DeOtte for the survey and design services they
provided for an additional 240 feet of severely deteriorated sewer lines located within the
project area. The poor condition of these lines was previously unknown.
Spiars & DeOtte, Inc., has requested reimbursement in the amount of$1,961.56 increas-
ing the contract fee from $133,889.00 to $135,850.56. I believe this fee is fair and rea-
sonable for the additional services that were provided.
Please authorize this additional fee by your signatures on the attached contract amend-
ment form.
